SPECIAL IMPORT MEASURES ACT
Fresh Tomatoes — Decision
On November 9, 2001, the Commissioner of Customs and Revenue initiated an investigation pursuant to subsection 31(1) of the Special Import Measures Act into the alleged injurious dumping into Canada of fresh tomatoes, originating in or exported from the United States of America, excluding tomatoes used for processing.
The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (the Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.
The Canada Customs and Revenue Agency (CCRA) will conduct an investigation into the alleged dumping at the same time and will render a preliminary decision within 90 days if the investigation continues.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2001-040) from Hewlett-Packard (Canada) Ltd., of Ottawa, Ontario, concerning a procurement (Solicitation No. V9419-000008/C) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Human Resources Development (HRDC). The solicitation is for the development and implementation of a consolidation plan for UNIX Services and the establishment of a means of acquiring services (including professional services), equipment and software, as and when required. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

REVIEW OF RECOMMENDATION
Ring-spun Yarns
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will review (Review No. TA-2001-001) its recommendation to the Minister of Finance in Review No. TA-98-004, concerning certain ring-spun yarns, as implemented by Order in Council P.C. 1999-1342 dated July 28, 1999. The tariff relief order is scheduled to expire on June 30, 2002.
The tariff relief order concerns the following tariff item Nos.: 5205.14.20, 5205.15.20, 5205.24.20, 5205.26.20, 5205.27.20, 5205.28.20, 5205.35.20, 5205.46.20, 5205.47.20, 5205.48.20, 5206.14.10, 5206.15.10, 5206.24.10, 5206.25.10, 5509.53.10, 5509.53.20, 5509.53.30 and 5509.53.40.
Notice of Expiry No. TE-2001-001, issued on October 2, 2001, informed interested persons of the impending expiry of the tariff relief order. On the basis of representations requesting or opposing the initiation of a review received by the Tribunal in reply to the notice, the Tribunal is of the opinion that a review of its recommendation is warranted.
The Tribunal will review, under section 19 of the Canadian International Trade Tribunal Act and in accordance with subparagraph 19(7) of the Textile Reference Guidelines, the appropriateness of recommending the renewal, amendment or termination of the tariff relief order on importations of certain ring-spun yarns covered by the said order.
The Tribunal will hold a public hearing to address the following issues: (1) the availability of identical or substitutable ring-spun yarns from domestic producers and their comparability with imported ring-spun yarns; (2) the substitutability of carded ring-spun yarns vs. combed ring-spun yarns; and (3) the impact on operations (i.e. effect on sales, prices, profitability, employment) should the tariff relief order be renewed. The hearing will be held in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing on March 13, 2002, at 9:30 a.m., to hear evidence and representations by interested parties.
Each interested person or government wishing to participate at the hearing as a party must file a notice of participation with the Secretary on or before December 21, 2001. Each counsel who intends to represent a party at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before December 21, 2001.
Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.
The Tribunal may call industry and government witnesses, as it deems necessary and appropriate, in order to assist it in reviewing the matter. It is the Tribunal's intention to conduct this public hearing as informally as possible. In camera sessions may be held if confidential information is raised at the hearing. Only counsel who have signed a written undertaking of confidentiality will be able to attend these sessions with Tribunal members and staff present.
To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested person or government filing a notice of participation and each counsel filing a notice of representation must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using English or French or both languages at the hearing.

Extension of deadline for comments
In Public Notice CRTC 2001-111, the Commission called for comments on proposed amendments to its Specialty Services Regulations, 1990 and its Pay Television Regulations, 1990.
These amendments will serve to remove the prior approval requirement that applies in situations where a person licensed to operate a distribution undertaking seeks to purchase, directly or indirectly, more than 10 percent of a pay or specialty undertaking.
The new deadline for comments is Thursday, December 13, 2001.

AMENDMENT
1. Subsection 10(4) of the Specialty Services Regulations, 1990 (see footnote 1) is amended by adding the word "or" at the end of paragraph (b), by striking out the word "or" at the end of paragraph (c) and by repealing paragraph (d) (see footnote 2).
COMING INTO FORCE
2. These Regulations come into force on the day on which they are registered.
