CUSTOMS TARIFF

Technical Amendments Regulations (Customs Tariff) 2005-1

The Minister of Finance, pursuant to section 13 of the Customs Tariff (see footnote a), hereby makes the annexed Technical Amendments Regulations (Customs Tariff) 2005-1.

TECHNICAL AMENDMENTS REGULATIONS (CUSTOMS TARIFF) 2005-1

AMENDMENTS

1. The List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1) is amended as set out in Part 1 of the schedule to these Regulations.

2. The List of Tariff Provisions set out in the schedule to the English version of the Act is amended as set out in Part 2 of the schedule to these Regulations.

3. The List of Tariff Provisions set out in the schedule to the French version of the Act is amended as set out in Part 3 of the schedule to these Regulations.

COMING INTO FORCE

4. These Regulations come into force on the day on which they are registered.

SCHEDULE

PART 1
(Section 1)

AMENDMENTS TO THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 5111.11.20 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

2. The preamble preceding tariff item Nos. 5111.20.11, 5111.20.12, 5111.20.13, 5111.20.18 and 5111.20.19 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

3. The preamble preceding tariff item Nos. 5111.30.11, 5111.30.12, 5111.30.13, 5111.30.18 and 5111.30.19 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

4. The preamble preceding tariff item Nos. 5111.90.21, 5111.90.22, 5111.90.23, 5111.90.28 and 5111.90.29 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

5. The Description of Goods of tariff item No. 5205.26.30 is amended by striking out the reference to "measuring less than 166 decitex,".

6. The Description of Goods of tariff item No. 5205.27.30 is amended by striking out the reference to "measuring less than 166 decitex,".

7. The Description of Goods of tariff item No. 5515.13.20 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

PART 2
(Section 2)

AMENDMENT TO THE ENGLISH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The preamble preceding tariff item Nos. 5111.19.31, 5111.19.32 and 5111.19.39 is amended by replacing the reference to "not containing more than one generic type" with a reference to "containing one generic type".

PART 3
(Section 3)

AMENDMENTS TO THE FRENCH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 1905.32.92 is amended by replacing the reference to "Gaufrettes et gaufres congelées" with a reference to "Gaufrettes, et gaufres congelées".

2. The Description of Goods of tariff item No. 5811.00.21 is amended by replacing the reference to "coulements" with a reference to "écoulements".

3. The preamble preceding tariff item Nos. 9506.70.11 and 9506.70.12 is replaced by the following:

---Patins à glace ou patins à roulettes fixés sur des bottes ou d'autres types de chaussures :

4. The Description of Goods of tariff item No. 9993.00.00 is amended by replacing the reference to "a) les marchandises ne soient pas vendues ou ne fassent l'objet d'aucune transformation ultérieure au Canada;" with a reference to "a) les marchandises ne soient pas vendues au Canada ou n'y fassent l'objet d'aucune transformation ultérieure;".

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The Technical Amendments Regulations (Customs Tariff) 2005-1 amends the List of Tariff Provisions set out in the schedule to the Customs Tariff to correct minor, technical errors and to align English and French texts.

Alternatives

No alternatives were considered. A regulation pursuant to section 13 of the Customs Tariff is the appropriate method in this instance of correcting technical errors inadvertently introduced into the schedule.

Benefits and Costs

The amendments contained in this Regulation are essentially technical and, inter alia, ensure consistency between the English and French versions of the Customs Tariff.

Consultation

Since the amendments involving English and French alignment and those correcting spelling errors are technical and do not involve any new policy or financial implications, no consultations were undertaken.

Compliance and Enforcement

Compliance is not an issue. The Canada Border Services Agency is responsible for the administration of the customs and tariff legislation and regulations.
