Model class screening report — Routine Projects in National Park Communities — Public notice

The Canadian Environmental Assessment Agency (the Agency) re-declares the report titled Routine Projects in National Park Communities to be a model class screening report (MCSR) pursuant to the provisions of subsection 19(1) and paragraph 19(2)(b) of the Canadian Environmental Assessment Act (the Act).

Public consultations on the MCSR took place from July 20 to August 3, 2009. The Agency received one written submission from the public concerning the MCSR. In making the declaration proposed by Parks Canada Agency, the Agency has reviewed the MCSR and has determined the project screening process, as described in the document, meets the requirements of the Act for the environmental assessment of this particular class of projects. It is also the Agency’s opinion that the class of projects described in the MCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The declaration is effective August 11, 2009, and is subject to the following terms and conditions:

  • Subject to subsection 19(8) of the Act, the declaration is valid until July 30, 2014;
  • Parks Canada will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of its intention either to re-declare the MCSR, or not to re-declare the MCSR and thereby allow the declaration to expire; and
  • Parks Canada and the Agency will ensure the MCSR is made available to the public in accordance with the requirements of the Act. Therefore, Parks Canada will place the MCSR in the Canadian Environmental Assessment Registry (the Registry). On a quarterly basis, Parks Canada will also post on the Registry Internet site, at www.ceaa-acee.gc.ca, a statement of the projects for which the MCSR was applied, as required under the Act. The quarterly schedule for posting on the Registry Internet site is contained in the addendum to the MCSR.

DETERMINATION

Custodial operations and related services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2008-063) on August 10, 2009, with respect to a complaint filed by Service d’entretien JDH Inc. (JDH), of Saint-Jean-sur-Richelieu, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. EF053-091182/A) by the Department of Public Works and Government Services. The solicitation was for the provision of janitorial services.

JDH alleged that its proposal was improperly evaluated.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement and the Canada-Chile Free Trade Agreement, the Tribunal determined that the complaint was valid.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY OF FINDING

Laminate flooring

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its finding made on June 16, 2005, in Inquiry No. NQ-2004-006, concerning laminate flooring in thickness ranging from 5.5 mm to 13 mm (other than laminate hardwood flooring where the hardwood component exceeds 2 mm in thickness) originating in or exported from the People’s Republic of China and France and the subsidizing of such product originating in or exported from the People’s Republic of China, is scheduled to expire (Expiry No. LE-2009-001) on June 15, 2010. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before August 27, 2009. Each counsel who intends to represent a party in these proceedings must also file a notice of representation with the Secretary on or before August 27, 2009. Qualified counsel who wish to have access to any confidential documents filed in these proceedings must file their notices of representation, declarations and undertakings, as well as the notices of participation signed by the parties that they represent, by the same date.

Parties requesting or opposing the initiation of an expiry review of the said finding shall file 20 copies of written public submissions containing relevant information, opinions and arguments with the Secretary of the Tribunal no later than August 31, 2009. Parties should endeavour to base their submissions on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.

Submissions shall include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning all relevant factors, including

  • the likelihood of continued or resumed dumping and subsidizing of the goods;
  • the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
  • the domestic industry’s recent performance (data for the past three years and for the most recent interim period), including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
  • the likelihood of injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry’s future performance;
  • any other developments affecting, or likely to affect, the performance of the domestic industry;
  • changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
  • any other matter that is relevant.

Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. In these circumstances, the Tribunal will distribute copies of the public submissions to each party that filed a submission with the Tribunal. Confidential submissions will be distributed by the Tribunal only to those counsel who have filed undertakings. Parties wishing to respond to the submissions must do so no later than September 15, 2009.

An expiry review at the request of any firm, organization, person or government will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.

The Tribunal will issue a decision on September 30, 2009, on whether an expiry review is warranted. If the Tribunal decides that a review is not warranted, the finding will expire on its scheduled expiry date. The Tribunal will issue its reasons no later than 15 days after its decision. If the Tribunal decides to initiate a review, it will issue a notice of expiry review.

In addition to providing more detailed information on the proceeding whereby the Tribunal determines if an expiry review is warranted, the draft guideline explains how an expiry review is conducted if the Tribunal determines that one is warranted. In an expiry review, the President of the Canada Border Services Agency (CBSA) first determines whether the expiry of the order or finding is likely to result in the continuation or resumption of dumping or subsidizing of the goods. If the CBSA determines that the expiry of the order or finding in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping or subsidizing is likely to result in injury or retardation.

1. In Broadcasting Notice of Consultation 2009-411-2, the Commission extended the deadline for filing written comments to August 17, 2009, in light of the fact that it required time to consider the implications of litigation filed by Bell Canada and related companies in the Federal Court of Appeal on the current proceeding. The Commission also indicated that it intended to issue an amended Broadcasting Notice of Consultation, if appropriate, on or before August 14, 2009.

2. In paragraph 37 of Broadcasting Notice of Consultation 2009-411, the Commission states that

[t]he Commission is now of the view that a negotiated solution for compensation for the free market value of local conventional television signals is also appropriate.

3. Given the concerns raised by Bell Canada and its related companies, as described in Notice of Consultation 2009-411-2, and wanting to remove any lingering doubts as to the validity of its process and decisions, the Commission will proceed with an examination de novo of the question of whether or not the Commission should put in place a regime for the establishment of fair value for local conventional television signals. This examination will take place during the current proceeding.

4. As such, the Commission amends paragraphs 37 to 39 of Broadcasting Notice of Consultation 2009-411 to read (the changes are in bold):

37. In Broadcasting Public Notice 2007-53 and again in Broadcasting Public Notice 2008-100, the Commission elected not to grant fee for carriage to conventional broadcasters but did provide broadcasters with the right to negotiate the terms under which their distant signals will be retransmitted. The Commission considers that it is appropriate, in the context of the present proceeding, to consider whether or not a negotiated solution for the compensation for the fair value of local conventional television signals is also appropriate, and is seeking comment on this question.

38. The Commission expects that negotiations for distant conventional television signals, and for conventional local television signals, should the Commission decide that the latter is appropriate, will be completed before the long-term renewal of licences and that they will take place in a way that ensures that Canadians will not lose access to programming services. In the absence of a negotiated agreement or agreements, the Commission is considering what strategies and procedures are most likely to contribute to and/or ensure a timely resolution of negotiations and is seeking comment on this issue as well.

39. The Commission is now seeking comment on what mechanism should be used for establishing a negotiated fair value for distant conventional signals, as well as local conventional signals, should the Commission find that the latter is appropriate. To that end, the Commission is seeking responses, with detailed rationale and supporting evidence, for the following questions:

(a) What regulatory measures are needed to facilitate fair negotiations?

(b) What methodology and criteria should be used for determining the fair market value of a conventional signal?

(c) Are there any other considerations that the Commission should take into account?

(d) What safeguards need to be established so that the negotiations are successful and are restricted to the issue of a negotiated fair market value for the conventional signal being distributed?

(e) What is the appropriate method, if required, to achieve resolution through binding arbitration?

5. In order to permit interested parties sufficient time to adapt their comments to reflect these new considerations, the Commission extends the deadline for filing written comments on this and all other issues described in Broadcasting Notice of Consultation 2009-411 to September 14, 2009. As a result, the hearing will now commence on November 16, 2009.

6. All other aspects of Broadcasting Notice of Consultation 2009-411, including the other issues described therein, remain unchanged.
