Prince Albert National Park of Canada Land Rents Remission Order

Her Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of the Environment and the Treasury Board, pursuant to subsection 23(2.1) (see footnote a) of the Financial Administration Act, hereby makes the annexed Prince Albert National Park of Canada Land Rents Remission Order.

PRINCE ALBERT NATIONAL PARK OF CANADA LAND RENTS REMISSION ORDER

Remission

1. Remission is hereby granted of the amount set out in section 2 to every lessee of a leasehold interest in public lands that are situated within the 12.39 ha seasonal campground in the visitor centre of Waskesiu in Prince Albert National Park of Canada, for which leasehold interest rent is set in accordance with the terms of the applicable lease and paragraph 8(2)(a) or (c) of the National Parks of Canada Lease and Licence of Occupation Regulations.

Amount of Remission

2. The amount of the remission shall be
(a) for the period beginning April 1, 2007 and ending March 31, 2008, 75% of that part of the rental rate set out in the lease for that period that is in excess of $300.00;
(b) for the period beginning April 1, 2008 and ending March 31, 2009, 50% of that part of the rental rate set out in the lease for that period that is in excess of $300.00; and
(c) for the period beginning April 1, 2009 and ending March 31, 2010, 25% of that part of the rental rate set out in the lease for that period that is in excess of $300.00.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order remits the following amounts to lessees of public lands situated within the seasonal campground area in the visitor centre of Waskesiu in Prince Albert National Park of Canada:

(a) for the year 2007-2008, an amount equal to 75% of the rental rate in excess of $300.00;

(b) for the year 2008-2009, an amount equal to 50% of the rental rate in excess of $300.00; and

(c) for the year 2009-2010, an amount equal to 25% of the rental rate in excess of $300.00.

There are currently 451 cabins located on these lands. Permission to occupy the cabin lots has previously been granted by way of annual camping permits issued under the authority of the National Parks Camping Regulations. It is recognized that the annual camping permits no longer reflect the actual occupancies of the cabin area and that a more suitable type of occupancy agreement is required. The annual camping permits are being replaced with land leases with an April 1, 2007 commencement date.

The annual fee for a camping permit in this area was $300.00 for the 2006 season. The new lease agreements have rent set in accordance with the National Parks of Canada Lease and Licence of Occupation Regulations and will result in significant increases in occupancy costs in all cases. If these land rental rates are fully implemented at the commencement of the lease term, the increases are considered to be unreasonable to lessees.

The Parks Canada Agency will phase in the land rents over three years, 2007-2009, by remitting part of the land rent increase above the previous camping permit fee for these years.

The estimated total amount of the remittances made over the duration of the Order will be $830,700.
