Rule Amending Criminal Appeal Rule 63 Made Pursuant to Section 482 of the Criminal Code with Respect to Criminal Appeals to the Court of Appeal of New Brunswick

The Court of Appeal of New Brunswick, pursuant to section 482 (see footnote a) of the Criminal Code (see footnote b), hereby makes the annexed Rule Amending Criminal Appeal Rule 63 Made Pursuant to Section 482 of the Criminal Code with Respect to Criminal Appeals to the Court of Appeal of New Brunswick.

This Rule was made at a meeting of the Judges of the Court of Appeal of New Brunswick on March 15, 2010.

RULE AMENDING CRIMINAL APPEAL RULE 63 MADE PURSUANT TO SECTION 482 OF THE CRIMINAL CODE WITH RESPECT TO CRIMINAL APPEALS TO THE COURT OF APPEAL OF NEW BRUNSWICK

AMENDMENTS

1. (1) The portion of paragraph 63.07(7) of the English version of Criminal Appeal Rule 63 Made Pursuant to Section 482 of the Criminal Code with Respect to Criminal Appeals to the Court of Appeal of New Brunswick (see footnote 1) before clause (a) is replaced by the following:

(7) When the evidence has been transcribed, the court stenographer shall forthwith

(2) Paragraph 63.07(9) of the Rule is replaced by the following:

(9) A party to an appeal shall pay the fees prescribed under the Recording of Evidence Act for a copy or transcript of any material prepared under subsection 682(2) of the Criminal Code.

COMING INTO FORCE

2. This Rule comes into force on May 1, 2010.
