Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2000-063) on June 27, 2001, with respect to a complaint filed by FM One Alliance Corp. (the complainant), of Hamilton, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning the cancellation by Canada Post Corporation of Request for Proposal No. 6 NS 00 RS R1, the proposed renewal of Property Management Agreement No. 586600 dated September 1, 1994, as amended, with Brookfield Lepage Johnson Controls Facility Management Services and the proposed renewal of Property Management Agreement No. 586599 dated September 1, 1994, as amended, with ProFac Facilities Management Services Inc. The solicitation was for the provision of facility management services.

The complainant alleged that Canada Post Corporation was conducting a procurement in contravention of the North American Free Trade Agreement.

Having examined the evidence presented by the parties and considered the provisions of the North American Free Trade Agreement, the Tribunal determined that the complaint was valid.

FINDING

Corrosion-resistant Steel Sheet

In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting the dumping of certain corrosion-resistant steel sheet originating in or exported from the People's Republic of China, India, Malaysia, the Russian Federation, South Africa and Chinese Taipei, and the subsidizing of certain corrosion-resistant steel sheet originating in or exported from India

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-2000-008) to determine whether the dumping of certain corrosion-resistant steel sheet originating in or exported from the People's Republic of China, India, Malaysia, the Russian Federation, South Africa and Chinese Taipei, and the subsidizing of certain corrosion-resistant steel sheet originating in or exported from India have caused material injury or retardation or are threatening to cause material injury to the domestic industry.

This inquiry is further to the issuance by the Commissioner of the Canada Customs and Revenue Agency of a preliminary determination dated March 5, 2001, and of a final determination dated June 4, 2001, that the aforementioned goods had been dumped and subsidized.

Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping and subsidizing of the aforementioned goods have not caused material injury or retardation and are not threatening to cause material injury to the domestic industry.

The statement of reasons will be issued within 15 days.

In the matter of an expiry review, under subsection 76.03(3) of the Special Import Measures Act, of the order made by the Canadian International Trade Tribunal on July 5, 1996, in Review No. RR-95-001, concerning certain oil and gas well casing made of carbon steel originating in or exported from the Republic of Korea and the United States

The Canadian International Trade Tribunal, under the provisions of subsection 76.03(3) of the Special Import Measures Act, has conducted an expiry review (Expiry Review No. RR-2000-001) of its order made on July 5, 1996, in Review No. RR-95-001, continuing, without amendment, its order made on June 10, 1991, in Review No. RR-90-005, continuing, with amendment, the review finding made by the Canadian Import Tribunal on November 6, 1986, in Review No. R-7-86, continuing, with amendment, the finding made by the Canadian Import Tribunal on April 17, 1986, in Inquiry No. CIT-15-85, concerning oil and gas well casing made of carbon steel, having an outside diameter ranging from 114.3 mm to 273.0 mm (4( in. to 103/4 in.) inclusive, seamless or welded, plain end or threaded and coupled, supplied to meet American Petroleum Institute specification 5A, grades H40, J55 and K55, or proprietary grades manufactured as substitutes for these specifications, excluding casing which has been manufactured in Canada and re-imported into Canada from the United States by the Canadian manufacturer either in the condition as exported from Canada or after having been threaded and/or coupled in the United States, originating in or exported from the Republic of Korea and the United States.

Pursuant to subsection 76.03(12) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby rescinds its order made on July 5, 1996, in Review No. RR-95-001, in respect of the above-mentioned goods originating in or exported from the Republic of Korea.

Pursuant to subsection 76.04(3) of the Special Import Measures Act, the Canadian International Trade Tribunal also hereby rescinds its order made on July 5, 1996, in Review No. RR-95-001, in respect of the above-mentioned goods originating in or exported from the United States.

Ownership Transfers — Application of a Condition Precedent Where Approval is Predicated on the Divestiture of Another Business Asset or Interest

The Commission announces that, in the future, it intends to make its approvals of applications involving the transfer of control of broadcasting undertakings subject to conditions precedent when the approval is predicated on the divestiture by the purchaser of another undertaking or of another business asset or interest. This approach should help maintain a healthy and dynamic competitive environment, and to ensure that applications of this type receive equitable treatment in a reasonably timely manner.
