Regulations Amending the Broadcasting Distribution Regulations
Whereas, pursuant to subsection 10(3) of the Broadcasting Act (see footnote a), a copy of the proposed Regulations Amending the Broadcasting Distribution Regulations, substantially in the annexed form, was published in the Canada Gazette, Part I, on March 10, 2007, and a reasonable opportunity was thereby given to licencees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect to the proposed Regulations;
Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act (see footnote b), hereby makes the annexed Regulations Amending the Broadcasting Distribution Regulations.

REGULATIONS AMENDING THE BROADCASTING DISTRIBUTION REGULATIONS
AMENDMENTS
1. The definition "emergency alert message" in section 1 of the Broadcasting Distribution Regulations (see footnote 1) is repealed.
2. Paragraph 7(d) of the Regulations is replaced by the following:
(d) for the purpose of altering a programming service to insert a warning to the public announcing
(i) any danger to life or property if the insertion is provided for in an agreement entered into by the licensee with the operator of the service or the network responsible for the service, or
(ii) an imminent or unfolding danger to life if there is no agreement with the operator of the service or the network responsible for the service;
COMING INTO FORCE
3. These Regulations come into force on the day on which they are registered.
EXPLANATORY NOTE
(This note is not part of the Regulations.)
These amendments provide for the insertion, with the broadcaster's consent, of a warning into a programming service announcing any danger to life or property. If there is no consent, a licensee is permitted to insert a warning of an imminent or unfolding danger to life. As a result of those changes, the definition of "emergency alert message" in section 1 of the Broadcasting Distribution Regulations is no longer required.
