SPECIAL IMPORT MEASURES ACT
Fresh Tomatoes — Decision
On June 24, 2002, the Commissioner of Customs and Revenue made a final determination of dumping under paragraph 41(1)(a) of the Special Import Measures Act (SIMA), respecting fresh tomatoes, originating in or exported from the United States of America, excluding tomatoes used for processing. The goods in question are usually classified under the following Harmonized System classification numbers:
0702.00.99.10 0702.00.99.20 0702.00.99.90
Information
The Canadian International Trade Tribunal is continuing its inquiry into the question of injury to the Canadian industry and will make its finding on or before July 23, 2002. If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports released from customs after the date of the Tribunal's finding will be subject to an anti-dumping duty equal to the margin of dumping. As of July 1, 2002, the provisions of the Customs Act will apply to the payment and collection of anti-dumping duties levied or returned under SIMA.
