BROADCASTING ACT

Oder Declining to Set Aside or to Refer Back to the CRTC Decisions CRTC 2005-338 and CRTC 2005-339

Whereas the Canadian Radio-television and Telecommunications Commission ("the Commission") rendered Broadcasting Decisions CRTC 2005-338 and CRTC 2005-339 on July 21, 2005, which respectively approved the applications by I.T. Productions Ltd. for a broadcasting licence to operate a new ethnic AM radio station at Vancouver operating at a frequency of 1200 kHz and by South Asian Broadcasting Corporation Inc. for a broadcasting licence to operate a new commercial specialty FM (ethnic) radio station at Vancouver operating at a frequency of 93.1 MHz;

Whereas, subsequent to the rendering of the Decisions, the Governor in Council received petitions requesting that the Decisions be set aside or referred back to the Commission for reconsideration and hearing of the matters;

And whereas the Governor in Council, having considered the petitions, is not satisfied that the Decisions derogate from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a);

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b), hereby declines to set aside Broadcasting Decisions CRTC 2005-338 and CRTC 2005-339 of July 21, 2005, or refer them back to the Commission for reconsideration and hearing.
