CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-04249 is approved.

1. Permittee: Lower North Shore Community Seafood Cooperative, Harrington Harbour, Quebec.

2. Type of Permit: To load and dispose of fish waste and other organic matter resulting from industrial fish-processing operations.

3. Term of Permit: Permit is valid from September 17, 2002, to September 16, 2003.

4. Loading Site(s): Harrington Harbour Wharf, 50°29.80' N, 59°28.70' W (NAD27).

5. Disposal Site(s): Within a 100 m radius of 50°29.70' N, 59°28.35' W (NAD27).

6. Route to Disposal Site: Direct navigational route from the loading site to the disposal site.

7. Equipment: The material will be placed in a towed scow.

8. Method of Disposal: The material to be disposed of will be placed in the towed scow and discharged directly into the sea within the perimeter indicated in paragraph 5.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 400 metric tonnes.

11. Waste or Other Matter to Be Disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

12. Requirements and Restrictions:

12.1. It is required that the Permittee report, in writing, to the Regional Director, Environmental Protection Branch, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, at least 48 hours prior to the start of the first disposal operation to be conducted under this permit.

12.2. A written report shall be submitted to the Regional Director, at the address listed in paragraph 12.1., within 30 days of the expiry of the permit. This report shall include the Registry of Ocean Disposal Operations referenced in paragraph 12.5., and contain the following information: the quantity and type of material disposed of pursuant to the permit, dates on which the disposal and loading activities occurred, and the equipment used for loading and disposal operations.

12.3. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. A copy of this permit must, at all times, be kept on board any vessel involved with the disposal operations.

12.5. The Permittee must complete the Registry of Ocean Disposal Operations as provided by the Department of Environment. This registry must, at all times, be kept on board any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

12.6. The loading and disposal at sea referred to under this permit shall not be carried out without written authorization from the Permittee.

12.7. The towed scow or containers to transport the material to be disposed of must be covered in a manner to prevent access by gulls and other sea birds.

12.8. The loading must be completed in a manner that ensures no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee must also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

MOTOR VEHICLE SAFETY ACT

Notice of Publication of Revision 1 of Technical Standards Document No. 121, "Air Brake Systems"

Notice is hereby given, pursuant to section 12 of the Motor Vehicle Safety Act and sections 16 and 17 of the Motor Vehicle Safety Regulations, that the Department of Transport has revised Technical Standards Document (TSD) No. 121, "Air Brake Systems," which establishes performance and equipment requirements for vehicles equipped with air brake systems. Revision 1 of TSD No. 121 is effective as of the date of publication of this notice and will become enforceable six months thereafter. Vehicles manufactured during the six-month interim period may conform to the requirements of either the current version or Revision 1.

TSD No. 121, "Air Brake Systems," reproduces U.S. Federal Motor Vehicle Safety Standard No. 121 of the same title and is incorporated by reference in section 121 of the Motor Vehicle Safety Regulations. This revision adopts the changes made by two recent Final Rules issued by the National Highway Traffic Safety Administration of the U.S. Department of Transportation. These Final Rules were published in the Federal Register of December 12, 2001 (Vol. 66, No. 239, p. 64154), and May 28, 2002 (Vol. 67, No. 102, p. 36819).

In the Final Rule published in December 2001, several minor amendments were made in order to simplify testing, increase safety during brake testing, and correct an inconsistency concerning emergency brake stops. Revision 1 adds a definition for "tandem axle," which clarifies the wheel-lock requirements, and it amends S5.3.1.1(a) to prevent the overloading of single-unit axles in fully loaded brake tests. Revision 1 also permits the use of roll bars in brake testing, which will protect test drivers in the event of a rollover; consequently, S5.3.1.1(b) and (c); steps 2b, 7 and 8 of Table I; paragraph S5.6.2(b); and S5.7.1 have been modified to take into account the added mass of the roll bars. In addition, the requirement previously contained in S5.7.3(b) to test truck tractors in the loaded condition for emergency brake stops has been eliminated, along with a reference to S5.7.3(b), which was removed from S6.1.14. The typographical errors previously contained in S6.1.8 and S6.2.5 of the U.S. standard were not reproduced in the TSD.

In accordance with the changes introduced in the Final Rule of May 2002, Revision 1 also deletes Figure 1(a), which was obsolete, and the related provision contained in S6.1.13(b). As a result, S6.1.13(a) is renumbered as S6.1.13. The word "tire" has been inserted before "inflation" in S6.1.2 in order to clarify the meaning of the paragraph, and S6.1.16, Thermocouples, which outlines temperature sensor installation, has been added to S6.1. The typographical errors corrected in the Final Rule that were contained in S5.4.1.1, S6.1.8, S6.2.5, and Table III had already been corrected, as had the rated brake chamber volumes contained in Table V.
