REGULATORY IMPACT ANALYSIS STATEMENT
Description
This submission responds to issues raised by the Standing Joint Committee for the Scrutiny of Regulations (SJC) concerning the Atlantic Pilotage Tariff Regulations—Newfoundland and Labrador Non-Compulsory Areas and the Great Lakes Pilotage Tariff Regulations, and makes editorial changes to the Laurentian Pilotage Tariff Regulations.
The proposed amendment to the Atlantic Pilotage Tariff Regulations—Newfoundland and Labrador Non-Compulsory Areas replaces subparagraph 1(2)(b)(ii) of the schedule, thereby changing "principal residence" to "place of residence" to address an SJC concern. This amendment does not change the tariff as it reflects how, in fact, the tariff has been applied.
The portion of section 2 of Schedule III to the English version of the Great Lakes Pilotage Tariff Regulations before paragraph (a) is replaced, changing the word "fees" to "charges." The amendment effects only an editorial change requested by the SJC.
The expression "(district)" at the end of the definition "circonscription" in section 1 of the French version of the Laurentian Pilotage Tariff Regulations is replaced by "(District)" and the heading "Pilotages Charges for the Years 2001 and 2002" before section 2 of the English version of the Regulations is replaced by "Pilotage Charges for the Years 2001 and 2002" to make editorial changes.
It is expected that the changes will have little impact on Canadians. The Miscellaneous Amendments Program was developed to streamline the regulatory process as well as to reduce costs.

PROPOSED REGULATORY TEXT
Notice is hereby given, pursuant to subsection 34(1) (see footnote a) of the Pilotage Act, that the Atlantic Pilotage Authority, pursuant to subsection 33(1) of that Act, proposes to make the annexed Regulations Amending the Atlantic Pilotage Tariff Regulations—Newfoundland and Labrador Non-Compulsory Areas (Miscellaneous Program).
In accordance with subsection 34(2) (see footnote b) of the Pilotage Act, when the Atlantic Pilotage Authority proposed to make amendments to the Atlantic Pilotage Tariff Regulations—Newfoundland and Labrador Non-Compulsory Areas, notice was given in the Canada Gazette, Part I, on June 12, 1993, affording interested parties the opportunity to comment on the tariff to the Canadian Transportation Agency and the regulations implementing that tariff were made by Order in Council P.C. 1994-100 of January 20, 1994 (see footnote c).
This amendment does not change that tariff as it reflects how, in fact, the tariff has been applied. It effects only an editorial change requested by the Standing Joint Committee for the Scrutiny of Regulations.
Interested persons may make representations to the Minister of Transport with respect to the proposed Regulations within 30 days after the publication of this notice. REGULATIONS AMENDING THE ATLANTIC PILOTAGE TARIFF REGULATIONS—NEWFOUNDLAND AND LABRADOR NON-COMPULSORY AREAS (MISCELLANEOUS PROGRAM)
AMENDMENT
1. Subparagraph 1(2)(b)(ii) (see footnote 1) of the schedule to the Atlantic Pilotage Tariff Regulations—Newfoundland and Labrador Non-Compulsory Areas (see footnote 2) is replaced by the following:
(ii) ceases when the pilot arrives at the pilot's place of residence or is dispatched to another assignment, whichever occurs first.

2. These Regulations come into force on the day on which they are registered.

In accordance with subsection 34(2) (see footnote e) of the Pilotage Act, when the Great Lakes Pilotage Authority proposed to make an amendment to the Great Lakes Pilotage Tariff Regulations, notice was given in the Canada Gazette, Part I, on April 16, 1994, affording interested parties the opportunity to comment on the tariff to the Canadian Transportation Agency and the regulations implementing that tariff were made by Order in Council P.C. 1994-1213 of July 19, 1994 (see footnote f).
This amendment does not change that tariff as it effects only an editorial change requested by the Standing Joint Committee for the Scrutiny of Regulations.
