Notice with Respect to Substances in the National Pollutant Release Inventory for 2002 — Amendment

Notice is hereby given, pursuant to subsection 46(1) of the Canadian Environmental Protection Act, 1999, that the Notice with Respect to Substances in the National Pollutant Release Inventory for 2002, published December 29, 2001, in the Canada Gazette, Part I, is amended as set out in Schedule 1. This notice comes into force on the date of its publication and remains in force until December 28, 2004.

SCHEDULE 1
Amendments

1. Footnote number 16 in Part 1 of Schedule 1 to the French version of the Notice is replaced by the following:

16 « (sauf lorsque dans un alliage) et ses composés »

2. Footnote number 20 in Part 3 of Schedule 1 to the French version of the Notice is amended by adding the following congener:

2,3,7,8-Tétrachlorodibenzo-p-dioxine (numéro du CAS 1746-01-6).

3. Subparagraph 9(b)(v) of Schedule 2 to the French version of the Notice is replaced by the following:

    • (v) fusion primaire de métaux communs;

4. Subsection 10(2) in Part 4 of Schedule 2 to the Notice is replaced by the following:

(2) For the purposes of paragraph (1)(b), total particulate matter, PM10 or PM2.5 that originated from road dust shall not be included in calculating the mass reporting threshold set out in column 2 of Table 2 for these substances.

5. Subsection 11(2) of Schedule 2 to the Notice is replaced by the following:

(2) Despite subsection (1), a report for a substance listed in Part 4 of Schedule 1 is not required

  • (a) if:
    • (i) the substance is only released to air from stationary, external-combustion equipment;
      (ii) the cumulative nameplate capacity of that equipment is less than 10 million British thermal units per hour; and
      (iii) the only type of fuel combusted in that equipment is commercial grade natural gas, liquefied petroleum gas, Number 1 or 2 fuel oil or any combination thereof; or
    (b) if:
    • (i) the contiguous facility was used for drilling or operating oil or gas wells or was used for associated activities, including gas production, gas processing, conventional crude oil production, heavy oil production, and crude bitumen production; and
      (ii) employees worked a total of less than 20,000 hours.

6. Section 9 in Part 1 of Schedule 3 to the Notice is replaced by the following:

9. Whether, during the 2002 calendar year, the facility had prepared or was implementing any pollution-prevention plans, and if so, whether any were pollution prevention plans:

  • (a) required by a notice under the Canadian Environmental Protection Act, 1999;
    (b) prepared or implemented for another government or under another Act of Parliament; or
    (c) prepared or implemented by the facility on a voluntary basis.

7. Section 30 in Part 3 of Schedule 3 to the Notice is replaced by the following:

30. Report information in respect of PM10 and PM2.5 listed in Part 4 of Schedule 1, in tonnes.

8. The definition "pipeline installation" in Schedule 4 to the Notice is replaced by the following:

"pipeline installation" means a collection of equipment situated at a single site, used in the operation of a natural gas transmission or distribution pipeline. « installation de pipeline »

9. The definition "other use" in Schedule 4 to the Notice is replaced by the following:

"other use" includes any use or disposal of a substance, listed in Schedule 1, relevant to the purpose of the facility which is not included under the definitions of "manufacture" or "process". « autre utilisation »

EXPLANATORY NOTE
(This note is not part of the notice.)

This amendment includes clarification and changes to certain provisions for reporting for the 2002 National Pollutant Release Inventory (NPRI).

The Notice for the 2002 NPRI contained reporting criteria for criteria air contaminant (CAC) emissions from the upstream oil and gas sector that were not consistent with Environment Canada's Response to the First Report from the NPRI Work Group on Substances. This discrepancy is corrected in this amendment. During 2002, Environment Canada consulted with stakeholders on the most appropriate means to capture reporting of emissions of criteria air contaminants from the upstream oil and gas sector.

The definition of "pipeline installation" has been restricted to pipelines used for the transmission or distribution of natural gas rather than fossil fuel.
