CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03276 is approved.

1. Permittee: Rivtow Marine Inc., Delta, British Columbia.

2. Type of Permit: To load or dispose of dredged material.

3. Term of Permit: Permit is valid from August 21, 2001, to August 20, 2002.

4. Loading Site(s): Rivtow Marine Inc., Delta, British Columbia, at approximately 49°10.25' N, 122°55.39' W.

5. Disposal Site(s): (a) Point Grey Disposal Site, 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m; and (b) Sandheads Disposal Site, 49°06.00' N, 123°19.50' W, at a depth of not less than 70 m.

The following position fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must call the Marine Communications and Traffic Services (MCTS) Centre on departure from the loading site and inform MCTS that it is heading for a disposal site;
(ii) Upon arrival at the disposal site, and prior to disposal, the vessel must again call MCTS to confirm its position. Disposal can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, MCTS will direct it to the site and advise that disposal can proceed; and
(iii) The vessel will inform MCTS when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s) : Direct.

7. Method of Loading and Disposal: Loading by clamshell dredge and disposal by bottom dump scow or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 10 000 m3.

10. Material to Be Disposed of: Dredge material consisting of silt, sand, rock, and other approved material typical of the approved loading site except logs and usable wood.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit issuing office before commencement of the project as to the dates on which the loading or dumping will occur.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities. A copy of the written approval for the appropriate loading site must be displayed with each copies of the permit posted at the loading sites.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre (RMIC) regarding the issuance of a "Notice of Shipping." The RMIC is located at 2380- 555 West Hastings Street, Vancouver, British Columbia V6B 5G3, (604) 666-6012 (Telephone), (604) 666-8453 (Facsimile), RMIC-PACIFIC@PAC.DFO-MPO.GC.CA (Electronic mail).

11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Branch, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

6. Route to Disposal Site(s): Via pipeline or by scows that will depart from the harbour using the marked channel and then turn eastward or westward to the disposal site.

7. Equipment: Suction dredge, pipeline or bottom dump scows.

8. Method of Disposal: Suction dredge and pipeline or by bottom dump scow as the scow moves linearly along the disposal site alignment.

OCEANS ACT

Amendment to the Definition "Container Ship" Provided in the Fee Schedule: Fees to Be Paid for Marine Navigation Services Provided by the Canadian Coast Guard

Amendment

1. The definition "container ship" in section 1 of the fee schedule is replaced by the following:

"container ship" means a ship that is:

i. exclusively designed and used in the carriage of containers; or

ii. used in the carriage of containers in holds and/or on deck with stern, bow, or side ramps for the loading/unloading of Roll-on/Roll-off (RoRo) cargo. (porte-conteneurs).

Coming into Force

2. This amendment comes into force on July 6, 2001.

Explanatory Note

The purpose of this amendment is to:

(a) bring the present fee schedule in line with the Coast Guard's original intent and policy in relation to the application of the Marine Navigation Services Fee to certain ships; and

(b) ensure a fair application of the Marine Navigation Services Fee.

CANADA-NEWFOUNDLAND ATLANTIC ACCORD IMPLEMENTATION ACT

Canada-Newfoundland Offshore Petroleum Board — Call for Bids No. NF01-1

The Canada-Newfoundland Offshore Petroleum Board (the Board) hereby gives notice of a call for the submission of bids in respect of 14 parcels in the Newfoundland offshore area.

This notice of the Call for Bids No. NF01-1 is made pursuant and subject to the Canada-Newfoundland Atlantic Accord Implementation Act, S.C., 1987, c. 3, and the Canada-Newfoundland Atlantic Accord Implementation Newfoundland Act, R.S.N. 1990, c. C-2.

The following is a summary of the Call for Bids No. NF01-1:

(i) Sealed bids will be received by the Board prior to the time of closing of this call for bids. This call for bids will close at 4 p.m., Newfoundland Standard Time, on November 20, 2001;
(ii) All bids must be submitted in accordance with the terms and conditions of the Call for Bids No. NF01-1;
(iii) The 14 parcels are located offshore of Newfoundland and are described in Schedule I. Exploration Licences may be issued for each parcel;
(iv) For the purpose of selecting a bid, the sole criterion to be used will be the total amount of money the bidder commits to expend on exploration on the respective parcel within Period I ("Work Expenditure Bid");
(v) A minimum bid of $250,000 will be required for each parcel in the area adjacent to the west coast of the province and a minimum bid of $1 million for each parcel in all other portions of the offshore area;
(vi) For each parcel, the Work Expenditure Bid must be accompanied by a bank draft or certified cheque in the amount of $10,000 ("Bid Deposit") made payable to the Receiver General for Canada. Furthermore, the successful bidder will be required to provide, within 15 days of notification of being the successful bidder, a promissory note in the amount of 25 percent of the Work Expenditure Bid ("Security Deposit"). A credit against the Security Deposit will be made following each anniversary date of the Exploration License on the basis of 25 percent of allowable expenditures, as described in Schedule III of the Exploration Licence ("Allowable Expenditures");
(vii) Each successful bidder will receive a refund, without interest, of the Bid Deposit when the Security Deposit is posted within 15 days. Failure to post the Security Deposit within 15 days will result in forfeiture of the Bid Deposit and disqualification of the bid.

Upon the announcement of the bid results, the Bid Deposits of unsuccessful bidders will be returned, without interest, as soon as possible;

(viii) For each parcel, an Exploration Licence will be issued for a term of nine years consisting of two consecutive periods of five years (Period I) and four years (Period II);
(ix) For each parcel, the licence requirement will be one well to be commenced within Period I and diligently pursued thereafter.

The interest owner shall commence the drilling of the well within Period I, and diligently pursue such drilling thereafter, as a condition precedent to obtaining tenure during Period II.

(x) For each parcel, rentals will be applicable only in Period II at the following rates:

When an Exploration Licence continues in force beyond Period II, rentals will be payable at the rates applicable during the last year of Period II.

Rentals will be payable annually, in advance, and are to be submitted by cheque payable to the Receiver General for Canada, except for rentals applicable to an Exploration Licence continuing beyond Period II, which will be payable monthly, in advance, at the rate of 1/12 of the applicable annual rates.

Rentals will be refunded annually, to a maximum of 100 percent of the rentals paid in that year, on the basis of a dollar refund for each dollar of Allowable Expenditures for that year.

Carry forward provisions to reduce rentals otherwise payable in ensuing rental years will apply.

Rentals will apply to lands subject to a declaration of significant discovery during the term of the Exploration Licence at the rates and levels of refundability specified above;

(xi) An Allowable Expenditure schedule will have application throughout Period I of the Exploration Licence. The rates of Allowable Expenditures will be reviewed, and may be amended, at the expiration of Period I;
(xii) A successful bidder will be required to comply with the Canada-Newfoundland Benefits procurement, employment and reporting procedures as established by the Board;
(xiii) The parcels will be subject to the payment of issuance fees and Environmental Studies Research Fund levies;
(xiv) The Board is not obliged to accept any bid or issue an interest as a result of this call for bids;
(xv) Any licence that may be issued shall be in the form of the Exploration Licence attached to the Call for Bids NF01-1; and
