EXPORT AND IMPORT PERMITS ACT

Cancellation of obsolete General Export Permits and a General Import Permit

Under Canada’s Export and Import Permits Act (EIPA), the Minister of Foreign Affairs has the authority to issue, amend, suspend, cancel or reinstate General Export Permits (GEPs) and General Import Permits (GIPs). GEPs and GIPs allow a resident of Canada to export or import certain controlled goods, as specified by the permit, without applying for an individual permit.

In order to ensure that the federal government’s export control regulations and policies are up-to-date and consistent, the Minister of Foreign Affairs, on July 3, 2009, has cancelled the following obsolete GEPs and GIP: GEP No. Ex. 14 — Export of Specimens Permit; GIP No. Ex. 17 — Import of Specimens (Personal or Household) Permit; GEP No. Ex. 7 — Export of One Cent Bronze Coins Permit; GEP No. Ex. 15 — Eggs; and GEP No. Ex. 16 — Egg Products.

Cancellation of General Export Permit No. Ex. 14 — Export of Specimens Permit (GEP 14) and General Import Permit No. Ex. 17 — Import of Specimens (Personal or Household) Permit (GIP 17)

On July 4, 1975, the Export Control List (ECL) and Import Control List (ICL) were amended to add item 1011 (later renumbered as item 5000) and item 30, respectively. These amendments were made to control the export and import of “all specimens of species of endangered wild fauna and flora or by-products of such specimens” as listed in the ECL and ICL. General Export Permit No. Ex. 14 (GEP 14) — Export of Specimens Permit and General Import Permit No. Ex. 17 (GIP 17) — Import of Specimens (Personal or Household) Permit were issued on the same day. GEP 14 allowed any person to export from Canada the relevant specimens without an individual export permit, provided that certain conditions were met. GIP 17 allowed any person to import into Canada the relevant specimens without an individual export permit, provided that certain conditions were met.

Item 1011 and item 30 were included on the ECL and ICL to implement obligations assumed by Canada under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), an international agreement for the protection of wild species against over-exploitation through international trade. CITES was originally implemented through regulations made pursuant to the Export and Import Permits Act (EIPA), which is administered by Foreign Affairs and International Trade Canada (FAITC).

The control of the items in question pursuant to the EIPA was repealed on December 19, 1996, as a result of the transfer of these controls to Environment Canada. The authority for this transfer was contained in the Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act (WAPPRIITA). WAPPRITTA now covers all federal trade controls related to the conservation and protection of wild species of flora and fauna, and has since it came into force on May 15, 1996.

Despite the prompt removal of these items from the schedule to the ECL and ICL in 1996, the cancellation of GEP 14 and GIP 17 was inadvertently overlooked. Eliminating this outdated GEP and GIP will ensure consistency in Canada’s export and import control policies.

On July 3, 2009, GEP 14 and GIP 17 were officially cancelled.

EXPLANATORY NOTE

Cancellation of General Export Permit No. Ex. 7 — Export of One Cent Bronze Coins Permit (GEP 7)

On April 30, 1974, the item “Canadian one cent bronze coin” was added to the Export Control List (ECL) under item number 5667. General Export Permit No. Ex. 7 — Export of One Cent Bronze Coins Permit (GEP 7) was promulgated on the same day to allow the export of one cent bronze coins of Canada having an aggregate face value not exceeding $1.00 or one cent bronze coins of Canada in uncirculated coin sets issued by the Royal Canadian Mint, without an individual export permit, provided that specified conditions were met.

On April 13, 1989, in the scope of broad changes to the ECL, controls relating to the export of Canadian one cent bronze coins were removed. However, the cancellation of GEP 7 was inadvertently overlooked. Eliminating this outdated GEP will promote consistent export control policies in Canada.

On July 3, 2009, GEP 7 was officially cancelled.

Cancellation of General Export Permit No. Ex. 15 — Eggs (GEP 15) and General Export Permit No. Ex. 16 — Egg Products (GEP 16)

On February 2, 1984, eggs and egg products were added to the Export Control List (ECL) under item number 1041 for the purpose of monitoring the exportation of these items.

On June 3, 1984, General Export Permit No. Ex. 15 — Eggs (GEP 15) and General Export Permit No. Ex. 16 — Egg Products (GEP 16) were promulgated so that individual export permits would not be required to export items listed under ECL item 1041, provided that the amount to be exported did not exceed the amounts specified in the GEPs.

On November 22, 1984, the ECL was amended and controls relating to the export of eggs and egg products were removed, therefore making GEP 15 and GEP 16 obsolete.

The cancellation of GEP 15 and GEP 16 was inadvertently overlooked when the controls relating to the export of eggs and egg products were removed from the ECL. Eliminating these outdated GEPs will promote consistent export control policies in Canada.

On July 3, 2009, GEP 15 and GEP 16 were officially cancelled.

Notice No. SMSE-012-09 — New issue of ICES-002

Notice is hereby given that Industry Canada is releasing the following updated document:

Interference-Causing Equipment Standards 002 (ICES-002), Issue 5: Spark Ignition Systems of Vehicles and Other Devices Equipped with Internal Combustion Engines, which sets out the technical requirements for the impulse electric field strength of radio noise produced by spark ignition systems of vehicles and other devices equipped with internal combustion engines.

The above-mentioned document was updated to reflect recent changes in equipment and certification requirements.

General information

ICES-002, Issue 5, will come into force as of the date of publication of this notice.

This document has been coordinated with industry through the Radio Advisory Board of Canada (RABC).

The Radio Equipment Technical Standards Lists will be amended to reflect the above-mentioned change.

CANADIAN POLAR COMMISSION

Chairperson and CEO (part-time) and Vice-Chairperson (part-time)

On July 26, 2009, the Government of Canada released its Northern Strategy focused on four pillars: exercising Canada’s Arctic sovereignty, promoting social and economic development, protecting Canada’s environmental heritage and improving and devolving governance. The Minister of Indian and Northern Affairs Canada (INAC) leads the development and implementation of this Northern Strategy on behalf of the Government of Canada.

Established in 1991 as a departmental corporation within INAC’s portfolio and mandated to promote the development and dissemination of knowledge in respect of the Polar Regions, the Canadian Polar Commission (CPC) is well placed to provide advice to the Minister related to the Northern Strategy.

The Canadian Polar Commission is tasked, therefore, with providing research and advice to the Minister on key topics related to the Government’s Northern Strategy.

Chairperson and CEO (part-time)

The Chairperson, as Chief Executive Officer, is responsible for planning, administering, monitoring, and evaluating the main activities of the Canadian Polar Commission. The Chairperson directs and manages the Commission’s activities and meetings; provides corporate leadership in the formulation, interpretation, and communication of broad corporate long-range principles, policies, and objectives; and ensures the effective and economic management of human, financial, and material resources.

The successful candidate is a proven leader with significant knowledge of the North and management experience at the executive level including financial and human resources. The preferred candidate will possess experience in strategic planning and managing organizational change to promote improved organizational governance and performance in addition to working with and providing advice to senior-level officials at various levels of government, stakeholders, and international organizations. Experience working on Northern issues is required. Experience working in the North and with, or for, international organizations would be considered assets. The successful candidate should possess a degree from a recognized university, or a combination of equivalent education, job-related training or experience.

The preferred candidate will be familiar with the mandate, operations, and public policy role of the CPC. He/she will also understand the operations of the federal government, including those related to sound governance and management principles, accountability and transparency. The ideal candidate will have knowledge of the federal government’s Northern Strategy and how the Commission can assist in meeting these objectives and priorities. In addition, knowledge of the key players, organizations, issues and events in the Arctic, both domestically and internationally, is required.

The qualified candidate will have the ability to provide excellent management, leadership and the vision necessary to ensure the realization of the strategic direction of the CPC. The favoured candidate will possess the ability to analyze complex situations in order to develop strategies, provide professional, sound advice and make suitable decisions, while anticipating their short- and long-term impact. He/she will be able to interact and work effectively and constructively with individuals from diverse sectors and cultural backgrounds, as well as establish credibility and influence with international and Aboriginal organizations, territorial and federal governments, the international polar community and key stakeholders, in order to advance the goals of the CPC and polar knowledge in Canada. The ideal candidate will possess superior communication skills and the ability to act as the CPC’s spokesperson in dealing with stakeholders, media, governments, and other organizations on a national and international level.

Along with superior interpersonal skills, the ideal candidate will possess sound judgement, strong ethical standards and integrity, be diplomatic and flexible, and be a strategic and innovative leader.

In addition to being available for approximately 50 days per year for Board and Committee activities and related travel both nationally and internationally, the chosen candidate will also be required to travel to the Commission’s meetings which will be held in locations across Canada — half of these North of 60 degrees.

Familiarity with Aboriginal languages of the North would be an asset as would proficiency in both official languages.

Vice-Chairperson (part-time)

The successful candidate will possess experience developing and maintaining effective relationships with representatives of business, territorial and federal governments, Aboriginal and international organizations, and academia, as well as working with, and providing advice to, senior-level officials at various levels of government, stakeholders, and international organizations. Experience working on Northern issues is required in addition to experience managing in a private- or public-sector organization. Experience working in the North, as well as working with, or for, international organizations would be considered assets.

The preferred candidate will understand the mandate, operations, and public policy role of the CPC and will have knowledge of sound governance, management principles and best practices. The ideal candidate will have knowledge of the federal government’s Northern Strategy and how the CPC can assist in meeting the objectives and priorities of that Strategy. Knowledge of the key players, organizations, issues and events in the Arctic, both domestically and internationally, is required. A degree from a recognized university, or a combination of equivalent education, job-related training, or experience would be an asset.

In addition to possessing the ability to contribute to debates and discussions among Board members, the qualified candidate will possess the ability to communicate effectively, both in writing and orally, on behalf of the CPC with all internal and external stakeholders, the media, and the public. He/she will be able to interact and work effectively and constructively with individuals from diverse sectors and cultural backgrounds as well as to establish credibility and influence with international and Aboriginal organizations, territorial and federal governments, the international polar community and key stakeholders, in order to advance the goals of the Commission and polar knowledge in Canada.

The preferred candidate will be diplomatic and flexible and possess strong consensus building and interpersonal skills, sound judgement, strong ethical standards, and integrity.

In addition to being available for approximately 30 days per year for Board and Committee activities and related travel, the chosen candidate will be required to travel to the Commission’s meetings which will be held in locations across Canada — half of these North of 60 degrees.

Familiarity with Aboriginal languages of the North would be an asset as would proficiency in both official languages.

Full-time employees in the federal public administration are not eligible to be appointed or to continue as members of the Board.

Persons appointed to the Board must have knowledge or experience that will assist the CPC in the furtherance of its purpose, having regard to the ethnic, linguistic and regional diversity of Canada’s Polar Regions.

The Government is committed to ensuring that its appointments are representative of Canada’s regions and official languages, as well as of women, Aboriginal peoples, disabled persons and visible minorities.
