COMMISSIONS

CANADA CUSTOMS AND REVENUE AGENCY

SPECIAL IMPORT MEASURES ACT

Leather Safety Footwear — Decision

On November 27, 2001, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Commissioner of Customs and Revenue made a final determination of dumping respecting leather footwear with metal toe caps, originating in or exported from the People's Republic of China, excluding waterproof footwear subject to the finding made by the Canadian International Trade Tribunal in Inquiry No. NQ-2000-004.

The goods in question are usually classified under the Harmonized System classification numbers 6403.40.00.10, 6403.40.00.20 and 6403.40.00.90.

Information

The Canadian International Trade Tribunal is continuing its inquiry into the question of injury to the Canadian industry and will make its finding on or before December 27, 2001. If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods may be subject to an anti-dumping duty equal to the amount by which the normal value exceeds the export price of the goods. In that event, all duty payable under section 3 of SIMA is hereby demanded pursuant to section 11 of SIMA.

A statement of reasons that provides further details of this decision is available on the Canada Customs and Revenue Agency's Web site at www.ccra-adrc.gc.ca/sima. DETERMINATION

Food

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2001-027) on November 28, 2001, with respect to a complaint filed by PTI Services (the complainant), of Edmonton, Alberta, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. E0209-000104/A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for the supply of food and food services for the Rocky Mountain National Army Cadet Summer Training Centre located near Cochrane, Alberta.

The complainant alleged that PWGSC had improperly evaluated the complainant's proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.
