Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2008-062) on June 24, 2009, with respect to a complaint filed by Adélard Soucy (1975) inc. (Adélard Soucy), of Rivière-du-Loup, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W7701-082667/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for the provision of assembly, welding and fabrication services for heavy mechanical parts.

Adélard Soucy alleged that its proposal was not properly evaluated.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2008-048) on June 23, 2009, with respect to a complaint filed by Almon Equipment Limited (Almon), of Toronto, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W0125-088713/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for aircraft ground de-icing services.

Almon alleged that PWGSC improperly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

Call for comments on proposed amendments to the Television Broadcasting Regulations, 1987, the Pay Television Regulations, 1990, and the Specialty Services Regulations, 1990

The Commission invites comments on the wording of the proposed Regulations Amending Certain Regulations Made Under the Broadcasting Act, which are appended to this notice. The Commission will accept comments that it receives on or before July 23, 2009. The Commission cannot be held responsible for postal delays and will not notify interested parties whose comments are received after the deadline date. The comments will not be considered by the Commission and will not be part of the public record.

The Commission will not formally acknowledge comments. It will, however, fully consider all comments, and they will form part of the public record of the proceeding, provided that the procedures for filing have been followed.

REGULATIONS AMENDING CERTAIN REGULATIONS MADE UNDER THE BROADCASTING ACT

AMENDMENTS

TELEVISION BROADCASTING REGULATIONS, 1987

1. The definition “Canadian program” in section 2 of the Television Broadcasting Regulations, 1987 is replaced by the following:

“Canadian program” means a program

(a) in respect of which a Canadian film or video production certificate referred to in section 125.4 of the Income Tax Act has been issued by the Minister of Canadian Heritage, or

(b) that qualifies as a Canadian program in accordance with the criteria established by the Commission in Appendices I and II to Public Notice CRTC 2000-42 dated March 17, 2000, entitled Certification for Canadian Programs – A Revised Approach and published in the Canada Gazette, Part I, on May 20, 2000; (émission canadienne)

PAY TELEVISION REGULATIONS, 1990

2. The definitions “Canadian program” and “program” in subsection 2(1) of the Pay Television Regulations, 1990 are replaced by the following:

“Canadian program” means a program
