Certain waterproof footwear — Decision

On February 27, 2009, pursuant to subsection 31(1) of the Special Import Measures Act, the President, Canada Border Services Agency (CBSA), initiated an investigation into the alleged injurious dumping of waterproof footwear and waterproof footwear in nearly finished form, constructed wholly or in part of rubber and/or thermoplastic rubber (TPR), originating in or exported from the People’s Republic of China and waterproof footwear and waterproof footwear in nearly finished form, constructed wholly or in part of rubber, thermoplastic rubber (TPR) and/or plastic, originating in or exported from Vietnam.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping. Written submissions should be forwarded to the Canada Border Services Agency, Trade Programs Directorate, Anti-dumping and Countervailing Program, SIMA Registry and Disclosure Unit, 11th Floor, 100 Metcalfe Street, Ottawa, Ontario K1A 0L8. To be given consideration in this investigation, this information should be received by April 6, 2009.

Any information submitted by interested persons concerning this investigation will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Waterproof footwear

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on February 27, 2009, from the Director General of the Trade Programs Directorate at the Canada Border Services Agency (CBSA) stating that the President of the CBSA had initiated an investigation into a complaint respecting the alleged injurious dumping of waterproof footwear and waterproof footwear in nearly finished form, constructed wholly or in part of rubber and/or thermoplastic rubber (TPR), originating in or exported from the People’s Republic of China and waterproof footwear and waterproof footwear in nearly finished form, constructed wholly or in part of rubber, TPR and/or plastic, originating in or exported from Vietnam.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2008-003) to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA.

The Tribunal’s inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before March 13, 2009. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before March 13, 2009.

On March 19, 2009, the Tribunal will distribute the public information received from the CBSA to all parties that have filed notices of participation, and the confidential information to counsel who have filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before March 30, 2009. These submissions should include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning the questions of

  • whether there are goods produced in Canada, other than those identified in the CBSA’s statement of reasons for initiating the investigation, that are like goods to the allegedly dumped goods;
  • whether there is more than one class of allegedly dumped goods;
  • which domestic producers of like goods comprise the domestic industry; and
  • whether the information before the Tribunal discloses a reasonable indication that the alleged dumping of the goods has caused injury or retardation, or threatens to cause injury.

The complainants may make submissions in response to the submissions of parties opposed to the complaint by April 7, 2009. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Parties should note that the Tribunal does not consider exclusion requests during a preliminary injury inquiry and, therefore, none should be filed at this stage. Should the matter proceed to a final inquiry, particulars regarding the schedule for filing exclusion requests will be included in the notice of commencement of inquiry.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 25 copies. The Tribunal will distribute the public submissions to all parties that have filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

The Secretary has sent the notice of commencement of preliminary injury inquiry and the inquiry schedule to the domestic producers, to importers and to exporters with a known interest in the inquiry. Certain fasteners

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its findings made on January 7, 2005, in Inquiry No. NQ-2004-005, concerning

  • the dumping of carbon steel fasteners, i.e. screws of carbon steel that are used to mechanically join two or more elements, excluding fasteners specifically designed for application in the automotive or aerospace industry, originating in or exported from the People’s Republic of China and Chinese Taipei and the subsidizing of such products originating in or exported from the People’s Republic of China, excluding the products described in Appendix A to this notice; and
  • the dumping of stainless steel fasteners, i.e. screws of stainless steel that are used to mechanically join two or more elements, excluding fasteners specifically designed for application in the automotive or aerospace industry, originating in or exported from Chinese Taipei, excluding the products described in Appendix B to this notice,

are scheduled to expire (Expiry No. LE-2008-003) on January 6, 2010. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before March 17, 2009. Each counsel who intends to represent a party in these proceedings must also file a notice of representation with the Secretary on or before March 17, 2009. Qualified counsel who wish to have access to any confidential documents filed in these proceedings must file their notices of representation, declarations and undertakings, as well as the notices of participation signed by the parties that they represent, by the same date.

Parties requesting or opposing the initiation of an expiry review of the said findings shall file 25 copies of written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal no later than March 23, 2009. Parties should endeavour to base their submissions on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.

Submissions shall include evidence, e.g. documents and sources that support the factual statements in the submissions, and argument concerning all relevant factors, including

  • the likelihood of continued or resumed dumping and subsidizing of the goods;
  • the likely volume and price ranges of dumped and subsidized imports if dumping and subsidizing were to continue or resume;
  • the domestic industry’s recent performance (data for the past three years and for the most recent interim period), including supporting data and statistics showing trends in production, sales, market share, domestic prices, costs and profits;
  • the likelihood of injury to the domestic industry if the findings were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped and subsidized imports on the industry’s future performance;
  • any other developments affecting, or likely to affect, the performance of the domestic industry;
  • changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
  • any other matter that is relevant.

Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. In these circumstances, the Tribunal will distribute copies of the public submissions to each party that filed a submission with the Tribunal. Confidential submissions will be distributed by the Tribunal only to those counsel who have filed undertakings. Parties wishing to respond to the submissions must do so no later than April 7, 2009.

An expiry review at the request of any firm, organization, person or government will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.

The Tribunal will issue a decision on April 22, 2009, on whether an expiry review is warranted. If the Tribunal decides that a review is not warranted, the findings will expire on their scheduled expiry date. The Tribunal will issue its reasons no later than 15 days after its decision. If the Tribunal decides to initiate a review, it will issue a notice of expiry review.

The Tribunal’s Draft Guideline on Expiry Reviews can be found on its Web site at www.citt-tcce.gc.ca. In addition to providing more detailed information on the proceeding whereby the Tribunal determines if an expiry review is warranted, the draft guideline explains how an expiry review is conducted if the Tribunal determines that one is warranted. In an expiry review, the President of the Canada Border Services Agency (CBSA) first determines whether the expiry of the order or finding is likely to result in the continuation or resumption of dumping or subsidizing of the goods. If the CBSA determines that the expiry of the order or finding in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping or subsidizing is likely to result in injury or retardation.

In Scope of licence renewal hearings for private conventional television stations, Broadcasting Notice of Consultation CRTC 2009-70, February 13, 2009 (Broadcasting Notice of Consultation 2009-70), the Commission stated that it would be predisposed to issue short-term licences, and reduced the scope of the hearing scheduled for the spring of 2009 to the following key issues:

  • the appropriate contributions to Canadian programming (local, priority and independently produced programming), given the current economic conditions;
  • the terms of administration and delivery of the Local Programming Improvement Fund (LPIF), including the method of establishing the base-level expenditures for the purpose of determining incrementality;
  • whether to impose a 1:1 ratio requirement between Canadian and non-Canadian programming expenditures, both on a trial basis during a short-term licence, and on a longer-term basis; and
  • consideration of the terms for the digital transition by August 2011, in light of an industry working group report being prepared for the current public process.

The Commission set out various questions in regard to its review of the scope of the licence renewal public hearings for private conventional television stations.

The Commission has received, from private conventional television broadcasters, responses to those questions.

The private conventional television broadcasters were directed to indicate if they are requesting amendments to any existing conditions of licence, and the reasons for these requests, as the Commission intends to retain all other conditions of licence as they currently apply.
