CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03272 is approved.

1. Permittee: S&R Sawmills Ltd., Surrey, British Columbia.

2. Type of Permit: To load or dispose of dredged material.

3. Term of Permit: Permit is valid from August 14, 2001, to August 13, 2002.

4. Loading Site(s): S&R Sawmills, Surrey, British Columbia, at approximately 49°11.00' N, 122°42.00' W.

5. Disposal Site(s): Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must call the Marine Communications and Traffic Services (MCTS) Centre on departure from the loading site and inform MCTS that it is heading for a disposal site;
(ii) Upon arrival at the disposal site, and prior to disposal, the vessel must again call MCTS to confirm its position. Disposal can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, MCTS will direct it to the site and advise that disposal can proceed; and
(iii) The vessel will inform MCTS when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Clamshell dredging and disposal by bottom dump scow or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 50 000 m3.

10. Material to Be Disposed of: Dredged material consisting of silt, sand, rock, wood wastes and other approved material typical of the approved loading site except logs and usable wood.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit issuing office before commencement of the project as to the dates on which the loading or dumping will occur.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities. A copy of the written approval for the appropriate loading site must be displayed with each copy of the permit posted at the loading sites.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre (RMIC) regarding the issuance of a "Notice to Shipping." The RMIC is located at 2380- 555 West Hastings, Vancouver, British Columbia V6B 5G3, (604) 666-6012 (Telephone), (604) 666-8453 (Facsimile), RMIC-PACIFIC@PAC.DFO-MPO.GC.CA (Electronic mail).

11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Branch, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

Notice with Respect to Polychlorinated Biphenyls in Automobile Shredder Residue

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether to control, or the manner in which to control polychlorinated biphenyls in automobile shredder residue, any person described in Schedule 1 to this notice who possesses or who may reasonably be expected to have access to the information described in Schedule 2 to this notice, to provide that information no later than September 27, 2001.

1. (1) This notice applies to any person who operated a scrap metal shredding facility that processed feedstock articles during the 1998, 1999 or 2000 calendar year.

(2) Despite subsection (1), sections 4 to 14 in Schedule 2 do not apply to any person in respect of the 1998, 1999 or 2000 calendar year during which a scrap metal shredding facility produced 1 000 kilograms or less of automobile shredder residue.

1. The definitions in this section apply in this notice.

"automobile shredder residue" means the non-metallic by-product that remains after shredding scrap metal articles containing or likely to contain polychlorinated biphenyls and removing all of the metallic content.

"calendar year" means a period of 12 consecutive months commencing on January 1st.

"feedstock article" means the scrap metal article type, as described in section 14, containing or likely to contain polychlorinated biphenyls, used in a scrap metal shredding facility.

"polychlorinated biphenyls" means chlorobiphenyls that have the molecular formula C12H(10-n)Cln in which "n" is greater than 2.

2. If the information provided in this schedule represents more than one facility, persons to whom this notice applies shall provide the name and address of each facility to which the information relates as an attachment to their submission.

6. For feedstock articles that were destined for shredding and that were inspected on site for polychlorinated biphenyl contamination, during the 1998, 1999 or 2000 calendar year, provide the following information:

(a) a copy of the procedures for the inspections on site;

(b) whether every incoming load of feedstock articles was inspected;

(c) the frequency of inspection if every incoming load of feedstock articles was not inspected;

(d) the criteria used to determine whether an inspection of an incoming load of feedstock articles was conducted;

(e) the situations in which a feedstock article would have been rejected (e.g. if a transformer contained an oil);

(f) if a rejected feedstock article was part of a larger load of incoming feedstock articles, indicate whether the article would have been removed from the load or the entire load would have been rejected;

(g) if a feedstock article or a load containing a feedstock article was rejected, indicate whether it was returned to the supplier or kept on site; and

(h) the date the inspection procedure was implemented.

7. For feedstock articles that were destined for shredding and that were inspected at the supplier's site for polychlorinated biphenyl contamination, during the 1998, 1999 or 2000 calendar year, provide the following information:

(a) the name of the supplier(s) who performed the inspections at the supplier's site; and

(b) a copy of the procedures for the inspections at the supplier's site.

8. For feedstock articles that were destined for shredding during the 1998, 1999 or 2000 calendar year, provide the following information:

(a) the applicable article code, described in section 14, for each type of feedstock article that was mixed prior to shredding; and

(b) the applicable article code, described in section 14, for each type of feedstock article that was shredded separately.

9. If feedstock articles that were destined for shredding, automobile shredder residue, soil, surface water or groundwater was sampled or analyzed for polychlorinated biphenyls during the 1998, 1999 or 2000 calendar year, provide a copy of each analytical result including:

(a) the date of sampling;

(b) the identification and location of what was sampled;

(c) the result, reported in parts per million (ppm), with the laboratory analysis of the sampled matter;

(d) the methods used for sampling and analyzing the matter; and

(e) the name, address and contact person for the laboratory that performed the analysis.

10. For feedstock articles and automobile shredder residue stored on or off site during the 1998, 1999 or 2000 calendar year, provide the following information:

(a) the identification of whether feedstock articles or automobile shredder residue was stored on or off site and what the stored feedstock articles were based on the categories listed in section 14;

(b) the maximum quantity, reported in tonnes, of automobile shredder residue and of each identified category of feedstock article stored on or off site during each year;

(c) the age of each on- or off-site stockpile; and

(d) the storage conditions of on-or off-site stockpile including if a natural or synthetic liner is installed and if a drainage water collection system is installed.

EXPLANATORY NOTE

(This note is not part of the notice.)

Automobile shredder residue (ASR) has been found to contain polychlorinated biphenyls (PCBs) in varying concentrations. Automobiles, household appliances and electrical equipment manufactured prior to the ban on the manufacture of PCBs and on its use in manufacturing equipment and products in the mid 1970s may have components that contain PCBs.

PCBs were assessed against the criteria for Track I management of the federal Toxic Substances Management Policy (TSMP). This policy provides a framework based on two key objectives: virtual elimination from the environment of toxic substances that are persistent, bioaccumulative and anthropogenic (Track 1); and life-cycle management of other toxic substances and substances of concern to prevent or minimize their release into the environment (Track 2).

PCBs are considered as Track I substances under federal Toxic Substances Management Policy (TSMP) and as such their releases to the environment should be virtually eliminated.

The information collected in this notice will serve to assess the extent of PCB contamination in ASR and will assist in determining the need to control or the manner in which to control the PCB content of this material.

This notice was published in the Canada Gazette, Part I, pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999 (CEPA, 1999). This notice requires the persons to whom it applies to provide certain information on their activities with respect to polychlorinated biphenyls in automobile shredder residue.

Pursuant to subsection 71(3) of CEPA, 1999, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is September 27, 2001.

Compliance with CEPA, 1999 is mandatory. Subsection 272(1) of CEPA, 1999 provides that:

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

...

Subsection 272(2) of CEPA, 1999 provides that:

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of CEPA, 1999 provides that:

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of CEPA, 1999 provides that:

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

Notice is hereby given that Industry Canada is releasing a provisional client procedure entitled Requirements for Certification Bodies for public comment. This provisional document presents the requirements which must be met by certification bodies (CBs) intending to certify terminal and radio equipment to Industry Canada's specifications and standards. These requirements will also be used for the recognition of foreign CBs under the terms of the Mutual Recognition Agreements/Arrangements (MRAs).
