FINDING

Cold-rolled Steel Sheet Products

In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting the dumping of certain cold-rolled steel sheet products originating in or exported from Brazil, Chinese Taipei, the former Yugoslav Republic of Macedonia, Italy, Luxembourg, Malaysia, the People's Republic of China, the Republic of Korea and the Republic of South Africa

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-2001-002) to determine whether the dumping in Canada of certain cold-rolled steel sheet products originating in or exported from Brazil, Chinese Taipei, the former Yugoslav Republic of Macedonia, Italy, Luxembourg, Malaysia, the People's Republic of China, the Republic of Korea and the Republic of South Africa has caused injury or retardation or is threatening to cause injury to the domestic industry.

This inquiry is pursuant to the issuance by the Commissioner of the Canada Customs and Revenue Agency of the preliminary determination dated June 11, 2001, and of a final determination dated September, 10, 2001, that the aforementioned goods have been dumped.

Following the Commissioner's final determination, the Canadian International Trade Tribunal determined, by order made on September 11, 2001, pursuant to subsection 42(4.1) of the Special Import Measures Act, that the volume of the dumped goods from each of the former Yugoslav Republic of Macedonia, Italy, Luxembourg and Malaysia was negligible, as the volume of the dumped goods from each of those countries was less than 3 percent and, collectively, less than 7 percent of the total volume of the goods of the same description as the dumped good released into Canada from all countries. Consequently, the Canadian International Trade Tribunal terminated its inquiry with respect to those four countries.

Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping of the aforementioned goods originating in or exported from Brazil, Chinese Taipei, the People's Republic of China, the Republic of Korea and the Republic of South Africa has not caused injury or retardation and is not threatening to cause injury to the domestic industry.

The statement of reasons will be issued within 15 days.

Information Processing and Related Telecommunications Services

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2001-029) from John Chandioux experts-conseils inc., of Montréal, Quebec, concerning a procurement (Solicitation No. EF116-001498/A) by the Department of Public Works and Government Services (PWGSC). The solicitation is for a turnkey automatic translation system for English-French and French-English meteorological bulletins for the Translation Bureau. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into this complaint.

It is alleged that PWGSC has evaluated proposals in a manner inconsistent with the Request for Proposal.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 4296, 4428, 4429, 4445, 4446 and 4447 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 3185

The claimant has been ordered to amend certain aspects of the format of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the generic chemical identity of an additional confidential hazardous ingredient in the controlled product, disclose its concentration in an acceptable manner and disclose that the real chemical identity is included in the claim for exemption;

2. Disclose that skin absorption of an ingredient in the controlled product has been shown to cause adverse central nervous system (CNS) effects in laboratory animals.

Registry Number 3295

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A;

2. Delete the statement which indicates that the ingredient phosphoric acid esters, amine salt is a WHMIS confidential ingredient;

3. Disclose an LC50 (4 hours, rat) value of 16 970 ppm for isopropyl alcohol;

4. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause adverse effects on the kidneys of laboratory animals;

5. Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals in the absence of maternal toxic effects.

Registry Number 4023

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose an oral LD50 and an LD50 (dermal, rabbit) value of 2.38 mL/kg for 2-ethylhexanol;

2. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

3. Disclose that ingestion of an ingredient in the controlled product has been shown to cause adverse effects on the immune system of laboratory animals;

4. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause blood effects in laboratory animals;

5. Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;

6. Disclose the generic chemical identity of an additional confidential hazardous ingredient in the controlled product, disclose its concentration in an acceptable manner and disclose that the real chemical identity is included in the claim for exemption;

7. Correct the impression that cumene, ethylbenzene, xylene and 1,2,4-trimethylbenzene are regulated components of the controlled product.

Registry Number 4067

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an oral LD50 and an LD50 (dermal, rabbit) value of 2.38 mL/kg for 2-ethylhexanol;

2. Disclose oral LD50 values for two of the confidential hazardous ingredients in an acceptable manner;

3. Disclose LD50 values for one of the confidential hazardous ingredients in an acceptable manner;

4. In relation to the period of time shown on the MSDS for flushing the eyes with water should eye contact occur, delete the current reference to "fifteen minutes" and replace it with a time of "from twenty to thirty minutes";

5. Disclose that skin absorption of an ingredient in the controlled product has been shown to cause neurotoxic effects in laboratory animals;

6. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse effects on the immune system of laboratory animals;

7. Disclose that chronic inhalation of an ingredient in the controlled product has been shown to cause blood effects in laboratory animals;

8. Disclose that an ingredient in the controlled product may cause skin sensitization;

9. Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;

10. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B;

11. Disclose the presence of an additional confidential hazardous ingredient in the controlled product;

12. Remove the inference from Section 15 of the MSDS that 2-ethyl-1-hexanol is not a WHMIS hazardous ingredient.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Number 4158

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the presence of three additional confidential hazardous ingredients in the controlled product;

2. Disclose the generic chemical identity for two additional confidential hazardous ingredients, together with either their actual concentrations or acceptable range values;

3. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

4. Disclose the Exposure Limit Values ACGIH TLV-TWA = 200 ppm (skin) and ACGIH TLV-STEL = 250 ppm (skin) for methyl alcohol;

5. Disclose an Exposure Limit Value AIHA WEEL-TWA = 1 mg/m3 for 1,6-hexanediol diacrylate;

6. Disclose an LD50 (dermal, rabbit) value of 3 600 mg/kg for 1,6-hexanediol diacrylate;

7. Disclose an LD50 (dermal, rabbit) value of 15 800 mg/kg and a lower bound to the LC50 (8 hours, rat) value of 32 000 ppm for methyl alcohol;

8. Disclose that acute dermal exposure to an ingredient in the controlled product has been shown to cause adverse CNS effects, visual disturbances and gastrointestinal tract disturbances;

9. Disclose that chronic ingestion of ingredients in the controlled product has been shown to cause CNS effects;

10. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause adverse effects on the eyes;

11. Disclose that an ingredient in the controlled product has shown positive test results in in vivo screening tests for mutagenicity, and disclose that another ingredient in the controlled product has shown positive test results in in vitro screening tests for mutagenicity;

12. Disclose that an ingredient in the controlled product has been shown to cause fetotoxicity and teratogenicity in laboratory animals and has been shown to cause behavioural abnormalities in offspring of laboratory animals;

13. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in classes D2A and D1B.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. COMPLETION OF PANEL REVIEW

Corrosion-resistant Carbon Steel Flat Products

Notice is hereby given, pursuant to subrule 78(b) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the Final Results of the Antidumping Duty Administrative Review made by the United States Department of Commerce, International Trade Administration, respecting certain corrosion-resistant carbon steel flat products from Canada is completed (Secretariat File No. USA-CDA-98-1904-01).

On August 24, 2001, the binational panel issued an order affirming the investigating authority's determination on remand, respecting certain corrosion-resistant carbon steel flat products from Canada.

No Request for an Extraordinary Challenge Committee has been filed with the responsible Secretary. Therefore, pursuant to subrule 78(b) of the NAFTA Article 1904 Panel Rules, this Notice of Completion of Panel Review is effective on October 5, 2001, the 31st day following the date on which the responsible Secretary issued the Notice of Final Panel Action.

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
