REGULATORY IMPACT ANALYSIS STATEMENT
Description
The Government of Quebec has requested these amendments to the Quebec Fishery Regulations (1990) which are made pursuant to the federal Fisheries Act. Quebec manages the province's freshwater fisheries by agreement with the federal government. Amendments to the Regulations, however, must be processed by the Department of Fisheries and Oceans (DFO) and approved by the Governor in Council since they are made under federal legislation.
The first two amendments mentioned below will contribute to the conservation and sustainability of the province's fishery resources while the third will improve administrative processes for recreational fishing in Quebec.
1. Size limit for brook trout in the Nouvelle River
Declining populations of Atlantic salmon in the Nouvelle River have necessitated restricting the fishery to small non-spawning salmon known as grilse. This restriction, intended to assist the recovery of the Atlantic salmon population, has caused some fishers on this river to focus their fishing efforts on sea trout, a large anadromous brook trout species. Because the current quota for all brook trout species in this river is 15 per day, the anadromous variety are in danger of being overfished.
To shift fishing pressure from the large anadromous brook trout, present only during part of the fishing season, to the more plentiful freshwater brook trout, present all season, an amendment is proposed to establish a quota and size limit for large and small brook trout in the Nouvelle River. This will maintain an attractive trout fishery in this river while preventing over-fishing of the larger less abundant anadromous brook trout.
2. Prohibiting the Use of Tench as Bait
Tench (Tinca tinca) is a non-native species of fish that is now widespread in Quebec due to its unrestricted use as bait. In an attempt to limit the proliferation of this undesirable species which competes too successfully with native fish species, an amendment to the Regulations is proposed which will add Tench to the schedule of fish species not permitted for use as bait.
3. Electronic Sport Fishing Licences
Recently, the province of Quebec implemented an electronic system for issuing sport fishing licences. The new system does not allow for conditions to be printed on the licence as was done with the manual licence issuing system. Therefore, the proposed amendment will add provisions to the Regulations specifying conditions that were previously printed on the anadromous Atlantic salmon sport fishing licence (salmon licence) and on the sport fishing licence for other species (non-salmon licence).
The salmon licence condition being added to the Regulations is an exception which permits licence holders to fish in salmon rivers for non-salmon species. Usually, the salmon licence is only valid for salmon fishing in these waters. The added condition eliminates the need for anglers to have two different licences to fish in the same rivers during the same period.
The non-salmon licence condition being added is also an exception which, in this case, allows licence holders to fish for non-salmon species in two salmon rivers: the part of the aux Rochers River flowing through Port-Cartier and a section of the Jacques-Cartier River that flows through Quebec City. Normally, the non-salmon licence is not valid in salmon rivers during salmon season. This added condition provides anglers with the opportunity to fish for a non-exploited brook trout population present in these waters without needing to have a salmon licence.
In addition to the amendments referred to above, certain administrative amendments are needed to update and correct errors in the Regulations. These include:
1. Amending the descriptions of the mouths of the Mars, Éternité and Saint-Jean Rivers to make better use of landmarks such as the new, easily identifiable metal markers;
2. Correcting the wording relating to the type of authorized fishing gear in four sectors of the Laval River;
3. Revising the list of common and scientific fish species to account for changes to the names of certain species and making related adjustments to other schedules that contain the names of those species; and
4. Making several amendments brought to DFO's attention by the Standing Joint Committee for the Scrutiny of Regulations to correct discrepancies between the French and English versions of the Regulations for latitude and longitude references of a number of lakes.
Alternatives
The substantive amendments in this initiative are the only means of balancing the management and conservation of provincial fisheries while allowing the continued use of those fisheries. No alternative to regulation exists that would provide this balance.
The licence condition amendments must be made in order for these conditions to apply to the new electronically issued licences.
There is no alternative to the administrative amendments.
Benefits and Costs
The proposed amendments, in particular, the size limits on brook trout and the prohibition of using tench as bait, will further improve conservation of fish stocks while maintaining the sustainable use of the resource. Electronically issued licences will benefit anglers by providing a more convenient way to obtain licences.
These amendments apply solely to sport fishing and have no impact on fishing by Aboriginal people for food, social, ceremonial or commercial purposes.
The proposed changes will have no financial affect on anglers or the operations of tackle shops and other businesses related to the tourism or recreational fishing industry.
There will be no additional cost incurred by the federal or provincial government nor by anglers.
Consultation
These proposed amendments have been requested by area fisheries managers and local angling associations in the areas of the province where the affected waters are situated. The amendment requests were submitted to the regional offices of the Société de la faune et des parcs du Québec, the agency responsible for fisheries management in that province.
Meetings were organized among regional fisheries managers, angling associations, anglers and other interested parties in the various provincial fishery regions to identify areas for improvement, to share views and to develop workable solutions. Solutions requiring regulatory amendments were then forwarded from regional authorities to the Société's Fisheries Regulatory Committee.
This Committee is comprised of representatives from the Wildlife Management and Development, Wildlife Protection, Wildlife Territories, Native Affairs and Regulations branches of the Société. The Committee in consultation with the regional managers analysed all proposals for regulatory change, assessing their impact on fishery resources and users and the ability to enforce compliance with the regulatory changes.
The following are some of the groups that participated in the consultations relating to these draft Regulations:
— the Société de restauration et de gestion de la rivière Nouvelle;
— the Regroupement pour la restauration des Trois Rivières Pabos inc.;
— the Corporation de gestion de la rivière à saumon des Escoumins;
— the Association sportive Onatchiway-Est;
— the Municipality of Port-Cartier;
— the Association sportive Batiscan-Neilson.
Information on the proposed amendments was also published in the 2000 Sport Fishing brochures produced by the Société and comments were invited.
Feedback received during this consultation process indicated that stakeholders and the public agree with the proposed amendments as the best way to ensure appropriate fishery conservation and management while maintaining a sustainable sport fishery.
Prepublication of the amendments will provide another opportunity for public comment.
Compliance and Enforcement
Once amendments are approved, the public along with tourist and angling associations will be informed of the regulatory changes by the press releases and advertisements in local media. The Société de la faune et des parcs du Québec also produces two annual brochures entitled Sport Fishing in Quebec — Main Regulations and Salmon Sportfishing in Quebec — Main Regulations which contain complete text of the Regulations. All new regulations are clearly set out in these brochures and are freely distributed throughout the province. Information about the Regulations is also available on the Société's Internet site, which is updated regularly.
In addition to regular patrols of popular fishing areas, enforcement personnel give information about the Regulations, issue warnings of potential violations and lay charges for regulatory contraventions. Also, the Fisheries Act prescribes penalties, upon conviction, for contraventions of the Regulations which include jail terms up to 24 months and/or fines up to $500,000. In addition, the courts may order the seizure of fishing gear, catches, vehicles or other equipment used in the commission of an offence. The courts may also impose licence suspensions and cancellations.
These amendments to the Regulations do not impose new enforcement costs.

REGULATIONS AMENDING THE QUEBEC FISHERY REGULATIONS (1990)
AMENDMENTS
1. Paragraph (a) of the definition "hoop net" in subsection 2(1) of the Quebec Fishery Regulations, 1990 (see footnote 1) is replaced by the following:
(a) consists of a series of interconnected conical pockets narrowing at equal distances to a point,
2. The Regulations are amended by adding the following before section 7:
6. No person other than an Indian as defined in the Indian Act shall fish in any part of the Betsiamites River set out in item 2 of Part IV of Schedule XVIII.
3. Subsection 13(3) (see footnote 2) of the English version of the Regulations is replaced by the following:
(3) An anadromous Atlantic salmon that is caught and retained in a wildlife reserve, in the Gouffre River or in the Ouelle River shall be tagged, by the person who hooked it, with a valid tag issued with that person's licence.

32. Schedule XXVII to the Regulations is amended by replacing the reference "(Sections 5 and 19)" (see footnote 34) after the heading "SCHEDULE XXVII" with the reference "(Sections 2, 3, 5, 11, 19, 21 to 25.1, 29, 30, 42 and 45 to 50)".
33. (1) Schedule XXVIII to the French version of the Regulations is amended by
(a) adding the word "Chevaliers" in alphabetical order; and
(b) deleting the word "Suceurs".
(2) Schedule XXVIII to the Regulations is amended by adding the word "Tench" in alphabetical order.
