CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-04246 is approved.

1. Permittee: Mines Seleine, a division of La Société canadienne de Sel limitée, Grosse-Île, Îles-de-la-Madeleine, Quebec.

2. Type of Permit: To dump or load dredged material.

3. Term of Permit: Permit is valid from August 5 to October 31, 2002.

4. Loading Site(s): The loading of dredged material is restricted to the segments of the Grande-Entrée channel delineated in this paragraph and must be done in accordance with the associated restrictions. The segments are delineated by precise measurements marking out the course of the said channel as defined in figure 2.1 titled "Localisation de la zone à l'étude et des points d'échantillonnage" of the report entitled "Information relative à l'examen préalable pour le dragage d'entretien du Chenal de la Grande-Entrée" file QE 504-00-044, prepared by Robert Hamelin et Associés inc. April 12, 2002. The placing of the marker buoys for each channel segment and the loading operations must be done in accordance with information appearing in the above-cited report.

List of channel segments and restrictions on loading:

Segment 258 to 4 200: Loading is limited to 60 percent of the maximum loading capacity of the dredge at all times and dredging is authorized for two out of three days from August 5 to October 15, 2002.

Segment 4 200 to 7 350: Dredging is authorized on two out of three days from August 5 to August 11, 2002, and dredging is authorized on two out of three days from August 26 to September 23, 2002.

Segment 7 350 to 8 650: Dredging is prohibited from September 24 to October 13, 2002.

Segment 8 650 to 10 720: Dredging is authorized on two out of three days from August 5 to September 30, 2002.

5. Disposal Site(s): Disposal area "D" delineated by the following coordinates: 47°31'33.22" N, 61°36'01.54" W; 47°31'22.25" N, 61°35'32.79" W; 47°31'02.51" N, 61°35'49.29" W; 47°31'12.01" N, 61°36'19.19" W (NAD27). The placing of the marker buoys at these four reference points must be done in accordance with the map number 01-00715 of Enterprises Normand Juneau inc. dated March 11, 2002, titled "Bathymétrie Dépôt "D" Disposition des matériaux dragués" and the instructions described in the report mentioned in paragraph 4. The accumulation of dredged material must not reduce water depth to less than 10.5 m at any point in the disposal area.

6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site.

7. Equipment: Trailing suction hopper dredge.

8. Method of Disposal: Direct discharge from the vessel. The disposal activities must be done in accordance with the instructions described in the report mentioned in paragraph 4. Also, fine sediments dredged in segment 258 to 4 200 must be deposited in the interior deep zone of the disposal site. Once the disposal of these fine sediments is complete, they must be entirely covered with one metre of coarse materials originating in segment 4 200 to 10 720 of the channel.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed: Not to exceed 300 000 m3 scow measure.

11. Material to Be Disposed of: Dredged material consisting of sand, silt, clay and gravel originating from the loading zone defined in paragraph 4.

12. Requirements and Restrictions:

12.1. At least 15 days before the start of any loading or disposal operations of sediments from segment 258 to 4 200 the Permittee must present to the Regional Director, Environmental Protection Program, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, (514) 283-4423 (Facsimile), immersion.qc@ec.gc.ca (Electronic mail), the results of marine or estuarine bioassays required by the letter from the Department of the Environment dated May 6, 2002. The samples and the results of these bioassays will be approved by the Department of the Environment.

12.2. The Permittee must put in place a continuous monitoring program for suspended sediments in the aquaculture park sector during the dredging of segment 258 to 4 200. Dredging activity will be halted in segment 258 to 4 200 for six consecutive hours if the concentration of suspended sediments exceeds, for a six consecutive hours, 150 mg/L in the blue mussel park or 10 mg/L in the scallop park.

12.3. The Permittee must complete bathymetry control in order to ensure the proper execution of capping work mentioned in paragraph 8.

12.4. The Permittee must complete an assessment of arsenic, copper, and cadmium concentrations in mollusk tissues from mollusks raised in the three aquaculture sites identified in figure 2.1 mentioned in paragraph 4. The study must include measurements taken before, during, and after the dredging of segment 258 to 4 200.

12.5. At least 15 days before the commencement of any loading or disposal operations in respect of this permit, the Permittee must obtain approval of the final version of the Monitoring and Environmental Protection Program, along with protocols necessary for it's implementation, from the Environmental Protection Branch, Department of the Environment, Quebec Region. The Permittee must submit a written report summarizing the results of the Monitoring and Environmental Protection Program to the Regional Director, identified in paragraph 12.1., within 120 days following the expiration of the permit.

12.6. The Permittee must obtain all other necessary permits, licenses, or approvals from other regulatory agencies in respect of the project described herein.

12.7. The Permittee shall mark out with buoys, the reference points for the disposal and loading sites defined herein, for the entire duration of the operations.

12.8. The Permittee must put out notices to navigation as appropriate of the progress of maintenance dredging operations and send to the Hydrographic Service of Canada, Mont-Joli Office, a bathymetric survey of the area after dredging. The Permittee must conform with the Collision Regulations of the Canada Shipping Act concerning signaling of floating equipment used and to assure that no piece of equipment is abandoned when work is completed.

12.9. The zone of common crab fishing located outside the lagoon on the west side of the channel, between the two navigation buoys, will be closed to navigation for dredging equipment and service boats.

12.10. The Permittee shall ensure that all contractors involved in the loading or disposal activities for which the permit is issued are made aware of any restrictions and conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit must be carried on all vessels involved in dredging or ocean disposal activities.

12.11. The loading or ocean dumping referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

12.12. The Permittee must keep a detailed register of loading and disposal operations conducted with respect to this permit. This registry must, at all times, be kept aboard the vessel involved with the disposal operations and be accessible to inspectors designated under the Canadian Environmental Protection Act, 1999.

12.13. The Permittee must advise the Canadian Coast Guard station at Rivière-au-Renard immediately before leaving the loading site to conduct disposal operations at the disposal site. The Permittee must record these communications in the registry mentioned in the previous paragraph.

12.14. It is required that the Permittee report in writing to the Regional Director, identified in paragraph 12.1., at least 48 hours prior to the first dumping operation pursuant to this permit.

12.15. The Permittee must put in place a compensation project to augment the production capacity of habitat in order to compensate for the disturbance caused by the deposit of sediments at disposal site "D". The compensation project should be implemented consistent with the compensation agreement between La Société canadienne de Sel limitée and the Department of Fisheries and Oceans.

12.16. The Permittee shall submit a written report to the Regional Director, identified in paragraph 12.1., within 30 days of the expiry of the permit. This report shall contain the register mentioned in paragraph 12.12., and contain the following information: the quantity and type of material disposed of during disposal operations pursuant to the permit, the equipment used, and the dates on which the loading and disposal activities occurred.

12.17. It is required that the Permittee admit any inspector designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.18. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.
