Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03312 is approved.

1. Permittee: Burrard Yacht Club, North Vancouver, British Columbia.

2. Type of Permit: To dispose of a platform at sea.

3. Term of Permit: Permit is valid from December 30, 2002, to December 29, 2003.

4. Loading Site(s): Burrard Yacht Club, North Vancouver, British Columbia at approximately 49°18.65' N, 123°05.65' W.

5. Disposal Site(s): Gabriola Disposal Site, British Columbia, at approximately 49°08.00' N, 123°32.00' W, at a depth of not less than 360 m. Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m.

6. Route to Disposal Site(s) : Direct.

7. Method of Loading and Disposal: Scuttling at the disposal site.

8. Description: Derelict platform

9. Requirements and Restrictions:

9.1 Prior to disposal, the Permittee must obtain all other necessary permits and approvals from other regulatory agencies in respect of the project described herein.

9.2 The Permittee must ensure that all floatables and all petroleum-based products (fuel oil, hydraulic fluids, lubricants, etc.) are removed from the platform prior to disposal.

9.3 The disposal must be done during weather conditions which will enable effective positioning at the disposal site. The timing of disposal activities must be outside any commercial fishery opening in the area.

9.4 The Permittee must ensure that arrangements are in place so that an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 is on site during the disposal operation.

9.5 The Permittee must provide on-site contingency measures and equipment to ensure the clean-up of any floatables and oil residues after the disposal should the need arise. The clean-up must be carried out to the satisfaction of the on-site enforcement inspector or the permit issuing office.

9.6 The Permittee must ensure that a contingency plan for the transport and disposal is in place to minimize impacts to the marine environment, navigation and unacceptable risks to human health.

9.7 The Permittee shall notify, in writing, the Regional Director, Environmental Protection Branch, Department of the Environment, and the Regional Hydrographer, Department of Fisheries and Oceans, of the final position of the platform within two weeks of the completion of the disposal. This notification must include the date on which the disposal occurred, the exact latitude and longitude of the disposal site, a description of how the position was determined and its estimated accuracy, and a measurement of the minimum depth over the sunken platform. 9.8 The Permittee must ensure that all contractors involved in the disposal activity under this permit are made aware of its restrictions or conditions and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be on site during the disposal activities.

Notice with Respect to Short-, Medium- and Long-chain Chlorinated Paraffins

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether to control or the manner in which to control short-, medium- and long-chain chlorinated paraffins, any person described in Schedule 1 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 2 to this notice, to provide that information no later than February 6,2003.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of Edward Dowdall, Use Patterns and Controls Implementation Section, Environment Canada, 351 Saint-Joseph Boulevard, 12th Floor, Hull, Quebec K1A 0H3. Persons Required to Provide Information

1. This notice applies to any person who, during the 2000 or 2001 calendar year:

(a) manufactured, imported, exported, distributed or sold chlorinated paraffins; or
(b) manufactured, imported or exported products that contained chlorinated paraffins.

Information Required

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1.

"chlorinated paraffins" means short-, medium- and long-chain chlorinated paraffins.

"export" means movement out of Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"import" means movement into Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"long-chain chlorinated paraffins" means chlorinated derivatives of n-alkanes having 18 or more carbon atoms.

"manufacture" means to produce by such means as, but not limited to, chemical synthesis, formulation, blending or compounding and includes the incidental production of a substance.

"medium-chain chlorinated paraffins" means chlorinated derivatives of n-alkanes having between 14 and 17 carbon atoms, inclusively.

"product" includes, but is not limited to, metal working fluids, sealants, vinyl coatings and flame retardants.

"short-chain chlorinated paraffins" means chlorinated derivatives of n-alkanes having between 10 and 13 carbon atoms, inclusively.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

2. For greater certainty, the following includes, but is not limited to, the known trade names containing or used to identify certain chlorinated paraffins:

3. The persons described in Schedule 1 shall provide only the information required in sections 5, 6 and 7 if they

(a) manufactured, imported, exported, distributed or sold chlorinated paraffins in quantities of less than 100 kilograms for each category of activity for all facilities; or

(b) manufactured, imported or exported products that contain chlorinated paraffins in

(i) a concentration of less than 100 milligrams per kilogram for each category of activity for each facility; or

(ii) a total quantity of chlorinated paraffins of less than 100 kilograms for each category of activity for all facilities.

4. If the information provided in response to this notice represents more than one facility, persons to whom this notice applies shall provide the name and address of each facility to which the information relates as an attachment to their submission.

EXPLANATORY NOTE

(This note is not part of the notice.)

Chlorinated paraffins are chlorinated derivatives of n-alkanes having ten or more carbon molecules and a chlorine content ranging from approximately 30 to 70 percent. Paraffins can be divided into groups depending on chain length — short, medium and long, and the degree of chlorination. Chlorinated paraffins are used as secondary plasticizers for polyvinyl chloride, as extreme pressure additives in metal machining fluids, and as fire retardants.

Short-chain chlorinated paraffins have a length of between 10 and 13 carbon atoms (C10-13). They are imported into Canada for use mainly as lubricants in the metal working sector. They are also used as flame retardants and/or plasticizers in items including PVC, synthetic rubber, paints and sealants.

Medium-chain chlorinated paraffins have a length of between 14 and 17 carbon atoms (C14-17) and long-chain chlorinated paraffins have chain lengths of at least 18 carbon atoms. At the time of release of the first Priority Substances List assessment, medium- and long-chain chlorinated paraffins were produced in, and imported into, Canada for use as plasticizers and flame retardants, as well as extreme-pressure additives in lubrication oils.

The information collected in this notice will serve to assess the trends in chlorinated paraffin use and the extent of short-chain chlorinated paraffin contamination in medium- and long-chain chlorinated paraffins, as well as assist in determining whether to control or the manner in which to control these substances.

This notice was published in the Canada Gazette, Part I, pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999 (CEPA 1999). This notice requires the persons to whom it applies to provide certain information on their activities with respect to chlorinated paraffins.

Pursuant to subsection 71(3) of CEPA 1999, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is February 6, 2003.

Compliance with CEPA 1999 is mandatory. Subsection 272(1) of CEPA 1999 provides that:

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

...

Subsection 272(2) of CEPA 1999 provides that:

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of CEPA 1999 provides that:

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of CEPA 1999 provides that:

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

Significant New Activity Notice No. 9350a

Significant New Activity Notice (Section 110 of the Canadian Environmental Protection Act, 1999)

Whereas the Ministers of Health and of the Environment have previously issued a Significant New Activity Notice No. 9350 with respect to the living organism Thiobacillus W5 consortium, on June 16, 2001;

Whereas the living organism is not on the Domestic Substances List;

Whereas the Ministers have assessed additional information pertaining to the living organism;

And whereas the Ministers suspect that a significant new activity in relation to the living organism, by virtue of its composition, may result in the living organism becoming toxic,

Now, therefore, the Minister of the Environment hereby rescinds the Significant New Activity Notice No. 9350 under subsection 110(2) of the Canadian Environmental Protection Act, 1999, and makes this Significant New Activity Notice No. 9350a in replacement thereof,

And further, the Minister of the Environment indicates, pursuant to section 110 of the Canadian Environmental Protection Act, 1999, that subsection 106(4) of the same Act applies with respect to the living organism.

A significant new activity involving the living organism is any activity which does not include:

(a) use of the living organism within a contained facility;

(b) pasteurization of any wastes containing the living organism and elemental sulphur at a temperature equal to or greater than 60°C for a minimum of 30 minutes and stabilization with lime prior to disposal; and

(c) effective disinfection prior to disposal of any other bleed stream wastes containing the living organisms, using a UV apparatus, or standard bleach solution, or pasteurization at a temperature equal to or greater than 60°C for a minimum of 30 minutes.

The following information must be provided to the Minister of the Environment at least 90 days prior to the beginning of the proposed new activity:

(1) description of the proposed new activity in relation to the living organism;

(2) submission of all information describing the new methods of treating and disinfecting wastes prior to disposal; and

(3) submission of all information relating to the treatment and disinfection of the process streams prior to their direct or indirect release to the Environment, and the efficacy of the disinfection.

The above information will be assessed within 90 days of its being provided to the Minister of the Environment.

EXPLANATORY NOTE

(This explanatory note is not part of the Significant New Activity Notice.)

A Significant New Activity Notice (SNAc Notice) is a legal document issued by the Minister of the Environment that lists the activities for a given substance in Canada for which there has been no finding of toxicity under the Canadian Environmental Protection Act, 1999 (CEPA 1999). The requirements prescribed in the Notice indicate the appropriate information to be sent to the Minister for assessment prior to the commencement of a new activity as described in the Notice.

A SNAc Notice can be issued for both Domestic Substances List (DSL)-listed and non-listed substances. Substances listed on the DSL that have a SNAc Notice attached may be imported or manufactured within Canada, if used within the activity constraints listed in the SNAc Notice. It is the responsibility of the users of the substance to be aware of and to follow all activity restrictions, and to submit a SNAc Notification to the Minister prior to the commencement of a significant new activity associated with the substance.

Substances that are not listed on the DSL can only be imported or manufactured by the person who has met the requirements under sections 81 or 106 of CEPA 1999. In circumstances where a SNAc Notice is issued for a substance that is not eligible for listing on the DSL, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with any activity restrictions imposed by a SNAc Notice, and of the obligation to notify any new activity as described in the Notice. It is the responsibility of the users of the substance to follow all activity restrictions, and to submit a SNAc Notification to the Minister prior to the commencement of a significant new activity associated with the substance.

A SNAc Notice does not constitute an endorsement by the Minister of the Environment with respect to the substance to which it relates, nor does it constitute an exemption from the application of any other laws (whether statutes, regulations, or other) that may also apply to the substance or related activities.
