BROADCASTING ACT

Regulations Amending the Radio Regulations, 1986

Whereas, pursuant to subsection 10(3) of the Broadcasting Act (see footnote a), a copy of the proposed Regulations Amending the Radio Regulations, 1986, substantially in the annexed form, was published in the Canada Gazette, Part I, on April 1, 2000, and a reasonable opportunity was thereby given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect to the proposed Regulations;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act (see footnote b), hereby makes the annexed Regulations Amending the Radio Regulations, 1986.

REGULATIONS AMENDING THE RADIO REGULATIONS, 1986

AMENDMENTS

1. The definitions "content category" (see footnote 1) and "content subcategory" (see footnote 2) in section 2 of the Radio Regulations, 1986 (see footnote 3) are replaced by the following:

"content category" means any category of broadcast matter that is described in the appendix to Public Notice CRTC 2000-14 dated January 28, 2000 and entitled Revised Content Categories and Subcategories for Radio, published in the Canada Gazette Part I on February 5, 2000. (catégorie de teneur)

"content subcategory" means any subcategory of broadcast matter that is described in the appendix to Public Notice CRTC 2000-14 dated January 28, 2000 and entitled Revised Content Categories and Subcategories for Radio, published in the Canada Gazette Part I on February 5, 2000. (sous-catégorie de teneur)

2. (1) Subsections 2.2(3) to (5) (see footnote 4) of the Regulations are replaced by the following:

(3) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a station other than a community station or campus station shall, in a broadcast week, devote 10 % or more of its musical selections from content category 3 to Canadian selections and schedule them in a reasonable manner throughout each broadcast day.

(4) If 7 percent or more of the musical selections broadcast by a licensee during an ethnic programming period are Canadian selections and are scheduled in a reasonable manner throughout that period, subsections (3) and (7) to (9) shall apply only in respect of the musical selections that are broadcast during the part of the broadcast week that is not devoted to ethnic programs.

(5) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a campus station, commercial station or community station in the French language shall, in a broadcast week, devote 65 percent or more of its vocal musical selections from content category 2 to musical selections in the French language broadcast in their entirety.

(2) The portion of subsection 2.2(6) (see footnote 5) of the Regulations before paragraph (a) is replaced by the following:

(6) An A.M. or F.M. licensee may, in a broadcast week, reduce the percentage of its Canadian musical selections from content category 2 referred to in subsections (7) to (9) to

(3) Subsections 2.2(7) (see footnote 6) and (8) (see footnote 7) of the Regulations are replaced by the following:

(7) Except as otherwise provided under a licensee's condition of licence and subject to subsection (6), an A.M. or F.M. licensee licensed to operate a station other than a commercial station, community station or campus station shall, in a broadcast week, devote 30 % or more of its musical selections from content category 2 to Canadian selections and schedule them in a reasonable manner throughout each broadcast day.

(8) Except as otherwise provided under a licensee's condition of licence that refers expressly to this subsection and subject to subsection (6), an A.M. or F.M. licensee licensed to operate a a commercial station, community station or campus station shall, in a broadcast week, devote 35 % or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

(4) Subsection 2.2(13) (see footnote 8) of the Regulations is replaced by the following:

(13) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a station in the French language other than a commercial station, community station or campus station shall, in a broadcast week, devote 65 % or more of its vocal musical selections from content category 2 to musical selections in the French language and schedule them in a reasonable manner throughout each broadcast day.

(14) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a community station or campus station in the French language shall, in a broadcast week, devote 65 % or more of its vocal musical selections from content category 2 to musical selections in the French language.

3. Subparagraph 9(3)(b)(iv) (see footnote 9) of the Regulations is replaced by the following:

(iv) any content category 3 musical selection that is described in the appendix to Public Notice CRTC 2000-14 dated January 28, 2000 and entitled Revised Content Categories and Subcategories for Radio, published in the Canada Gazette Part I on February 5, 2000.

COMING INTO FORCE

4. These Regulations come into force on the day on which they are registered.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

These amendments

(a) incorporate the revised content categories and subcategories for radio set out in Public Notice CRTC 2000-14 dated January 28, 2000;

(b) increase the required level of Canadian content for musical selections from content categories 2 and 3 measured on a weekly basis for A.M. and F.M. licensees operating community and campus stations;

(c) remove the requirement that Canadian musical selections from content categories 2 and 3 be scheduled in a reasonable manner throughout the broadcast day by licensees operating community and campus stations;

(d) remove the requirement that French vocal musical selections from content category 2 be scheduled in a reasonable manner throughout the broadcast day by licensees operating community and campus stations; and

(e) make consequential changes.
