Waterproof Footwear and Waterproof Footwear Bottoms — Decision

On December 9, 2002, the Commissioner of Customs and Revenue made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act respecting waterproof footwear and waterproof footwear bottoms, originating in or exported from Hong Kong, China; Macao, China; and Vietnam.

The goods in question are usually classified under Harmonized System headings 6401, 6402, 6403 and 6404.

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury and will make its order or finding by January 8, 2003. Provisional duty will continue to apply until this date.

If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to an anti-dumping duty equal to the margin of dumping. In that event, the importer in Canada shall pay all such duties.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2002-023) on December 17, 2002, with respect to a complaint filed by Nanaimo Shipyard Ltd. (the complainant), of Nanaimo, British Columbia, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Letter of Interest No. W8483-01FD03/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for the refit of the HMCS Algonquin.

The complainant alleged that its proposal was unfairly evaluated with respect to the experience requirement contained in the Letter of Interest and that, as a result, it was not considered qualified to compete for this contract.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

BOUNDARY WATERS TREATY OF 1909

Invitation to Comment on the 2002 Progress Report on the Canada-United States Air Quality Agreement

The International Joint Commission invites public comment on progress by the United States and Canada in reducing transboundary air pollution under the 1991 Canada-United States Agreement on Air Quality. The 2002 Progress Report provides updates on acid rain control programs, ground-level ozone controls, cooperative efforts on particulate matter, data measurement and analysis, notification of sources of transboundary air pollution, and the results of the second five-year review of the agreement, among other issues. The Commission will provide a synthesis of comments received to the two governments and the public as directed by the Agreement.

The Governments of the United States and Canada signed an Agreement on Air Quality on March 13, 1991. The purpose of the Agreement was to establish a practical and effective instrument to address shared concerns on transboundary air pollution.

Under the terms of the Agreement, the Governments' bilateral Air Quality Committee reviews progress made in the implementation of the Agreement, prepares and submits periodic progress reports to the Governments, and refers each progress report to the International Joint Commission for solicitation of public input.
