Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order (File No. PR-2009-026) on September 3, 2009, with respect to a complaint filed by Flag Connection Inc. (FCI), of Lion’s Head, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. C1111-080972/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Canadian Heritage. The solicitation was for the provision of paper hand flags.

FCI alleged that PWGSC improperly awarded a contract to a non-compliant bidder.

The Tribunal found that FCI was not a potential supplier in respect of the designated contract that was the subject of the inquiry and, therefore, did not have standing to file the complaint. The Tribunal terminated the inquiry and dismissed the complaint.

The licensee proposes to add several rebroadcasting transmitters to its licence. These rebroadcasting transmitters, located throughout northern British Columbia, are all currently in operation.

2. The Commission notes that the transmitters at Kitwancool and Masset are already associated with the licence of CFNR-FM Terrace. The following paragraphs are therefore withdrawn:

The transmitter at Kitwancool would operate on frequency 96.1 MHz (channel 241LP) with an ERP of 6.4 W (non-directional antenna with an effective height of the antenna above average terrain of 117.3 m).

The transmitter at Masset would operate on frequency 96.1 MHz (channel 241LP) with an ERP of 6.4 W (non-directional antenna with an effective height of the antenna above average terrain of 23.2 m).

3. The Commission adds, for consideration, the following paragraphs to this Notice of Consultation:

The transmitter at Moricetown would operate on frequency 95.1 MHz (channel 236LP) with an ERP of 8 W (non-directional antenna with an effective height of the antenna above average terrain of 14 m).

The transmitter at Cheslatta would operate on frequency 95.1 MHz (channel 236LP) with an ERP of 10 W (non-directional antenna with an effective height of the antenna above average terrain of 14 m).

REGULATORY POLICY 2009-562

Conditions of licence for competitive Canadian specialty services operating in the genres of mainstream sports and national news

The Commission announces the standard conditions of licence for competitive Canadian mainstream sports and national news specialty services. The conditions of licence are set out in the appendices to the document.

The Commission is prepared to consider applications for broadcasting licences or licence amendments to operate specialty services in these genres subject to the standard conditions of licence. Any new entrants should file their applications as Category 2 services and expect that the standard conditions of licence will be imposed at licensing. Incumbents may apply for a licence amendment to replace their current obligations with the standard conditions of licence.

In light of its commitment in Broadcasting Public Notice 2008-100 to implement the standard conditions of licence immediately, the Commission is now prepared to consider applications for licences subject to the conditions of licence set out in the appendices to Broadcasting Regulatory Policy CRTC 2009-562. Until the regulatory revisions required to fully implement the policies set out in Broadcasting Public Notice 2008-100 come into effect, any new entrants should file their applications as Category 2 services and expect that the standard conditions of licence will be imposed at licensing. Incumbents may apply for a licence amendment to replace their current obligations with the standard conditions of licence.
