CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Greenhouse bell peppers

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on March 22, 2010, from the Director General of the Trade Programs Directorate at the Canada Border Services Agency (CBSA) stating that the President of the CBSA had initiated an investigation into a complaint respecting the alleged injurious dumping of greenhouse bell peppers originating in or exported from the Netherlands (the subject goods).

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary inquiry (Preliminary Injury Inquiry No. PI-2009-005) to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Secretary on or before April 7, 2010. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before April 7, 2010.

On April 13, 2010, the Tribunal will distribute the public information received from the CBSA to all parties that have filed notices of participation, and the confidential information to counsel who have filed a declaration and undertaking with the Secretary.

Submissions by parties opposed to the complaint must be filed not later than noon, on April 22, 2010. These submissions should include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning the questions of

  • whether there are goods produced in Canada, other than those identified in the CBSA’s statement of reasons for initiating the investigation, that are like goods to the subject goods;
  • whether the subject goods comprise more than one class of goods;
  • which domestic producers of like goods comprise the domestic industry; and
  • whether the information before the Tribunal discloses a reasonable indication that the alleged dumping of the subject goods has caused injury or retardation, or is threatening to cause injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on April 29, 2010. At that time, parties in support of the complaint may also make submissions to the Tribunal.

Parties should note that the Tribunal does not consider exclusion requests during a preliminary injury inquiry, and, therefore, none should be filed at this stage. Should the matter proceed to a final inquiry, particulars regarding the schedule for filing exclusion requests will be included in the notice of commencement of inquiry.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. (See Procedural Guidelines for the Designation and Use of Confidential Information in Canadian International Trade Tribunal Proceedings available on the Tribunal’s Web site at www.citt-tcce.gc.ca.)

The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 25 copies. The Tribunal will distribute the public submissions to all parties that have filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

The Secretary has sent the notice of commencement of preliminary injury inquiry and the preliminary injury inquiry schedule to the domestic producers, to importers and to exporters with a known interest in the preliminary injury inquiry. The notice and schedule of key inquiry events are available on the Tribunal’s Web site at www.citt-tcce.gc.ca.

The information is fully encrypted from the sender to the Tribunal.

However, parties must still file paper copies in the required number as instructed. Where a party is required to file hard copies, the electronic version and the hard-copy version must be identical. In case of discrepancies, the hard-copy version will be considered the original.

At the end of the official process, the Tribunal will issue a decision supported by a summary of the case, a summary of the arguments and an analysis of the case.

The Tribunal’s decision will be posted on its Web site and distributed to the parties and interested persons, as well as to organizations and persons who have registered to receive decisions of the Tribunal.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2009-069) on March 24, 2010, with respect to a complaint filed by the Chamber of Shipping of British Columbia (COS), of Vancouver, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. FP802-090083) by the Department of Fisheries and Oceans (DFO). The solicitation was for the management of the billing and collection of the Canadian Coast Guard’s Marine Navigation Services Fee.

COS alleged that DFO improperly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

Oil country tubular goods

Notice is hereby given that, on March 23, 2010, further to the issuance by the President of the Canada Border Services Agency of final determinations dated February 22, 2010, that the aforementioned goods (Inquiry No. NQ-2009-004) had been dumped and subsidized, and pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal (the Tribunal) found that

  • the dumping and subsidizing of those aforementioned goods that are coupling stock had not caused injury or retardation and were not threatening to cause injury; and
  • the dumping and subsidizing of those aforementioned goods that are casing and tubing had caused injury.

The Tribunal excluded pup-joints, welded or seamless, heat-treated or not heat-treated, in lengths of up to 3.66 m (12 feet), from its injury finding.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2009-130) from Valcom Consulting Group Inc. (Valcom), of Ottawa, Ontario, concerning a procurement (Solicitation No. W8484-07AA15/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of informatics professional services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Valcom alleges that PWGSC changed the evaluation criteria after the solicitation closed.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

NOTICE

On February 2, 2010, the Canadian International Trade Tribunal issued Notice of Expiry No. LE-2009-004 relating to the aforementioned order. Persons or governments requesting or opposing the initiation of an expiry review of this order were requested to file written submissions containing relevant information, opinions and arguments with the Secretary of the Canadian International Trade Tribunal no later than February 22, 2010, and replies by March 5, 2010.

The Canadian International Trade Tribunal received no submissions in support of an expiry review and a continuation of the order. Consequently, no expiry review will be initiated.

Pursuant to the Special Import Measures Act, an order continuing a finding of injury or threat of injury and the associated special protection in the form of anti-dumping duties expire five years from the date of the order, unless an expiry review has been initiated.

In light of the foregoing, the Canadian International Trade Tribunal hereby gives notice that, pursuant to paragraph 76.03(1)(b) of the Special Import Measures Act, the order made by the Canadian International Trade Tribunal on December 7, 2005, in Expiry Review No. RR-2004-008 will expire on December 6, 2010.

Astral submitted that under the procedure set out in Broadcasting Notice of Consultation 2010-41, it would not have the opportunity to reply to the arguments that could be raised by TVA Group Inc. in the filings it will submit to the public record of this proceeding. Astral requested that its existing licensed service Super Écran be granted a right of reply as provided in Regulatory frameworks for broadcasting distribution undertakings and discretionary programming services — Regulatory policy, Broadcasting Public Notice CRTC 2008-100, October 30, 2008.

Given the importance of the issues raised in this proceeding, the Commission considers it appropriate to allow interested parties to reply to comments. Accordingly, parties who participated in the first phase of this process will be allowed to file reply comments by no later than April 20, 2010. Replies should be no longer than 10 pages and are to be received, not merely sent, by that date.

The Commission stipulates that the reply comments must address only the points raised in comments filed by other parties.

Call for comments on issues related to the digital television transition

The Commission calls for comments and seeks further information on the number of Canadians who could potentially lose service as a result of the transition to over-the-air digital television (DTV), on its proposal to authorize the provision by broadcasting distribution undertakings of a free package consisting of all local and regional conventional television signals currently available over-the-air in a given market, on possible regulatory measures to educate consumers regarding the DTV transition, on the implementation of one or more trial markets for DTV conversion, and on other related matters.

The Commission will accept comments that it receives on or before May 6, 2010. The Commission cannot be held responsible for postal delays and will not notify a party whose comment is received after the deadline. The comment will not be considered by the Commission and will not be part of the public file.

The Commission will not formally acknowledge comments. It will, however, fully consider all comments, and they will form part of the public record of the proceeding, provided that the procedures for filing set out in the notice have been followed.

Reference to the Federal Court of Appeal — Commission’s jurisdiction under the Broadcasting Act to implement a negotiated solution for the compensation for the fair value of private local conventional television signals

In A group-based approach to the licensing of private television services, Broadcasting Regulatory Policy CRTC 2010-167, March 22, 2010, the Commission sets out its determinations with respect to a group-based approach to the licensing of private local television services, including the determination that a value for program distribution regime is necessary to ensure the fulfillment of the policy objectives set out in section 3 of the Broadcasting Act (the Act). However, the Commission did not determine the legal issue as to whether it has the jurisdiction under the Act to implement a negotiated solution for compensation for the fair value of private local conventional television signals. Consequently, the Commission determined that it would refer the matter to the Federal Court of Appeal (the Court).

Pursuant to section 18.3 and subsection 28(2) of the Federal Courts Act, the Commission therefore orders that the following question of law be referred to Court for hearing and determination and requests disposition of the matter on an expedited basis:

Is the Commission empowered, pursuant to its mandate under the Broadcasting Act, to establish a regime to enable private local television stations to choose to negotiate with broadcasting distribution undertakings a fair value in exchange for the distribution of the programming services broadcast by those local television stations?

The Commission expects to receive directions on procedure from the Court. The Court’s directions on procedure will be available at the Court, and copies can be obtained from the Commission on request.

A group-based approach to the licensing of private television services

The Commission sets out its determinations on issues relating to a group-based approach to the licensing of large English-language private television ownership groups. The key areas addressed are the following:

  • Canadian programming expenditures;
  • Canadian content requirements;
  • Programs of national interest;
  • Maintaining local programming;
  • Expenditures on non-Canadian programming;
  • Canadian independent production;
  • Regional production;
  • Continuing application of social policies;
  • Ownership issues;
  • Administrative renewals; and
  • Appropriate length of licence term.

The Commission also addresses the following issues relating to revenue support for English- and French-language conventional television broadcasters:

  • Review of the Local Programming Improvement Fund; and
  • Proposed regime for value for signal and the question of the Commission’s jurisdiction to be referred to the Federal Court of Appeal for expedited hearing and determination.

Further, the Commission notes its determinations, set out in broadcasting regulatory policies to be issued shortly, relating to advertising on the video-on-demand platform and to the sale of commercial advertising in the local availabilities of non-Canadian specialty services. It also states its intention to conduct a review of its policies concerning direct-to-home (DTH) services prior to the next licence renewal proceedings for the two DTH undertakings currently in operation (Shaw Direct and Bell TV).

Finally, the Commission addresses various issues relating to the digital television (DTV) transition for English- and French-language conventional television broadcasters, including its revised list of mandatory markets, the date set for the DTV transition, and the operation of analog transmitters in and outside the mandatory markets.
