COMMENCEMENT OF INVESTIGATION

Nylon and Polyester-cotton Fabrics

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2001-002) received from Beco Industries Ltd. (the requester) of Ville D'Anjou, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, solely of nylon filament yarn, dyed, plain weave, of a weight not exceeding 70 g/m2, of tariff item No. 5407.42.90, for use in the manufacture of sleeping bags or sleeping bag carrying sacks of the same material; and woven fabrics of polyester staple fibres, containing less than 85 percent by weight of polyester, mixed solely with cotton, printed, plain weave, of a weight not exceeding 100 g/m2, of tariff item No. 5513.41.90, for use in the manufacture of sleeping bags (the subject fabrics).

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified under tariff item Nos. 5407.42.90 and 5513.41.90.

The Tribunal's investigation was commenced on October 25, 2001, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before November 15, 2001. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by February 22, 2002.

Information Processing and Related Telecommunications Services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2001-023) on October 25, 2001, with respect to a complaint filed by Bell Nexxia (the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. V9345-000020/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Human Resources Development. The solicitation was for a number of telecommunications systems and services.

The complainant alleged that, by finding a competitor's proposal responsive, PWGSC had violated a number of provisions under the applicable trade agreements.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

Notice is hereby given that the Canadian International Trade Tribunal, further to a decision of the Federal Court of Appeal, hereby amends as follows its determination on the above-mentioned complaints (File Nos. PR-2000-044R and PR-2000-049R to PR-2000-053R):

Pursuant to subsections 30.15(2) and (3) of the Canadian International Trade Tribunal Act, the Canadian International Trade Tribunal recommends, as a remedy, that the requirements of the Department of Fisheries and Oceans, including those of the Canadian Coast Guard, for rigid hull inflatable boats contained in solicitation Nos. F1701-000169/A, F5575-000232/A, F2599-002425/A and F3036-00C032/A be reissued according to the provisions of the Agreement on Internal Trade.

The Canadian International Trade Tribunal further recommends that the Department of Public Works and Government Services and the Department of Fisheries and Oceans not exercise the options in the contracts issued to Zodiac Hurricane Technologies Inc. as a result of solicitation Nos. F3059-00AP01/A and F1808-000171/A and, instead, issue new solicitations for the rigid hull inflatable boats covered by the said options in accordance with the Agreement on Internal Trade.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2001-031) from C.F. Industrial Products Inc., of Leamington, Ontario, concerning a procurement (Solicitation No. 23232-022002/A) by the Department of Public Works and Government Services on behalf of the Department of Agriculture and Agri-food. The solicitation is for the supply, installation, testing, commissioning and demonstration of two diesel engine generator units, complete with ancillary devices servicing. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that the evaluation process has not been conducted in accordance with the Request for Proposal.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the screening officer at the following address: Hazardous Materials Information Review Commission, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 1M3.
