South-West Asia Service Medal

Whereas it is desirable and our Privy Council for Canada has advised that Letters Patent do issue instituting and creating in Canada the South-West Asia Service Medal for the purpose of according recognition to any person enrolled in, attached to or working with the Canadian Forces while the Forces were engaged in the operations against terrorism in South-West Asia after September 11, 2001;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, hereby advises Her Majesty the Queen that Letters Patent, to which Her Majesty may be graciously pleased to affix Her signature, do issue under the Great Seal of Canada, providing that there shall be instituted and created in Canada a medal to be designated and styled the South-West Asia Service Medal, the description and eligibility criteria of which shall be provided for by the South-West Asia Service Medal Regulations annexed to the Letters Patent.

TO ALL TO WHOM these Presents shall come or whom the same may in any way concern,

GREETING:

WHEREAS it is desirable and Our Privy Council for Canada has advised that Letters Patent do issue instituting and creating in Canada the South-West Asia Service Medal for the purpose of according recognition to any person enrolled in, attached to or working with the Canadian Forces while the Forces were engaged in the operations against terrorism in South-West Asia after September 11, 2001;

NOW KNOW you that We, by and with the advice of Our Privy Council for Canada, do by these Presents institute and create a medal to be designated and styled the South-West Asia Service Medal,

AND WE DO ordain, direct and appoint that the description and eligibility criteria of the South-West Asia Service Medal shall be provided for by the annexed South-West Asia Service Medal Regulations, as those Regulations may from time to time be amended, repealed or revised by Letters Patent issued by Us, Our Heirs and Successors or Our Governor General of Canada on Our behalf.

IN WITNESS WHEREOF, We have caused these Our Letters to be made Patent and We have caused Our Great Seal of Canada to be affixed to these Presents, which We have signed with Our Royal Hand.

GIVEN the thirty-first day of July in the year of Our Lord two thousand and two and in the fifty-first year of Our Reign.

SOUTH-WEST ASIA SERVICE MEDAL REGULATIONS

INTERPRETATION

1. The definitions in this section apply in these Regulations.

"Bar" means the bar described in section 5. (Barrette)

"Medal" means the South-West Asia Service Medal instituted by section 2. (Médaille)

"theatre of operations" means a subset of the United States Central Command Area of Responsibility (USCENTCOM's AOR) that includes Afghanistan, Bahrain, Kuwait, Qatar, the United Arab Emirates, the Persian Gulf, the Gulf of Oman, the Gulf of Aden, the Red Sea, the Suez Canal and those parts of the Indian Ocean and the Arabian Sea that are west of sixty-eight degrees East longitude and north of five degrees South latitude, as well as the airspace above that subset. DESIGNATION

2. There shall be instituted a medal to be designated as the "South-West Asia Service Medal".

DESCRIPTION

3. (1) The Medal shall consist of a circular medal made of cupronickel, 36 mm across, with a claw at the top of the medal, in the form of a cluster of olive leaves, being attached to a straight, slotted bar.

(2) On the obverse of the Medal shall appear the effigy of Her Majesty the Queen of Canada, wearing the King George IV State Diadem, facing right, circumscribed with the inscriptions "ELIZABETH II", "DEI GRATIA REGINA" and "CANADA", separated by small maple leaves.

(3) On the reverse of the Medal shall appear a representation of a hydra, the many-headed creature of Greek mythology also described as a multifarious evil not to be overcome by a single effort, that is transfixed by a Canadian sword, and over which shall appear the Latin phrase "ADVERSUS MALUM PUGNAMUS", which means "we are fighting evil".

(4) The Medal shall be suspended by a ribbon, 32 mm in width, with a 12 mm white stripe in the middle flanked by 4 mm black stripes, 2 mm red stripes and 4 mm sand stripes.

4. The Medal shall be awarded for honourable service.

5. The Bar to the Medal shall consist of cupronickel with raised edges and bear the name "AFGHANISTAN".

6. The Bar shall be awarded for honourable service.

ELIGIBILITY

7. A person may be awarded the Medal if the person:

(a) is enrolled in, attached to or working with the Canadian Forces; and

(b) has been posted on the establishment of, attached to or working with a Canadian or allied unit or formation deployed outside Canada that was participating in, or provided direct support on a full time basis to, operations conducted in the theatre of operation against terrorism in South-West Asia for a period of at least 90 days after September 11, 2001.

8. A recipient of the Medal may be awarded the Bar if the recipient has served for a period of at least 30 days, while deployed in the theatre of operations after September 11, 2001.

9. Any person who dies or is evacuated from the theatre of operations because of injuries or medical reasons directly attributable to service is deemed to have completed the minimum service required under sections 7 or 8.

10. If the Deputy Chief of the Defence Staff considers that the nature of combat or other operations warrants the award of the Medal or Bar, although the criteria set out in sections 7 and 8 are not met, the Deputy Chief of the Defence Staff may recommend that the criteria be waived. Such a waiver shall be made with the approval of the Chief of the Defence in consultation with Armed Forces Council and on the recommendation of the Canadian Forces Honours Committee.

11. Service counted towards the Medal cannot be counted towards any other Canadian or foreign award.

AWARD

12. The Chief of the Defence Staff shall make a list of all persons who are eligible to be awarded the Medal, or the Medal and Bar, and shall forward the list to the Governor General.

13. The Medal and Bar may be awarded posthumously.

PRESENTATION

14. Unless the Governor General otherwise directs, the Medal and Bar shall be presented to the recipient, on behalf of the Governor General, as arranged by the Chief of the Defence Staff.

WEARING OF MEDAL AND BAR

15. (1) The Medal shall be worn after the Somalia Medal on the left breast.

(2) The Bar shall be worn centred on the ribbon described in subsection 3(4).

(3) When the undress ribbon is worn, a silver maple leaf shall be worn centred on the ribbon to denote the award of the Bar.

16. A recipient of the Medal may wear a miniature medal, which is one-half the size of the Medal, on all occasions when the wearing of miniature medals is customary.

CANCELLATION AND REINSTATEMENT

17. (1) The Governor General may, on the advice of the Chief of the Defence Staff,

(a) cancel or annul the award of the Medal or Bar to any person; and

(b) restore the award of a Medal or Bar that has been cancelled or annulled.

(2) Where the award of a Medal or Bar is cancelled or annulled, the name of the recipient shall be deleted from the register referred to in paragraph 18(c).

ADMINISTRATION

18. The Director, Honours, Chancellery shall:

(a) acquire the Medals and Bars;

(b) provide the Medals and Bars to the Chief of the Defence Staff;

(c) maintain a register containing the names of recipients and such other records relating to the award as the Director considers necessary; and

(d) perform such other functions in respect of awards of the Medal and Bar as the Governor General may require the Director to perform.

GENERAL

19. Nothing in these Regulations limits the right of the Governor General to exercise all powers and authorities of Her Majesty in respect of the Medal and Bar.
