Regulations Amending Certain Regulations Made under the Canada Post Corporation Act (Miscellaneous Program)

Whereas, pursuant to subsection 20(1) of the Canada Post Corporation Act, a copy of the proposed Regulations Amending Certain Regulations Made under the Canada Post Corporation Act (Miscellaneous Program), substantially in the annexed form, was published in the Canada Gazette, Part I, on January 29, 2000, and a reasonable opportunity was afforded to interested persons to make representations to the Minister of Public Works and Government Services with respect to the proposed regulations;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Public Works and Government Services, pursuant to subsection 19(1) (see footnote a) of the Canada Post Corporation Act, hereby approves the annexed Regulations Amending Certain Regulations Made under the Canada Post Corporation Act (Miscellaneous Program) made on April 26, 2000 by the Canada Post Corporation.

REGULATIONS AMENDING CERTAIN REGULATIONS MADE UNDER THE CANADA POST CORPORATION ACT (MISCELLANEOUS PROGRAM)

ARMED FORCES POSTAL REGULATIONS

1. The heading before section 2 of the French version of the Armed Forces Postal Regulations (see footnote 1) is replaced by the following:

DÉFINITIONS

2. (1) The definition "envois de la poste aux lettres" (see footnote 2) in section 2 of the French version of the Regulations is replaced by the following:

" envoi de la poste aux lettres " Lettre, imprimé ou petit paquet posté conformément au présent règlement pour transmission par avion. (letter-post item)

(2) The expression "(bureau de poste des Forces canadiennes or BPFC)" at the end of the definition ""Canadian Forces Post Office" or "CFPO"" in section 2 of the English version of the Regulations is replaced by the expression "(bureau de poste des Forces canadiennes ou BPFC)".

(3) The expression "(bureau de poste navale or BPN)" at the end of the definition ""Fleet Mail Office" or "FMO"" in section 2 of the English version of the Regulations is replaced by the expression "(bureau de poste navale ou BPN)".

(4) The expression "(envois de la poste aux lettres)" at the end of the definition "letter-post item" in section 2 of the English version of the Regulations is replaced by the expression "(envoi de la poste aux lettres)".

MATERIALS FOR THE USE OF THE BLIND REGULATIONS

3. The heading before section 2 of the French version of the Materials for the Use of the Blind Regulations (see footnote 3) is replaced by the following:

DÉFINITIONS

4. (1) The definition "postage" (see footnote 4) in section 2 of the Regulations is replaced by the following:

"postage" means the charge payable for the handling and conveyance of material for the use of the blind and for registered service and Xpresspost mail. (affranchissement)

(2) The definition "material for the use of the blind" in section 2 of the Regulations is amended by adding the following at the end of that definition:

POSTING ABROAD OF LETTER-POST ITEMS REGULATIONS

5. The heading before section 2 of the French version of the Posting Abroad of Letter-Post Items Regulations (see footnote 5) is replaced by the following:

6. (1) The definition "envois de la poste aux lettres" (see footnote 6) in section 2 of the French version of the Regulations is replaced by the following:

" envoi de la poste aux lettres " S'entend au sens du Règlement sur les envois de la poste aux lettres du régime postal international. (letter-post item)

(2) The expression "(envois de la poste aux lettres)" at the end of the definition "letter-post item" in section 2 of the English version of the Regulations is replaced by the expression "(envoi de la poste aux lettres)".

REPRODUCTION OF POSTAGE STAMPS REGULATIONS

7. Section 5 (see footnote 7) of the Reproduction of Postage Stamps Regulations (see footnote 8) is replaced by the following:

In addition to reproductions of postage stamps authorized by section 2, reproduction of postage stamps may, where the Canada Post Corporation considers that it will be in the public interest, be made or published with the written consent of the Canada Post Corporation, which consent may be sought by an application in writing addressed to the following address:

SOLICITATIONS BY MAIL REGULATIONS

8. Section 6 of the French version of the Solicitations by Mail Regulations (see footnote 9) is replaced by the following:

SPECIAL SERVICES AND FEES REGULATIONS

9. The heading before section 2 of the French version of the Special Services and Fees Regulations (see footnote 10) is replaced by the following:

10. (1) The portion of subsection 6(1) (see footnote 11) of the Regulations before paragraph (a) is replaced by the following:

11. The paragraph 26(2)(a) of the Regulations is replaced by the following:

UNDELIVERABLE AND REDIRECTED MAIL REGULATIONS

12. The heading before section 2 of the French version of the Undeliverable and Redirected Mail Regulations (see footnote 13) is replaced by the following:

LETTER DEFINITION REGULATIONS

13. (1) Paragraph 2(a) of the French version of the Letter Definition Regulations (see footnote 14) is replaced by the following:

a) un message ou des renseignements transportés à titre occasionnel et livrés au destinataire par l'expéditeur qui est également son ami;

(2) Paragraph 2(e) of the French version of the Regulations is replaced by the following:

14. Paragraph 12(b) of the French version of the Mail Receptacles Regulations (see footnote 15) is replaced by the following:

16. Section 5 of the French version of the Postage Meter Regulations (see footnote 16) is replaced by the following:

17. The portion of subsection 18(3) (see footnote 17) of the English version of the Regulations after paragraph (c) is replaced by the following:

the postmaster or other designated person may require the surrender of the postage meter by the user.

18. The portion of subsection 5(2) (see footnote 18) of the schedule to the English version of the Regulations before paragraph (a) is replaced by the following:

(2) In the case of addressed admail referred to in subsection 11(2) of these Regulations with only the month and year indicated, the date of posting shall consist of

INTERNATIONAL LETTER-POST ITEMS REGULATIONS

19. The definition "small packet" (see footnote 19) in section 2 of the International Letter-post Items Regulations (see footnote 20) is replaced by the following:

"small packet" means a package, usually containing goods; (petit paquet)

20. Paragraphs 7.1(2)(a) (see footnote 21) and (b) (see footnote 22) of the Regulations are replaced by the following:

(a) complete the Customs Document required by the Corporation; and

(b) securely affix that Customs Document to the item on the address side where possible.

21. Section 8 of the French version of the Regulations is replaced by the following:

8. Les lettres ou cartes postales incluses dans des enveloppes et les envois à découvert ne peuvent être transmis par la poste que si les enveloppes ou envois à découvert sont de forme rectangulaire et entièrement cachetés.

22. The portion of section 25 of the Regulations before paragraph (a) is replaced by the following:

25. A small packet shall bear or contain no addition, indication or modification nor any enclosure that is in addition to the item posted except

23. Paragraph 25(j) of the Regulations is replaced by the following:

(j) any document having the character of current or personal correspondence if the sender and addressee of the document is the same as the sender and addressee of the small packet;

24. Section 31.1 (see footnote 23) of the Regulations is replaced by the following:

31.1 Unless they are sent by, or addressed to, an officially recognized institution for the blind, tapes and records that are intended for the use of the blind shall not be posted to any country that is identified in the Universal Postal Convention, as amended from time to time, as being required to admit sound recordings as literature for the blind only if the recordings are sent by, or addressed to, such an institution.

25. Schedule II (see footnote 24) to the Regulations is repealed.

DEFICIENT POSTAGE REGULATIONS

26. (1) The definition "deficient postage" in section 2 of the Deficient Postage Regulations (see footnote 25) is amended by adding the following at the end of that definition:

(affranchissement insuffisant)

(2) The definition "deficient postage item" in section 2 of the Regulations is amended by adding the following at the end of that definition:

(envoi insuffisamment affranchi)

POSTAL SERVICES INTERRUPTION REGULATIONS

27. The portion of section 2 of the French version of the Postal Services Interruption Regulations (see footnote 26) before paragraph (a) is replaced by the following:

2. En cas d'interruption du service postal dans l'ensemble ou une partie du Canada, la Société peut, pour assurer la bonne marche de ses opérations :

LETTER MAIL REGULATIONS

28. Paragraph 8(1)(l) (see footnote 27) of the Letter Mail Regulations (see footnote 28) is replaced by the following:

(l) any other articles that are fragile or perishable, can soil or damage other mail or postal equipment or can cause injury to persons handling them.

NON-MAILABLE MATTER REGULATIONS

29. Subitem 1(6) (see footnote 29) of the schedule to the Non-mailable Matter Regulations (see footnote 30) is replaced by the following:

1.	(6) Fish, game, meat, fruit, vegetables, perishable biological substances or other perishable items that are not prepared for posting in accordance with the applicable requirements of the current Canada Postal Guide — Guide des postes du Canada, published by the Corporation.

30. Subitem 2(1) (see footnote 31) of the schedule to the Regulations is replaced by the following:

(1) Live animals, other than live animals that are accepted for transmission by post pursuant to an agreement with the Corporation or that are referred to in the current Canada Postal Guide — Guide des postes du Canada, published by the Corporation, and are prepared for posting in accordance with the applicable requirements set out in that guide.

COMING INTO FORCE

31. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

These amendments to the Regulations are of a technical nature. They do not reflect any substantive change to the Regulations made under the Canada Post Corporation Act, but rather:

• correct minor errors in format, syntax, spelling or punctuation;
• correct typographical errors, anomalies or renumbering;
• correct inconsistencies between the English and French versions of the Regulations;
• update or clarify minor, non-substantive unclear passages; and
• revoke obsolete provisions that have no further application or effect.

Amendments common to more than one regulation are addressed after the following description of specific amendments:

1. Reproduction of Postage Stamps Regulations

- update the contact and address information given in section 5.

2. Solicitations by Mail Regulations

- correct an inconsistency by replacing "par les Postes" par "par la poste" in the French version of section 6 to reflect the English text stating "by post".

3. Special Services and Fees Regulations

- make consequential amendments to subsections 6(1), 6(3), and paragraph 26(2)(a) by removing references to provisions that have already been revoked.

4. International Letter-post Items Regulations

- correct the language used in paragraph 25(j) to better conform with the detailed Regulations of Universal Postal Convention (Seoul 1994).

- remove reference to a specific Customs Document in paragraphs 7.1(2)(a) and (b) and repeals Schedule II showing the Customs Document to make the Regulations more efficient by avoiding to go through a regulatory process every time the form is changed.

- replace "modification or enclosure except" by "modification nor any enclosure that is in addition to the item posted except" in section 25 for clarification.

- reword section 31.1 to remove the list of countries as the Universal Postal Union list is changed from time to time. By doing so, the Regulations become more efficient because they are kept up to date without regulatory amendments.

5. Letter Mail Regulations

- replace "injury to employees of the Corporation" by "injury to persons handling them" to acknowledge the risk of injury to persons other than Canada Post employees.

6. Non-Mailable Matter Regulations

- update the reference to the Canada Postal Guide published by the Corporation, that is given in subitems 1(6) and 2(1) of the schedule.

Besides the aforementioned amendments, the heading "Interprétation" of section 2 in the French version is replaced by "Définitions" in the following Regulations :

- Armed Forces Postal Regulations;

- Materials for the Use of the Blind Regulations;

- Posting Abroad of Letter-Post Items Regulations;

- Special Services and Fees Regulations;

- Undeliverable and Redirected Mail Regulations.

The equivalent (in French or in English, as the case may be) is added at the end of the following definitions:

- "material for the use of the blind" in the Materials for the Use of the Blind Regulations; and

- "deficient postage" and "deficient postage item" in the Deficient Postage Regulations.

The defined term "envois de la poste aux lettres" is now in singular in section 2 of the Armed Forces Postal Regulations and Posting Abroad of Letter-Post Items Regulations.

All of the other amendments are to correct grammatical, syntax, punctuation, typographical or format errors.

Consultation

As required by the Canada Post Corporation Act, these amendments were published for comments in the Canada Gazette, Part I, on January 29, 2000. No comments were received.

Compliance and Enforcement

It is expected that this change will have no impact on Canadians and will streamline the Regulations to make them more efficient.
