PUBLIC SERVICE EMPLOYMENT ACT

Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 20 of the Public Service Employment Act (see footnote a), hereby approves the exclusion from the application of the definitions “deployment” and “internal appointment process” in subsection 2(1), paragraphs 22(2)(a) to (c) (see footnote b) and sections 40, 41 (see footnote c), 48, 51 to 53 (see footnote d), 57, 59 and 62 of that Act to positions in Statistics Canada whose function is solely to provide administrative or management support or to perform data processing duties for the purpose of conducting the population census and the agriculture census as described in the Statistics Act (see footnote e) and to the persons appointed or deployed to those positions on a specified term basis, other than other persons mentioned in subsection 5(1) of that Act.
STATISTICS CANADA CENSUS-RELATED TERM EMPLOYMENT
EXCLUSION APPROVAL ORDER
Whereas the Public Service Commission has decided that it is neither practicable nor in the best interests of the public service to apply certain provisions of the Public Service Employment Act (see footnote f) to positions in Statistics Canada whose function is solely to provide administrative or management support or to perform data processing duties for the purpose of conducting the population census and the agriculture census as described in the Statistics Act (see footnote g) and to the persons appointed or deployed to those positions on a specified term basis, except for other persons mentioned in subsection 5(1) of that Act;
And whereas, pursuant to subsection 20(2) of the Public Service Employment Act (see footnote h), the Public Service Commission has consulted with the employer;
Therefore, the Public Service Commission, pursuant to section 20 of the Public Service Employment Act (see footnote i), hereby excludes from the application of the definitions “deployment” and “internal appointment process” in subsection 2(1), and of paragraphs 22(2)(a) to (c) (see footnote j), and sections 40, 41 (see footnote k), 48, 51 to 53 (see footnote l), 57, 59 and 62 of that Act to positions in Statistics Canada whose function is solely to provide administrative or management support or to perform data processing duties for the purpose of conducting the population census and the agriculture census as described in the Statistics Act (see footnote m) and to the persons appointed or deployed to those positions on a specified term basis, except for other persons mentioned in subsection 5(1) of that Act.
This Order may be cited as the Statistics Canada Census-Related Term Employment Exclusion Approval Order.

EXPLANATORY NOTE
(This note is not part of the Order.)
By the Order the Governor General in Council approves the exclusion of positions in Statistics Canada whose function is solely to provide administrative or management support or to perform data processing duties for the purpose of conducting the population census and the agriculture census as described in the Statistics Act and the persons appointed or deployed to those positions on a specified term basis, other than other persons mentioned in subsection 5(1) of that Act, from the application of the following provisions of the Public Service Employment Act:
(a) the definition “deployment” in subsection 2(1);
(b) the definition “internal appointment process” in subsection 2(1);
(c) paragraphs 22(2)(a) to (c) (Commission Regulation regarding appointment priorities and acting appointments);
(d) sections 40 and 41 (Priorities);
(e) section 48 (Persons being considered for appointment);
(f) sections 51 to 53 (Deployment);
(g) section 57 (Indeterminate employment);
(h) section 59 (Conversion to indeterminate); and
(i) section 62 (Termination of employment).
