CUSTOMS TARIFF

Technical Amendments Order (Customs Tariff) 2000-3

Whereas the Minister of Finance considers it necessary to amend the schedule to the Customs Tariff(see footnote a) as a consequence of the enactment of that Act;

Therefore, the Minister of Finance, pursuant to section 138 of the Customs Tariff(see footnote b), hereby makes the annexed Technical Amendments Order (Customs Tariff) 2000-3.

TECHNICAL AMENDMENTS ORDER (CUSTOMS TARIFF) 2000-3

AMENDMENTS

1. Tariff item No. 4818.90.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1) is repealed.

2. The List of Tariff Provisions set out in the schedule to the Act is amended as set out in Part 1 of the schedule to this Order.

3. The List of Tariff Provisions set out in the schedule to the French version of the Act is amended as set out in Part 2 of the schedule to this Order.

4. The List of Tariff Provisions set out in the schedule to the Act is amended by adding, in numerical order, the tariff provisions set out in Part 3 of the schedule to this Order.

COMING INTO FORCE

5. This Order is deemed to have come into force on January 1, 1998.

PART 1
(Section 2)

AMENDMENTS TO THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 8417.80.10 is amended by

(a) striking out the semicolon following the reference to "Waste incinerators including pathological and crematorial type"; and

(b) striking out the reference to "Waste wood burning systems".

2. The Description of Goods of tariff item No. 8420.10.10 is amended by striking out the reference to "For the pulp, paper or paperboard industry;".

3. The Description of Goods of tariff item No. 8421.29.10 is amended by

(a) adding a semicolon after the reference to "Sulphuric acid recovery systems"; and

(b) adding, in alphabetical order, a reference to "Waste oil refining systems for the production of resaleable automotive diesel oil, furnace and industrial oils".

4. The Description of Goods of tariff item No. 8465.92.10 is amended by replacing the reference to "Wood jointers or planer-jointers;" with a reference to "Wood jointers or planer-jointers, excluding portable, benchtop types;".

5. The Description of Goods of tariff item No. 8537.10.11 is amended by replacing the reference to "heading No. 84.21, 84.22, 84.50 or 85.16" with a reference to "heading No. 84.21, 84.22, 84.28, 84.50 or 85.16".

AMENDMENTS TO THE FRENCH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 4010.29.10 is amended by replacing the reference to "striées sans" with a reference to "striées, sans".

2. The Description of Goods of tariff item No. 8207.19.10 is amended by replacing the reference to "Autres outils de forage, à l'exclusion des suivants :" with a reference to "Autres outils, à l'exclusion des suivants :".

3. The Description of Goods of tariff item No. 8309.90.10 is amended by replacing the reference to "en aciers, ayant" with a reference to "en acier, ayant".

4. The Description of Goods of tariff item No. 9903.00.00 is amended by replacing the reference to "devant servir dans les suivants :" with a reference to "devant servir dans ce qui suit :".

5. The Description of Goods of tariff item No. 9991.00.00 is amended by

(a) replacing the reference to "importé comme partie intégrale de ce dernier," with a reference to "importé comme partie intégrante de ce dernier,";

(b) replacing the reference to "échantillons n'excèdent pas deux dollars;" with a reference to "échantillons n'excède pas deux dollars;"; and

(c) replacing the reference to "les marchandises seront fournis directement de l'étranger;" with a reference to "les marchandises seront fournies directement de l'étranger;".

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Order.)

Description

This Order corrects certain technical errors and omissions arising as a result of the conversion of the former Customs Tariff to the new simplified Tariff (Bill C-11), which came into effect on January 1, 1998, as well as minor technical issues identified by the Standing Joint Committee for the Scrutiny of Regulations. Specifically, the Order

(a) corrects translation, typographical and transposition errors in previous technical amendment Orders under section 138 of the Customs Tariff, which were identified by the Standing Joint Committee for the Scrutiny of Regulations;

(b) reinstates duty-free treatment for sterilization pouches and rolls, which became dutiable as a result of the implementation of the simplified Customs Tariff;

(c) maintains duty-free entry for certain equipment (e.g. waste wood burning systems and calendering machines) that is unavailable domestically and that, prior to January 1, 1998, benefited from the duty-free provisions of the Machinery Program.

Alternatives

No alternatives were considered. A Ministerial Order pursuant to section 138 of the Customs Tariff is the appropriate method of correcting technical errors that were inadvertently introduced into the Schedule to the new simplified Tariff.

Benefits and Costs

This Order will have no impact on existing policy and is not expected to have any significant financial implications.

Consultation

Since this Order simply corrects certain technical errors and omissions in the Customs Tariff and restores duty-free entry for goods that were eligible for such treatment in the past, it does not involve any new policies. No consultations were conducted.

Compliance and Enforcement

Compliance is not an issue. The Canada Customs and Revenue Agency is responsible for the administration of customs and tariff legislation and regulations.
