The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2001-026) from McNally Construction Inc. (the complainant), of Hamilton, Ontario, concerning a procurement (Solicitation No. F7047-000054/C) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation is for the construction, testing and delivery of a jet-propelled boat. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
It is alleged that PWGSC has improperly evaluated the complainant's proposal as being non-compliant.

PUBLIC HEARING
Petro-Canada Medicine Hat Pipeline
The National Energy Board (the Board) has scheduled an oral public hearing with respect to an application filed by Petro-Canada (the Applicant) under the National Energy Board Act to construct and operate the proposed Medicine Hat Pipeline and for orders related to toll and tariff matters. The hearing will include the consideration of matters to be examined in accordance with the Canadian Environmental Assessment Act. Copies of the application are available for viewing at the Applicant's office (150 Sixth Avenue SW, Calgary), the Board's library and in the Reference Department of the Medicine Hat Public Library, 414 First Street, Medicine Hat, Alberta.
The proposed Medicine Hat Pipeline comprises approximately 67 kilometres (42 miles) of mostly 273.1-mm (10-inch) diameter new natural gas transmission pipeline and associated control facilities, with a design capacity of approximately 1.5 million cubic metres (53 million cubic feet) per day. The proposed pipeline route begins near the southeastern side of the Suffield Military Block in Alberta and extends northeast to join TransCanada PipeLines Limited's system near Burstall, Saskatchewan. The pipeline route follows existing corridors for most of its length with approximately 13 kilometres of new right-of-way being required. The Medicine Hat Pipeline is proposed to be in service in May 2002 with an estimated capital cost of $9.9 million.
The hearing is scheduled to commence at 9 a.m. (mountain daylight time — MDT), Monday, November 19, 2001, at a location to be announced at a future date. The hearing will be public and will be held to obtain the evidence and views of interested persons on the application. Any person interested in participating in the hearing should consult the Board's detailed Directions on Procedure GH-3-2001 for further background and instructions.
Any person wishing to intervene in the hearing must file a written intervention by 5 p.m. MDT, September 24, 2001, with the Secretary of the Board and serve copies on Petro-Canada and its counsel at the following addresses: Mr. John D.
