CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03283 is approved.

1. Permittee: Crescent Beach Marina Co. (1967) Ltd., Surrey, British Columbia.

2. Type of Permit: To load waste and other matter for the purpose of disposal at sea and to dispose of waste and other matter at sea.

3. Term of Permit: Permit is valid from January 15, 2002, to January 14, 2003.

4. Loading Site(s): Crescent Beach Marina, Surrey, British Columbia, at approximately 49°03.40' N, 122°52.10' W.

5. Disposal Site(s): (a) Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m; and (b) Sand Heads Disposal Site: 49°06.00' N, 123°19.50' W, at a depth of not less than 70 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must inform the appropriate Marine Communications and Traffic Services Centre (MCTS) upon departure from the loading site and inform MCTS that it is heading for a disposal site;
(ii) Upon arrival at a disposal site and prior to disposal, the vessel must again call MCTS to confirm its position. Disposal can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, MCTS will advise the bearing and distance to the site and advise when disposal can proceed; and
(iii) The vessel must inform the MCTS when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Loading by clamshell dredge and disposal by bottom dump scow or by end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 20 000 m3.

10. Waste and Other Matter to Be Disposed of: Dredged material consisting of silt, sand, rock, and other approved material typical to the approved loading site.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit issuing office before commencement of the project as to the dates on which the loading or ocean disposal will occur.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be displayed at the loading site, and must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre, regarding the issuance of a "Notice to Shipping." 11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Branch, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

2. Type of Permit: To load and dispose of dredged material.

3. Term of Permit: Permit is valid from October 29, 2001, to May 31, 2002.

4. Loading Site(s): Miscou Harbour: 47°52.96' N, 64°30.98' W (NAD83), as described in Figures A-1 and A-2 in Appendix A of the Environmental Screening Report, August 10, 2001, submitted in support of the permit application.

5. Disposal Site(s): Miscou Harbour: 47°53.10' N, 64°30.80' W (NAD83), as described in Figures A-1 and A-2 in Appendix A of the Environmental Screening Report, August 10, 2001, submitted in support of the permit application.

6. Route to Disposal Site(s): Most direct navigational route from the disposal site to the dredging site.

7. Equipment: Suction dredge.

8. Method of Disposal: Via pipeline.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 23 000 m3 place measure.

11. Waste and Other Matter to Be Disposed of: Dredged material consisting of sand and silt.

12. Requirements and Restrictions:

12.1. It is required that the Permittee notify in writing, by facsimile or electronic mail, Mr. Clark Wiseman, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, (902) 426-3897 (Facsimile), clark. wiseman@ec.gc.ca (Electronic mail) and Ms. Rachel Gautreau, Environmental Conservation Branch, Canadian Wildlife Service, Department of the Environment, Atlantic Region, (506) 364-5062 (Facsimile), rachel.gautreau@ec.gc.ca (Electronic mail), at least 48 hours prior to each occasion that dredging equipment is mobilized to the loading site. The notification shall include the equipment to be used, contractor, contact for the contractor, and expected period of dredging.

12.2. A written report shall be submitted to Mr. Victor Li, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, (902) 490-0705 (Facsimile), within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of material disposed of and the dates on which the loading and disposal activities occurred.

12.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations. Proof of payment of the remaining balance of $5,405 of the fee shall be submitted to Mr. Victor Li, identified in paragraph 12.2., prior to April 22, 2002.

12.4. Procedures to accurately measure or estimate quantities of dredged material disposed of at each disposal site shall be submitted to Mr. Victor Li, identified in paragraph 12.2. The procedures shall be approved by the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit.

12.5. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.6. The Permittee shall notify in writing Mr. Marc Godin, Area Habitat Coordinator, Department of Fisheries and Oceans, P.O. Box 3420, Station Main, Tracadie-Sheila, New Brunswick E1X 1G5, (506) 395-3809 (Facsimile), at least 48 hours prior to the commencement of each loading operation to be conducted under this permit.

12.7. The Permittee shall implement the mitigative measures identified in Part D of the "Environmental Screening Report, Miscou-Pigeon Hill Harbour Channel Dredging (August 10, 2001)" submitted in support of the permit application. Modifications to the mitigative measures shall be made only with the written approval of the Environmental Protection Branch, Department of the Environment.

12.8. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.9. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by any person with written approval from the Permittee.

12.10. Within 24 hours of authorizing approval to another person to conduct the dredging and disposal authorized by this permit, the Permittee shall submit by facsimile to Mr. Victor Li, identified in paragraph 12.2., a copy of the written approval.

12.11. Dredging and disposal will be permitted during daylight hours.

2001 Call for Bids: Central Mackenzie Valley

The Minister of Indian Affairs and Northern Development hereby gives notice, pursuant to section 15 of the Canada Petroleum Resources Act (CPRA), R.S., 1985, c. 36, 2nd Supplement, of the bids that have been selected in response to the 2001 Call for the Central Mackenzie Valley. A summary of terms and conditions applicable to the call was published in the Canada Gazette, Part 1, on May 5, 2001. The call closed on September 17, 2001. Winning bidders, having submitted work deposits representing 25 percent of their work proposal bid, will receive an exploration licence. A summary of the terms and conditions of the six exploration licences being issued is also set out herein.

The following is a summary of the terms and conditions of the five exploration licences issued to the winning bidders as indicated above:

1. The exploration licences confer, relative to the lands: the right to explore for and the exclusive right to drill and test for petroleum; the exclusive right to develop those frontier lands in order to produce petroleum; and the exclusive rights, subject to compliance with the other provisions of the Act, to obtain a production licence.

2. The term of the exploration licences will be eight years consisting of two consecutive periods of four years each.

3. Each interest owner shall drill one well prior to the end of Period I. That is, within the first four years of the term, as a condition precedent to obtaining tenure to Period II, which comprises years five, six, seven, and eight. Failure to drill a well shall result in the reversion to Crown reserve, at the end of Period I, of the lands not subject to a significant discovery licence or a production licence.

4. The interest holders submitted their issuance fees and posted work deposits equivalent to 25 percent of the bid submitted for each parcel. A reduction of the deposit will be made as allowable expenditures, as defined in the Call for Bids, are incurred on the lands in Period I of the term.

5. Rentals will be applicable only in Period II at a rate of $3.00 per hectare in respect of the first year, $5.50 in the second year and $8.00 in the third and fourth year. A reduction of rentals will be made as allowable expenditures, as defined in the Call for Bids, are incurred during Period II of the term.

6. Other terms and conditions referred to in the licences include provisions respecting Indemnity, Liability, Successors and Assigns, Notice, Waiver and Relief, Appointment of Representative and Agreement by interest owner.

7. Notice No. DGRB-007-01 — Call for Proposals to License Expeditiously a Ka Band Space Station at the 107.3° West Longitude Orbital Position

This Canada Gazette notice announces the release of a paper, under the above title, that invites interested parties to make proposals to Industry Canada with respect to developing and operating a fixed-satellite Ka band space station in the 107.3° W longitude orbital position.

Although the 107.3° W longitude orbital position was previously licensed to Star Choice, the licence has been returned to the Department. The Department continues to believe that the Ka satellite position at 107.3° W longitude orbital position is a valuable resource for Canada. Consequently, Industry Canada is initiating through this Call for Proposals a process to license expeditiously a Ka band fixed-satellite space station in the 107.3° W longitude orbital position. However, as Canadian access to this orbital resource is time limited by the first-come, first-served nature of the International Telecommunication Union (ITU) satellite filing process, any satellite authorized by means of this licensing process must be deployed in a timely manner.

If more than one acceptable application is received by means of this Call for Proposals to serve Canada and warrants authorizing a second Ka band orbital position, the Department may also recommend to the Minister that the Ka band orbital position at 118.7° W longitude orbital position be assigned as well.

To satisfy the Department's objective that the licensing process be transparent, fair and timely for interested parties wishing to access this orbital position, a Call for Proposals is initiated with this notice. A 30-day period is provided for applicants to submit their proposals. Qualifications for participating in this licensing process are set out in the Call for Proposals.

To be eligible for consideration, interested parties must submit their proposals to Industry Canada in accordance with the instruction in the referenced paper no later than October 30, 2001. All proposals received will be posted on the Industry Canada spectrum Web site within a few days of their receipt.

Notice is hereby given that radio apparatus listed below was forfeited on September 19, 2001, under subsections 13(1) and 13(2) of the Radiocommunication Act by order of the Associated Regional Director, Quebec Region, Industry Canada, pursuant to his authority as delegated by the Minister of Industry on January 6, 2000. The radio apparatus was related to prosecution of 9058-3675 Québec Inc. of Saint-Bruno-de-Guigues, Quebec, (hereinafter referred to as "the accused") for a breach of subsection 4(1) and paragraph 10(1)(a) of the Radiocommunication Act. The accused was found guilty of the offence in the Quebec Court on August 15, 2001.

Yaesu transceiver, model: FT-2600M/serial number: 01230134 and the owner's manual.

Any person having a claim as rightful owner, mortgagee, lien holder or holder of any like interest, on the forfeited item may, within 30 days of the date of this issue of the Canada Gazette, contest the forfeiture order by complying with the provisions of subsection 13(3) of the Act.

Fraser River Port Authority — Supplementary Letters Patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport for the Fraser River Port Authority (the "Authority") under the authority of the Canada Marine Act, effective May 1, 1999;

WHEREAS, prior to the issuance of the Letters Patent, the Authority, at the time the Fraser River Harbour Commission and the City of Surrey (the "City") agreed to a certain exchange of lands by way of acquisition of approximately 1,310 m2 of the remaining portion of Pine Road from the City by the Authority and the disposition of approximately 4 m2 of Lot 3, Plan LMP 23985 by the Authority to the City;

AND WHEREAS the Board of Directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to reflect this exchange of lands;

NOW THEREFORE under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended as follows:

1. Paragraph 2 of Schedule B to the Letters Patent is amended by deleting the following:

"save and except therefrom the federal real property listed above under the administration of a member of The Queen's Privy Council for Canada other than the Minister of Transport or any successor thereto, if that member has not given consent to the Minister in accordance with paragraph 44(2)(b) of the Act."

2. Schedule B to the Letters Patent is amended by adding the following at the end of the table in paragraph 2:

In addition to the above lands:

(a) ALL AND SINGULAR that certain part, parcel or tract of land and premises, situate lying and being a portion of Pine Road in District Lot 8, Group 2, dedicated on Plan 546, New Westminster District, which said portion may be more particularly described as follows:

commencing at the Westernmost Corner of Lot 3 of District Lots 7 and 8, Group 2, New Westminster District, Plan LMP 23985:

thence, a bearing of 128°42'00", in a southeasterly direction and along the boundary of said Lot 3, and the production of said boundary for a distance of 130.835 metres, more or less, to a point on the boundary of said Lot 3;

thence, a bearing of 218°41'25", for a distance of 10.010 metres, more or less, to a point on the boundary of part of Lot 2, District Lot 8, Group 2, Plan LMP 23985;

thence, a bearing of 308°42'38", and along the boundary of said Lot 2, for a distance of 130.837 metres, more or less, to the Northernmost Corner of said Lot 2;

thence, a bearing of 38°42'15", and along the boundary of Timberland Road, for a distance of 9.986 metres, more or less, to the point of commencement, and containing by admeasurement 0.131 Hectares;

SAVE AND EXCEPT FROM THE LANDS DESCRIBED IN PARAGRAPH 2:

(a) ALL AND SINGULAR that certain part, parcel or tract of land and premises, situate, lying and being a portion of Lot 3, District Lots 7 and 8, Group 2, New Westminster District, Plan LMP 23985, which said portion may be more particularly described as follows:

commencing at the Northernmost Corner of said Lot 3;

thence, a bearing of 128°41'52", and along the boundary between said Lot 3 and Tannery Road, in a southeasterly direction, for a distance of 3.00 metres;

thence, a bearing of 263°41'51", for a distance of 4.243 metres, more or less, to a point on the boundary between said Lot 3 and Timberland Road;

thence, a bearing of 38°42'15", and along the boundary of said Lot 3, for a distance of 3.00 metres, more or less, to the point of commencement, and containing by admeasurement 4 Square Metres;

(b) the federal real property listed above under the administration of a member of The Queen's Privy Council for Canada other than the Minister of Transport or any successor thereto, if that member has not given consent to the Minister in accordance with paragraph 44(2)(b) of the Act.

These Supplementary Letters Patent are to be effective on the later of:

(i) the date of registration in the New Westminster Land Title Office of the transfer documents evidencing the transfer of the federal real property from Her Majesty the Queen in right of Canada to the City of Surrey; and
(ii) the date of registration in the New Westminster Land Title Office of the transfer documents evidencing the transfer of the real property from the City of Surrey to Her Majesty the Queen in right of Canada.

If both transfers identified in (i) and (ii) above are registered on the same date, these Supplementary Letters Patent are to be effective on the date of registration.

WHEREAS Letters Patent were issued by the Minister of Transport for the Hamilton Port Authority (the "Authority") under the authority of the Canada Marine Act effective May 1, 2001;

WHEREAS in support of port operations the Authority wishes to acquire from Case Canada Corporation the real property described below;

WHEREAS Schedule C of the Letters Patent describes the real property, other than federal real property, held or occupied by the Authority;

AND WHEREAS the board of directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to add to Schedule C of the Letters Patent the real property described below;
