CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice with Respect to Certain Substances on the Domestic Substances List (DSL)

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice to provide that information no later than March 8, 2002.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of the DSL Surveys Coordinator, Environment Canada, 351 Saint-Joseph Boulevard, 14th Floor, Hull, Quebec K1A 0H3. Pursuant to section 313 of the Canadian Environmental Protection Act, 1999, any person who provides information in response to this notice may submit, with the information, a written request that it be treated as confidential.

Pursuant to subsection 71(4) of the Canadian Environmental Protection Act, 1999, the Minister of the Environment may, on request in writing from any person to whom this notice applies, extend the time or times within which the person shall comply with this notice.

SCHEDULE 2

Persons Required to Provide Information

1. This notice applies to any person who, during the 2000 calendar year:

(a) manufactured or imported a substance listed in sections 1 to 8 of Schedule 1, whether alone or in a mixture or in a product other than a manufactured item, in a total quantity greater than 100 kilograms of the substance; or

(b) manufactured or imported a substance listed in section 9 of Schedule 1, whether alone or in a mixture or in a product other than a manufactured item, in a total quantity greater than 10 000 kilograms of the substance.

SCHEDULE 3

Information Required

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1st.

"export" means movement out of Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"identifier" means a name used to identify or refer to a substance, or a set of mixtures or products in which it is contained, with similar end uses and concentration of the substance (e.g. lipstick, laundry detergent, furniture polish, etc.).

"import" means movement into Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"manufacture" means to produce, prepare or compound a substance and includes the incidental production of a substance at any level of concentration as a result of the manufacturing, processing or other uses of other substances, mixtures, products, or manufactured items.

"manufactured item" means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design including, but not limited to, clothing,

empty storage containers, furniture, tiles, electrical wire, fabric and carpeting, plywood, brake linings, fibres, leather, paper, yarns, dyed fabric, matches, flares, photographic films, and batteries.

"mixture" means a combination of substances that does not produce a substance that is different from the substances that were combined including, but not limited to, prepared formulations, hydrates, alloys, and reaction mixtures that are fully characterized in terms of constituents (e.g. paints, coating, blended fuels, solvent mixtures).

"studies" means any documents that cannot be found publicly by search on the Internet or on commercial databases by CAS RN(see footnote 10) of the substance.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

2. If the information provided in response to this notice represents more than one facility, persons to whom this notice applies shall provide the name, address, latitude and longitude of each facility to which the information relates as an attachment to their submission.

EXPLANATORY NOTE

(This note is not part of the notice.)

The Minister of the Environment and the Minister of Health are required, under subsection 73(1) of the Canadian Environmental Protection Act, 1999 (CEPA, 1999), to categorize the substances on the Domestic Substances List. Following this categorization, section 74 of the CEPA, 1999 requires the Ministers to conduct a screening assessment of the substances that meet the specific criteria set out in that section. The information required by this notice, in addition to other sources of information, will be used, among other things, to determine whether the substances covered by this notice are toxic or capable of becoming toxic as defined in section 64 of the CEPA, 1999.

The collection of technical and scientific information is necessary to conduct the screening assessments. With this first notice, Environment Canada and Health Canada are testing a staged data collection process to collect information on 123 substances.

Of this list of 123 substances, 93 (sections 1 to 8 of Schedule 1) were proposed by a technical advisory group made up of experts from various interested parties, and 30 (section 9 of Schedule 1) were selected by Health Canada. The list of substances includes a range of classes and types of uses for the substances present on the Domestic Substances List. It therefore represents a sample of the type of substances for which Environment Canada and Health Canada will collect information in future years.

This notice was published in the Canada Gazette, Part I, pursuant to paragraph 71(1)(b) of the CEPA, 1999. This notice requires the persons to whom it applies to provide certain information on their activities with respect to the substances listed in Schedule 1.

Pursuant to subsection 71(3) of CEPA, 1999, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is March 8, 2002.

Compliance with CEPA, 1999 is mandatory. Subsection 272(1) of CEPA, 1999 provides that:

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

Subsection 272(2) of CEPA, 1999 provides that:

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of CEPA, 1999 provides that:

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of CEPA, 1999 provides that:

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

Food and Drug Regulations — Amendment

Interim Marketing Authorization

Provision currently exists in the Food and Drug Regulations for the use of the alpha-amylase enzyme in the production of brewers' mash, distillers' mash, dextrins, maltose, dextrose, glucose (glucose syrup) and glucose solids (dried glucose syrup) at levels consistent with good manufacturing practice. This enzyme is obtained from a variety of sources including several Bacillus organisms. Health Canada has received a submission to permit the use of an alpha-amylase enzyme obtained from a genetically modified Bacillus licheniformis organism, the Bacillus licheniformis LiH 1464 (pLiH1346), that carries the gene from Bacillus stearothermo-philus coding for this enzyme.

Evaluation of available data supports the safety and effectiveness of this alpha-amylase obtained from the genetically modified Bacillus licheniformis LiH 1464 (pLiH1346). The data demonstrated satisfactorily that the genetic modification is limited to the modified Bacillus licheniformis organism and that the techniques used to isolate and purify the alpha-amylase enzyme from the organism produced an enzyme free from genetic material. Therefore, the resulting alpha-amylase enzyme does not transfer genetic material to final food products.

The use of this alpha-amylase enzyme will benefit both the consumers and industry through the increased availability of quality food products and more efficient and improved manufacturing conditions.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of the alpha-amylase enzyme obtained from the genetically modified Bacillus licheniformis LiH 1464 (pLiH1346). The use of this alpha-amylase will be permitted for the same purposes as the other alpha-amylase enzymes in the production of brewers' mash, distillers' mash, dextrins, maltose, dextrose, glucose (glucose syrup) and glucose solids (dried glucose syrup) at levels consistent with good manufacturing practice.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of this alpha-amylase enzyme as indicated above while the regulatory process is undertaken to formally amend the Regulations.

Interim Marketing Authorization

Pyridaben is registered under the Pest Control Products Act as a miticide/insecticide for the control of mites on apples, cucumbers, grapes, peaches/nectarines, pears, peppers, raspberries and strawberries. Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of pyridaben at 2 parts per million (p.p.m.) in strawberries, 1.5 p.p.m. in peaches/ nectarines, 1 p.p.m. in peppers, 0.75 p.p.m. in pears, 0.5 p.p.m. in apples, 0.3 p.p.m. in grapes, 0.1 p.p.m. in cucumbers, and 0.05 p.p.m. in imported almonds. MRLs have also been established at 0.05 p.p.m. in meat of cattle, goats, horses, and sheep, and 0.01 p.p.m. in milk to cover residues in food derived from animals fed with crops treated with pyridaben. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 p.p.m.

The Pest Management Regulatory Agency (PMRA) of Health Canada has recently approved an application to amend the registration of pyridaben in order to allow its use for the control of mites on tomatoes. The PMRA has also been requested to establish an MRL for residues of pyridaben resulting from this use in tomatoes, in order to permit the import and sale of food containing these residues.

Before making a registration decision regarding a new use of a pest control product, the PMRA conducts the appropriate assessment of the risks and value of the product specific to its proposed use. The registration of the pest control product will be amended if the data requirements for assessing value and safety have been adequately addressed, the evaluation indicates that the product has merit and value, and the human health and environmental risks associated with its proposed use are acceptable.

After the review of all available data, the PMRA has determined that an MRL of 0.15 p.p.m. for pyridaben in tomatoes would not pose an unacceptable health risk to the public.

The use of pyridaben on tomatoes will provide joint benefits to consumers and the agricultural industry as a result of improved management of pests. In addition, this use will contribute to a safe, abundant and affordable food supply by allowing the importation and sale of food commodities containing acceptable levels of pesticide residues.

Therefore, it is the intention of the PMRA to recommend that the Food and Drug Regulations be amended to establish an MRL for pyridaben of 0.15 p.p.m. in tomatoes.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate sale of tomatoes with an MRL for pyridaben of 0.15 p.p.m. while the regulatory process to amend the Regulations is undertaken.

Health Canada has received a submission to permit the use of sorbitan monostearate as an emulsifying agent in puddings at a maximum level of use of 0.5 percent. Evaluation of available data supports the safety and effectiveness of this new use for sorbitan monostearate.

The use of sorbitan monostearate will benefit the consumer through a greater availability of quality pudding products. It will also benefit the industry by facilitating their production.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of sorbitan monostearate as an emulsifying agent in puddings at a maximum level of use of 0.5 percent.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of sorbitan monostearate, as indicated above, while the regulatory process is undertaken to formally amend the Regulations.

Interim Marketing Authorization

Tebufenozide is registered under the Pest Control Products Act as an insecticide for the control of various insects on apples, cranberries, lettuce and peppers. Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of tebufenozide resulting from its use at 1 part per million (p.p.m.) in apples and 0.2 p.p.m. in peppers, and at 2.5 p.p.m. in raisins and 0.5 p.p.m. in grapes and kiwi fruit imported into Canada. The establishment of MRLs for tebufenozide in cranberries and lettuce is currently in progress. In the meantime, an interim marketing authorization was issued on August 4, 2001, to permit the immediate sale of lettuce, dried cranberries and cranberries containing residues of tebufenozide with MRLs of 6 p.p.m., 5 p.p.m. and 1 p.p.m., respectively. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 p.p.m.
