MONTREAL PORT AUTHORITY

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport for the Montreal Port Authority (hereinafter “the Authority”) under the Canada Marine Act (hereinafter “the Act”), effective March 1, 1999;

WHEREAS Schedule “B” of the Letters Patent describes the federal real property managed by the Authority;

WHEREAS, having notified the Board of Directors of the Authority, the Minister of Transport, acting on his own initiative, wishes to issue Supplementary Letters Patent to remove from Part I of Schedule “B” of the Letters Patent the federal real property described below effective on the specified dates and to impose certain restrictions on the said federal real property as of the date hereof;

NOW THEREFORE, under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended as follows:

1. Each of the federal real properties described in Annex “A” hereto are withdrawn from Part I of Schedule “B” of the Letters Patent, effective on (i) the date in Column A of the following table regarding this property or (ii) the date in Column B regarding this property if the lease is extended by the Lessee of the property in question exercising its option to renew.

2. Notwithstanding any other provision of these Letters patent, the Authority may not consent to any leases, permits, agreements, easements or other encumbrances for the properties described in Annex A, which would subsist beyond the date for withdrawal of these properties. Where two such possible dates are specified for a property, the later of these dates shall apply on the condition that the Lessee of the property in question exercises its option to renew.
