Application for Certification: Guild of Canadian Film Composers — Tribunal File No. 1310-02-002

In accordance with subsection 25(3) of the Status of the Artist Act, the Canadian Artists and Producers Professional Relations Tribunal hereby gives notice that it has received an application for certification from the Guild of Canadian Film Composers (GCFC). The GCFC is seeking certification to represent a sector composed of all professional independent contractors engaged by a producer subject to the Status of the Artist Act who create, write, compose, orchestrate, arrange or edit music, lyrics (in a language other than French) or music and lyrics where the said music and/ or lyrics are intended for film, videotape, digital media or any other audio-visual media or analogous process, or any other process now known or to be invented which modifies or replaces the aforementioned technology and processes, with the exception of:

The artists covered by the certification granted to the Société professionnelle des auteurs et des compositeurs du Québec (SPACQ) by the Canadian Artists and Producers Professional Relations Tribunal on May 17, 1996, as may be amended by the Tribunal in the future.

And is subject to:

(a) The agreement concluded between the Guild of Canadian Film Composers and the Society of Composers, Authors and Music Publishers of Canada (SOCAN) on May 6, 2002; and

(b) The agreement concluded between the Guild of Canadian Film Composers and the Société du droit de reproduction des auteurs, compositeurs et éditeurs au Canada (SODRAC) inc. on May 13, 2002.

Any artists' association that wishes to make a competing application for certification in respect of the same sector or any part of the same sector must file its application for certification no later than October 18, 2002. Any individual or organization that wishes to make representations to the Tribunal regarding the application must notify the Tribunal in writing of their interest no later than October 18, 2002.

Request to Review the Certification Order of the Société professionnelle des auteurs et des compositeurs du Québec (SPACQ) — Tribunal File No. 1350-02-008

The Société professionnelle des auteurs et des compositeurs du Québec (SPACQ) was certified on May 17, 1996, by the Canadian Artists and Producers Professional Relations Tribunal to represent a sector composed of lyricists, composers and lyricist-composers:

(a) of songs in the French language commissioned by a producer to whom the Status of the Artist Act applies;

(b) of music without words commissioned by a French-language broadcast undertaking, when the composer is a resident of Quebec;

(c) of music without words commissioned by any producer in Quebec to whom the Status of the Artist Act applies, when the composer is a resident of Quebec.

The SPACQ is asking the Tribunal to amend its certification as a result of the application for certification filed by the Guild of Canadian Film Composers (Tribunal File No. 1310-02-002) which is the subject of Public Notice 2002-1. The sector requested by the SPACQ is as follows:

Independent contractors engaged in a production in Quebec, by a producer subject to the Status of the Artist Act with the exception of a national private English-language broadcaster, to perform the function of lyricist, composer, lyricist-composer, or music or song editor.

Any artist, artists' association or producer wishing to file written representations with the Tribunal with respect to this request must do so no later than October 18, 2002.

Call for Comments Concerning Internet Retransmission (Order in Council P.C. 2002-1043)

Extension of deadline for submission of comments

1. In Public Notice CRTC 2002-38 dated July 19, 2002, the Commission called for comments on the broadcasting regulatory framework for Internet retransmission of over-the-air television and radio signals. The Commission established a two-stage process for the filing of written comments, with initial comments to be filed by September 6, 2002, and reply comments by October 4, 2002.

2. At the request of the Canadian Association of Broadcasters, the Commission extends the deadline for the filing of initial comments to September 13, 2002. The deadline for the filing of reply comments remains October 4, 2002.
