SPECIAL IMPORT MEASURES ACT

Concrete Reinforcing Bar — Decision

On November 3, 2000, the Commissioner of Customs and Revenue initiated an investigation pursuant to subsection 31(1) of the Special Import Measures Act into the alleged injurious dumping of hot-rolled deformed carbon or low alloy steel concrete reinforcing bar in straight lengths or coils, originating in or exported from the Republic of Indonesia, Japan, the Republic of Latvia, the Republic of Moldova, the Republic of Poland, Chinese Taipei (previously referred to as Taiwan) and Ukraine. The goods in question are usually classified under the following Harmonized System classification numbers:

The Canada Customs and Revenue Agency will conduct the investigation into the alleged dumping and will render a preliminary decision within 90 days. In addition, the Canadian International Trade Tribunal will now conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Pulp-dewatering Screw Presses

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on November 27, 2000, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency (CCRA) stating that the Commissioner of the CCRA had initiated an investigation into a complaint respecting the alleged injurious dumping in Canada of pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kværner Pulping a.s., its affiliates, successors and assigns.

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2000-004) to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused material injury or retardation or is threatening to cause material injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before December 13, 2000. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before December 13, 2000.

On December 19, 2000, the Tribunal will distribute the public information received from the Commissioner to all parties that filed notices of participation, and the confidential information to counsel who filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before December 29, 2000. These submissions should include evidence, e.g. documents and sources which support the factual statements in the submissions, and argument concerning the questions of:

— whether there are goods produced in Canada, other than those identified in the Commissioner's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped goods;

— whether there is more than one class of allegedly dumped goods;

— which domestic producers of like goods comprise the domestic industry; and

— whether the information before the Tribunal discloses a reasonable indication that the alleged dumping of the goods has caused material injury or retardation, or threatens to cause material injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint by January 8, 2001. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a nonconfidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made. The Canadian International Trade Tribunal Rules govern these proceedings.

All submissions must be filed with the Tribunal in 20 copies. The Tribunal will distribute the public submissions to all parties that filed notices of participation and any confidential submissions to counsel who have filed a declaration and undertaking.

Along with the notice of commencement of preliminary injury inquiry, the Secretary has sent a letter to the domestic producer, named exporter and importers with a known interest in the inquiry which provides details on the procedures and the schedule for the inquiry. DETERMINATION

Telecommunications Services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2000-024) on November 27, 2000, with respect to a complaint filed by AT&T Canada Corp. (the complainant), of Toronto, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. U6158-000401/A) by the Department of Public Works and Government Services on behalf of the Department of Industry. The solicitation was for the acquisition of asynchronous transfer mode network services.

The complainant alleged that the procurement process was being conducted in a discriminatory manner in violation of several articles of the applicable trade agreements.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

Call for Applications for a Broadcasting Licence to Carry on a Radio Programming Undertaking to Serve Ottawa/Hull

On August 25, 2000, in Notice of Public Hearing CRTC 2000-8, the Commission announced an application by Coopérative Radio Ville-Marie Outaouais for a broadcasting licence to carry on a predominantly religious French-language FM radio programming undertaking at Ottawa/Hull, operating on a frequency of 97.9 MHz (channel 250B1) with an effective radiated power of 800 watts. The application was to be considered at a hearing on October 30, 2000.

Please note that the Commission has extended to January 29, 2001, the deadline for submitting applications concerning the above-noted call for applications.

The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, "affected party," for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

(a) a supplier of the controlled product;

(b) an employee at the work place;

(c) an employer at the work place;

(d) a safety and health professional for the work place;

(e) a safety and health representative or a member of a safety and health committee for the work place; and

(f) a person who is authorized in writing to represent

(i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
(ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

Written representations respecting a claim for exemption cited in the present notice, or the material safety data sheet to which the claim relates, must cite the appropriate Registry Number, state the reasons and evidence upon which the representations are based and be delivered within 30 days of the date of the publication of this notice in the Canada Gazette, Part I, to the Screening Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1.

Cut-to-Length Carbon Steel Plate from Canada

Notice is hereby given, pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the final determination made by the United States Department of Commerce, International Trade Administration respecting Certain Cut-to-Length Carbon Steel Plate from Canada is completed. Pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, this Notice of Completion of Panel Review is effective on November 20, 2000, the day the Consent Motion to terminate the binational panel review of this matter was filed (Secretariat File No. USA-CDA-99-1904-02).

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

NATIONAL ENERGY BOARD

PUBLIC HEARING

Sumas Energy 2, Inc. — Hearing Order EH-1-2000

Notice is hereby given that the National Energy Board (the Board) has received from Sumas Energy 2, Inc. (Sumas or the Applicant) an application dated July 7, 1999, as amended October 23, 2000, pursuant to Part III, section 58.23, of the National Energy Board Act (the Act), requesting a Certificate of Public Convenience and Necessity to construct an international power line. The proposed power line would originate in the United States and cross the Canadian border near Abbotsford, British Columbia. The proposed power line would extend approximately 8.5 km northward from the border on Canadian Pacific Railway, City of Abbotsford and British Columbia Hydro and Power Authority (B.C. Hydro) existing rights-of-way to B.C. Hydro's Clayburn substation located in Abbotsford, British Columbia. It would operate at 230 000 volts. No customers for the electricity to be transported on the proposed power line have yet been identified. Sumas is not applying for authorization to export electricity from Canada.

The Board will hold an oral public hearing into the application for the Certificate of Public Convenience and Necessity pursuant to sections 58.25 and 24 of the Act commencing Monday, February 19, 2001, at 9 a.m., in the Fraser Valley, British Columbia, at a location to be determined. The hearing will be held to obtain the evidence and the views of interested parties to Hearing Order EH-1-2000.

The Board will hold public information sessions to inform persons on how to participate in the Board's hearing process on November 21 and 22, 2000, from 7:00 to 10:00 p.m. at the Abbey Arts Centre, 2329 Crescent Way, Abbotsford, British Columbia. Notice of the public information sessions will be published in local newspapers.
