CANADA-NOVA SCOTIA OFFSHORE PETROLEUM RESOURCES ACCORD IMPLEMENTATION ACT

Issuance of exploration licences

As required by subsection 62(4) of the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act, S.C. 1988, c. 28, and subsection 65(4) of the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act, S.N.S. 1987, c. 3, notice is hereby given that the Canada-Nova Scotia Offshore Petroleum Board has issued exploration licences 2421 and 2422 to BEPCo. Canada Company as a result of Call for Bids No. NS08-2. The effective date of these two licences is August 14, 2009.

A summary of the terms and conditions of these licences was previously published in the Canada Gazette and in the Royal Gazette (Nova Scotia), as part of Call for Bids No. NS08-2. The full text of the Call for Bids and copies of the exploration licences are available from the Board upon request.

Information processing and related telecommunications services

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2009-038) from Brainhunter (Ottawa) Inc. (Brainhunter), of Ottawa, Ontario, concerning a procurement (Solicitation No. TBIPS/SA/110) by the Department of Foreign Affairs and International Trade (DFAIT). The solicitation is for the services of computer programmers/analysts to design, develop, test and deliver .NET applications. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Brainhunter alleges that DFAIT improperly disqualified its proposal.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2009-037) from Giamac Inc. dba AutoRail Forwarders (Giamac), of Halifax, Nova Scotia, concerning a procurement (Solicitation No. W0153-09HLO1/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for transportation services of personal motor vehicles. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Giamac alleges that PWGSC improperly evaluated its proposal and did not provide an equal opportunity to all suppliers.

Approved — Request by Rogers Broadcasting Limited (Rogers) to harmonize its requirement for the provision of Canadian programming across all of its OMNI stations, to amend CJMT-TV’s requirement for the provision of ethnic programming in order to harmonize it with the conditions of licence applicable to the other OMNI stations and to eliminate the restrictions on the broadcast of non-Canadian, non-ethnic programming during specific broadcast periods for CFMT-TV and CJMT-TV.

Approved — Rogers’ request to harmonize across all of its OMNI stations the requirement to provide programming to a minimum of 20 distinct ethnic groups in a minimum of 20 distinct languages monthly and an amended requirement that no more than 16% of the programming be in any one foreign language during each broadcast month.

Approved — Extension to August 31, 2011, for the deadline to commence the operation of the digital television programming undertaking CHNM-DT Vancouver and its transmitter CHNM-DT-1 Victoria.

Denied — Rogers’ proposal to harmonize across all of its OMNI stations the requirement to broadcast ethnic programming during “peak” time and its request to remove the conditions of licence relating to the overlap of programming between OMNI and Citytv stations and Rogers’ request to remove the restriction relating to the overlap of ethnic programs in a foreign language on CJMT-TV and CFMT-TV during the same broadcast year.
