CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Order Adding a Toxic Substance to Part 3 of Schedule 3 to the Canadian Environmental Protection Act, 1999

Whereas, pursuant to subsection 332(1) of the Canadian Environmental Protection Act, 1999(see footnote a), the Minister of the Environment published in the Canada Gazette, Part I, on January 15, 2000, a copy of the proposed Order Adding a Toxic Substance to Part 3 of Schedule 3 to the Canadian Environmental Protection Act, 1999, substantially in the annexed form, and persons were given an opportunity to file comments with respect to the Order or to file a notice of objection requesting that a board of review be established and stating the reasons for the objection;

Therefore, the Minister of the Environment and the Minister of Health, pursuant to paragraph 100(c) of the Canadian Environmental Protection Act, 1999 (see footnote 1) , hereby make the annexed Order Adding a Toxic Substance to Part 3 of Schedule 3 to the Canadian Environmental Protection Act, 1999.

ORDER ADDING A TOXIC SUBSTANCE TO PART 3
OF SCHEDULE 3 TO THE CANADIAN
ENVIRONMENTAL PROTECTION ACT, 1999

AMENDMENT

1. Part 3 of Schedule 3 to the Canadian Environmental Protection Act, 1999 (see footnote 2) is amended by adding the following after item 14:

15. Tributyltetradecylphosphonium chloride

2. This Order comes into force on March 31, 2000.

EXPLANATORY NOTE

(This note is not part of the Order.)

Under section 100 of the Canadian Environmental Protection Act, 1999 (CEPA, 1999), the Minister of the Environment and the Minister of Health have the authority to add any substance to the Export Control List in Schedule 3 of that Act or delete any substance from that List.

The Export Control List of CEPA (1999) consists of 3 parts as follows: Part 1, Prohibited Substances; Part 2, Substances Subject to Notification or Consent; and Part 3, Restricted Substances.

On March 15, 2000, an Order adding a toxic substance, namely Tributyltetradecylphosphonium chloride (TTPC), to the List of Toxic Substances (Schedule I) to the Canadian Environmental Protection Act of 1988 and to the List of Toxic Substances Requiring Export Notification (Part II of Schedule II) to that Act was published in the Canada Gazette, Part II.

The addition of TTPC to the List of Restricted Substances (Part 3 of Schedule 3) of CEPA (1999) will ensure that the same export conditions that applied to this substance under the Canadian Environmental Protection Act of 1988 are continued under CEPA (1999).
