COMMENCEMENT OF INQUIRY

Grain Corn

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on November 7, 2000, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency, stating that a preliminary determination had been made respecting the dumping and subsidizing of grain corn in all forms, excluding white dent corn imported by snack food and tortilla manufacturers for use by them in the manufacture of snack food and tortillas, seed corn (used for reproductive purposes), sweet corn and popping corn, originating in or exported from the United States of America and imported into Canada for use or consumption west of the Manitoba-Ontario border (Inquiry No. NQ-2000-005).

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused or are threatening to cause injury, or have caused retardation, as these words are defined in SIMA, and to determine such other matters as the Tribunal is required to determine under that section.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Public Hearing

A public hearing relating to this inquiry will be held at The Lombard Hotel, 2 Lombard Place, Winnipeg, Manitoba, commencing on February 5, 2001, at 9:30 a.m.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of appearance with the Secretary on or before November 27, 2000. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of appearance as well as a declaration and undertaking with the Secretary on or before November 27, 2000.

To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested party and each counsel filing a notice of appearance must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using French or English or both languages at the hearing.

Representations concerning the public interest question referred to in subsection 45(2) of SIMA may be made to the Tribunal. Persons referred to in subsection 45(2) who wish to make representations on that question must make the request to do so to the Secretary no later than November 27, 2000. No comprehensive representations on the public interest question are required at that time. However, any person wishing to make such representations should indicate the general nature of the public interest concerns. If any such request is received, the Secretary will notify any person making such a request and the parties to the inquiry of the place and time for the making of representations and the manner in which they may be made in the event of a finding of injury.

The Canadian International Trade Tribunal Rules govern these proceedings.

In order to observe and understand production processes, the Tribunal, accompanied by its staff, may conduct field visits.

Along with the notice of commencement of inquiry, the Secretary has sent a letter to the Manitoba Corn Growers Association, interested governments and departments, importers, exporters and certain purchasers with a known interest in the inquiry providing details on the procedures and the schedule for the inquiry. It specifies, among other things, the date for filing replies to Tribunal questionnaires, the date that information on record will be made available by the Tribunal to interested parties and counsel that have filed notices of appearance, and dates for filing of submissions by interested parties.

COMMENCEMENT OF INVESTIGATION

Filtering Fabric

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-2000-003) received from Tantalum Mining Corporation of Canada Limited (the requester) of Lac du Bonnet, Manitoba, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of filtering fabric, solely of non-textured polyester filaments, with a loom width exceeding 3 metres, for use in the manufacture of cesium formate (the subject fabric).

The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabric, which is classified under tariff item No. 5911.40.00.

The Tribunal's investigation was commenced on November 8, 2000, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before December 6, 2000. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by March 8, 2001.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Notice was received by the Secretary of the Canadian International Trade Tribunal (the Tribunal) on November 3, 2000, from the Acting Director General of the Anti-dumping and Countervailing Directorate at the Canada Customs and Revenue Agency (CCRA) stating that the Commissioner of the CCRA had initiated an investigation into a complaint respecting the alleged injurious dumping in Canada of hot-rolled deformed carbon or low alloy steel concrete reinforcing bar in straight lengths or coils, originating in or exported from the Republic of Indonesia, Japan, the Republic of Latvia, the Republic of Moldova, the Republic of Poland, Chinese Taipei (previously referred to as Taiwan) and Ukraine (Preliminary Injury Inquiry No. PI-2000-003).

Pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry to determine whether the evidence discloses a reasonable indication that the dumping of the subject goods has caused material injury or retardation or is threatening to cause material injury, as these words are defined in SIMA.

The Tribunal's inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the inquiry must file a notice of participation with the Secretary on or before November 17, 2000. Each counsel who intends to represent a party in the inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before November 17, 2000.

On November 23, 2000, the Tribunal will distribute the public information received from the Commissioner to all parties that filed notices of participation, and the confidential information to counsel who filed a declaration and undertaking with the Tribunal.

Submissions by parties opposed to the complaint must be filed on or before December 4, 2000. These submissions should include evidence, e.g. documents and sources which support the factual statements in the submissions, and argument concerning the questions of:

— whether there are goods produced in Canada, other than those identified in the Commissioner's statement of reasons for initiating the investigation, that are like goods to the allegedly dumped goods;

— whether there is more than one class of allegedly dumped goods;

— which domestic producers of like goods comprise the domestic industry; and

— whether the information before the Tribunal discloses a reasonable indication that the alleged dumping of the goods has caused material injury or retardation, or threatens to cause material injury.

The complainant may make submissions in response to the submissions of parties opposed to the complaint by December 11, 2000. At that time, other parties supporting the complaint may also make submissions to the Tribunal.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. In the matter of a review (Review No. RR-99-006), under subsection 76(2) of the Special Import Measures Act, of the findings made by the Canadian International Trade Tribunal on November 6, 1995, in Inquiry No. NQ-95-002, concerning: the dumping of refined sugar, refined from sugar cane or sugar beets, in granulated, liquid and powdered form, originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of refined sugar, refined from sugar cane or sugar beets, in granulated, liquid and powdered form, originating in or exported from the European Union

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby continues the findings in respect of the dumping of the above-mentioned goods originating in or exported from Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of the above-mentioned goods originating in or exported from the European Union, with an amendment to exclude the goods listed in the Appendix.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal also hereby continues the finding in respect of the dumping of the above-mentioned goods originating in or exported from the United States of America, with an amendment to exclude the goods listed in the Appendix.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

SUSPENSION OF INQUIRY

On September 29, 2000, the Canadian International Trade Tribunal (Tribunal) published a notice in the Canada Gazette informing interested parties that it had suspended its injury inquiry (Inquiry No. NQ-2000-003) in the above-mentioned matter further to the receipt of a notice from the Commissioner of the Canada Customs and Revenue Agency (the Commissioner) that, pursuant to section 49(1) of the Special Import Measures Act (SIMA), he had accepted an undertaking offered by the exporter with respect to the subject goods.

Pursuant to subsection 51(1) of SIMA, the Commissioner will terminate an undertaking and resume his investigation if, within 30 days of the notice of acceptance of an undertaking, a written request for termination is received from an importer, the exporter or the complainant.

No written request having been received by the Commissioner for the termination of the undertaking, the Tribunal hereby gives notice that its inquiry into the question of whether the dumping of the subject goods found by the Commissioner has caused injury or is threatening to cause injury remains suspended.

PUBLIC NOTICE 2000-150

Call for Comments on Proposed Amendments to the Broadcasting Distribution Regulations, Pay Television Regulations, 1990 and Specialty Services Regulations, 1990

In this notice, the Commission calls for comments on proposed regulatory amendments necessary to give effect to its licensing framework policy for new digital pay and specialty services set out in Public Notice CRTC 2000-6.

Future amendments may be required to accommodate any determinations that the Commission may make related to increasing the availability of French-language broadcasting services in French linguistic minority communities as a result of the processes described in Public Notices CRTC 2000-38 and 2000-74. Interested parties will have an opportunity to comment on proposed amendments to any regulations that result from these processes.

The Commission proposes to make amendments to the Pay Television Regulations, 1990, SOR/90-105, the Specialty Services Regulations, 1990, SOR/90-106, and the Broadcasting Distribution Regulations, SOR/99-555. A copy of the proposed Regulations amending certain regulations made under the Broadcasting Act (the proposed amendments) is appended to the public notice.

The proposed amendments result from the process initiated by the Commission in Public Notice CRTC 1999-19 calling for comments to assist in the development of an appropriate framework for considering new pay and specialty services applications. Following a written comment process, the Commission issued Public Notice CRTC 2000-6, dated January 13, 2000, and entitled Licensing framework for new digital pay and specialty services, setting out its framework for licensing new digital Canadian pay and specialty services.

The proposed amendments are intended to implement the Commission's policies as set out in Public Notice 2000-6. The Commission proposes that the amendments will come into effect on February 1, 2001.

Future amendments may be required to accommodate any determinations that the Commission may make related to increasing the availability of French-language broadcasting services in French linguistic minority communities as a result of the processes described in Public Notices CRTC 2000-38 and 2000-74. Interested parties will have an opportunity to comment on proposed amendments to any regulations that result from these processes.

Carriage of category 1 and category 2 services

In Public Notice 2000-6, the Commission stated that it would license two categories of new digital services, each with a different set of regulatory obligations and privileges. It proposes to incorporate the corresponding obligations affecting distribution undertakings into the Broadcasting Distribution Regulations (the Regulations) as follows:

Class 1 and 2 licensees who offer programming services to the public by using digital technology would, pursuant to subsection 18(11) of the Regulations, be required to distribute Category 1 services appropriate to their market on a digital basis. Direct-to-home (DTH) undertakings would be required to carry all category 1 services on a digital basis pursuant to section 38. Pursuant to the proposed amendment to section 33.1, Class 3 licensees may carry category 1 services.

Under the proposed amendments, Class 1, Class 2 and Class 3 licensees may carry category 2 services on a digital basis pursuant to sections 19.1 and 33.1.

As an exception, section 33.2 of the Regulations would allow licensees of independent Class 3 distribution systems that do not use digital technology to distribute Category 1 services on an analog basis. An independent Class 3 distribution system is one that is not interconnected with a Class 1 or Class 2 distribution system.

Related Category 2 services

As outlined in Public Notice 2000-6, when a licensee and/or an affiliate of that licensee controls more than 10 percent of the total shares of the licensee of a category 2 service, the two are considered to be "related." To address concerns regarding the potential for preferential treatment of related services, cable and DTH distribution undertakings would be required, pursuant to subsections 18(12) and (13) and sections 31 and 36 of the Regulations, to distribute five non-related Category 2 services for each related Category 2 service they distribute. The obligation to distribute five unrelated services will also be triggered when a related pay-per-view or DTH pay-per-view service licensed after January 1, 2000, or a related video-on-demand service is distributed.

The remaining proposed amendments to the Regulations are required to effect and clarify the amendments noted above.

Undue preference provisions

The proposed amendments to the Pay Television Regulations, 1990 and the Specialty Services Regulations, 1990 address the concern that a licensee of multiple programming services could confer upon itself an undue preference in negotiating the terms of carriage for all its services. The proposed amendments also address the concern that licensees of distributor-affiliated programming services could potentially confer an undue preference on the distributor to which they are affiliated. The proposed amendments therefore introduce a prohibition against pay and specialty services, respectively, granting an undue preference or advantage similar to the provision applicable to distributors by virtue of the Broadcasting Distribution Regulations.

Call for comments

Interested parties are invited to present their comments as to whether the proposed amendments accurately reflect the Commission's policy set out in Public Notice 2000-6.

The Commission will accept comments that it receives on or before December 8, 2000.

The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.

CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION

PUBLIC NOTICE 2000-153

Call for Applications for a Broadcasting Licence to Carry on a Radio Programming Undertaking to Serve Ottawa/Hull

On August 25, 2000, in Notice of Public Hearing CRTC 2000-8, the Commission announced an application by Coopérative Radio Ville-Marie Outaouais for a broadcasting licence to carry on a predominantly religious French-language FM radio programming undertaking at Ottawa/Hull, operating on a frequency of 97.9 MHz (channel 250B1) with an effective radiated power of 800 watts. The application was to be considered at a hearing on October 30, 2000.

The Commission received interventions from other parties expressing an interest in filing FM radio applications for the use of the 97.9 MHz frequency.

In view of the foregoing, the application by Coopérative Radio Ville-Marie Outaouais was removed from the agenda of the October hearing.

The Commission hereby calls for applications from other parties wishing to obtain a radio licence in the Ottawa/Hull market.

Persons interested in submitting such an application are required to file with the Commission a letter of intent no later than December 8, 2000, followed by a formal application no later than January 8, 2001, and are also required to submit all necessary technical documentation to the Department of Industry by the latter date.

It should be noted that, in making this call, the Commission has not reached any conclusion with respect to the licensing of such a service, nor should it necessarily be construed that the Commission will, by virtue of having called for applications, authorize such a service at this time.

Applicants will be required to provide evidence giving clear indication that there is a demand and a market for the station and the proposed service. Without restricting the scope of the issues to be considered, the following should be addressed:

1. The contribution that the proposed service will make to achieving the objectives established in the Broadcasting Act and, in particular, to the production of local and regional programming.

2. The factors relevant to the evaluation of applications, as outlined in Decisions CRTC 99-480, 99-481 and 99-482.

3. The expected audience of the proposed service.

4. The means by which the applicant will promote the development of Canadian talent, including local and regional talent.

5. An analysis of the markets involved and potential advertising revenues, taking into account the results of any survey undertaken supporting the estimates.

6. Evidence as to the availability of financial resources consistent with the requirements established in the financial projections of the applicant's business plan. For the convenience of applicants, the Commission has available upon request a document entitled "Documentation Required by the Commission to Support the Availability of an Applicant's Proposed Financing."

The Commission also reminds applicants that they must comply with the eligibility requirements set out in the Direction to the CRTC (Ineligibility of Non-Canadians), SOR/97-192, dated April 8, 1997, as amended by SOR/98-378, dated July 15, 1998, and the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences), SOR/85-627, dated June 27, 1985, as amended by SOR/97-231, dated April 22, 1997.

The Commission will announce at a later date the public process for considering applications and where they may be examined by the public. As part of that process, the public will be given the opportunity to comment on any application by submitting written interventions to the CRTC.

Notice of each application will also be published in newspapers of general circulation within the area to be served.

6. The Notice of Filing published in the Canada Gazette, Part I, on January 31, 1998, listed the subject of the claim bearing Registry Number 4094 to be the chemical identity of four ingredients. It has since been established that the subject of the claim is the chemical identity and concentration of four ingredients.

7. The Notice of Filing published in the Canada Gazette, Part I, on January 31, 1998, listed the subject of the claims bearing Registry Numbers 4101 and 4116 to be the chemical identity of one ingredient. It has since been established that the subject of the claims is the chemical identity and concentration of two ingredients.

There were no submissions from affected parties to the Screening Officer with respect to any of the above claims for exemption and related MSDSs.

Each of the claims for exemption listed above was found to be valid. The Screening Officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations. After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the claims bearing Registry Numbers 4145, 4273, 4283 and 4316 complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claim bearing Registry Number 4282, being a claim from an employer in the province of Ontario, the MSDS relating to the claim complied with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

After consultation with officials of the Department of Health, and having regard for the various data readily available in the literature and any information provided by the claimant, the Screening Officer found that the respective MSDS relating to the remaining claims did not comply with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

Registry Number 3189

The claimant has been ordered to amend certain aspects of the content of the MSDS.

Registry Number 3811

The claimant has been ordered to amend certain aspects of the content and wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Correct the information pertaining to the lower and upper flammable limits;

2. Disclose oxides of carbon as hazardous combustion products;

3. Disclose that chronic ingestion of an ingredient in the controlled product has been shown to cause damage to the liver and adverse effects on the nervous system and muscle tissues in laboratory animals;

4. Disclose that an ingredient in the controlled product is considered to be a germ cell mutagen based on positive results in in vivo screening tests and that it has been shown to cause mutagenic effects in human cells, in vitro;

5. Disclose that halogenated hydrocarbons are toxicologically synergistic products in combination with an ingredient in the controlled product;

6. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: Have casualty drink 250-300 mL of water to dilute the ingested material. If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration and repeat administration of water.

Registry Number 3822

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose that acute inhalation of an ingredient in the controlled product has caused an increase in heart rate;

2. Disclose the heart, the urinary bladder and the ears as target organs due to chronic exposure;

3. Disclose that an ingredient in the controlled product has been shown to cause teratogenic effects in laboratory animals;

4. Disclose that ingredients in the controlled product have shown positive results in screening tests for mutagenicity;

5. Disclose that n-hexane, benzene, xylene, ethanol and acetylsalicylic acid produce synergistic effects;

6. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be flushed with water for at least 15 minutes or until the chemical is removed;

7. Disclose the Exposure Limit Value AIHA WEEL (TWA, 8 hours) = 100 ppm for propylene glycol monomethyl ether acetate;

8. Disclose the lower LC50 (4 hours, female rat) value of 5 060 ppm for toluene;

9. Correct the LC50 (2 hours, mouse) value for methyl ethyl ketone.

Registry Numbers 3888 to 3911, inclusive and 4157

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose oxides of carbon and nitrogen as hazardous combustion products;

2. Disclose that diethylene glycol methyl ether has been shown to cause teratogenic effects via oral exposure in laboratory animals;

3. In relation to the first aid information shown on the MSDS for skin contact, disclose a statement to the effect that the skin should be washed with gently flowing, lukewarm water for at least 20-30 minutes and that contaminated clothing, footwear and leather goods should be removed under running water;

4. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: Have casualty rinse their mouth thoroughly with water. Have casualty drink 250-300 mL of water to dilute the ingested material. If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

5. Registry Number 3896: Disclose the Exposure Limit Value OSHA PEL-Ceiling = 5 mg/m3 for manganese oxide;

6. Registry Number 3904: Disclose an LD50 (oral, rat) value of >2 g/kg, an LD50 (dermal, rat) value of >2 g/kg and an LC50 (4 hour, rat) of >2.53 mg/L for the controlled product;

7. Registry Numbers 3889, 3890 and 3900:

(a) Disclose the Exposure Limit Value ACGIH TLV-TWA = 0.1 mg/m3 for amorphous silica;

(b) Disclose the Exposure Limit Value OSHA-PEL = either 80 mg/m3 divided by the value "%SiO2" or 20 mppcf for amorphous silica;

8. Registry Numbers 3896, 3897 and 3898: Disclose that ingredients in the controlled product have shown positive results in screening tests for mutagenicity;

9. Registry Numbers 3898, 3900 and 3906:

(a) Disclose Exposure Limit Values for one of the confidential hazardous ingredients;

(b) Disclose the presence of two additional confidential hazardous ingredients in the controlled product;

10. Registry Numbers 3900, 3910 and 3911: Disclose that ingredients in the controlled product have shown positive results in in vitro screening tests for mutagenicity and that an ingredient in the controlled product has shown positive results in an in vivo screening test for mutagenicity;

11. Registry Numbers 3896-8 and 3900:

(a) Disclose the Exposure Limit Values OSHA-PEL = 30 mg/m3 divided by the value "%SiO2+2" (total particulate) and either 10 mg/m3 divided by the value "%SiO2+2" or 250 mppcf divided by the value "%SiO2+5" (respirable fraction) for crystalline silica;

(b) Revise the MSDS to show that crystalline silica has been classified as carcinogenic to humans (Group 1) by the International Agency for Research on Cancer (IARC);

12. Registry Numbers 3889, 3893, 3894, 3899, 3901, 3902 and 3911: Disclose the presence of an additional confidential hazardous ingredient in the controlled product;

13. Registry Numbers 3889-3895, 3899, 3901-3909 and 4157: Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity;

14. Registry Numbers 3889-3903, 3905-3911 and 4157: Disclose an LD50 (oral, rat) value of >2 g/kg, an LD50 (dermal, rat) value of >2 g/kg and an LC50 (4 hour, rat) of >2.53 mg/L for an essentially similar controlled product.

Registry Numbers 4081 to 4116, inclusive

The claimant has been ordered to amend certain aspects of the format and content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose the Exposure Limit Value AIHA WEEL (TWA, 8 hours) = 100 ppm, and an LC50 (6 hours, rat) of >4 345 ppm, for propylene glycol monomethyl ether acetate;

2. In relation to the first aid information shown on the MSDS for ingestion, add a statement such as the following: Have casualty rinse their mouth thoroughly with water. Have casualty drink 250-300 mL of water. If vomiting occurs naturally, have casualty lean forward to reduce the risk of aspiration;

3. Registry Number 4084: Disclose the presence of two additional confidential hazardous ingredients in the controlled product;

4. Registry Number 4094: Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

5. Registry Number 4097: Disclose that an ingredient in the controlled product has shown positive test results in in vivo screening tests for mutagenicity, and disclose that other ingredients in the controlled product have shown positive test results in in vitro screening tests for mutagenicity;

6. Registry Number 4098:

(a) Disclose the Exposure Limit Values ACGIH TLV-TWA = 0.012 mg/m3 (as Cr) and OSHA-PEL = 0.5 mg/m3 (as Cr) for C.I. Yellow Pigment 34;

(b) Disclose an LC50 value for the confidential hazardous ingredient in an acceptable manner;

7. Registry Number 4104: Disclose the Exposure Limit Value OSHA PEL = 0.5 mg/m3 for chromium oxide;

8. Registry Number 4106: Disclose the Exposure Limit Values ACGIH TLV-TWA = 0.2 mg/m3 (fumes), ACGIH TLV-TWA = 1 mg/m3 (dusts and mists) and OSHA PEL-C = 0.1 mg/m3 for C.I. Pigment Blue 15;

9. Registry Number 4112: Disclose an LD50 value for the confidential hazardous ingredient in an acceptable manner;

10. Registry Numbers 4083 and 4084: Disclose oxides of carbon, sulphur and nitrogen as hazardous combustion products;

11. Registry Numbers 4087 and 4089:

(a) If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A;

(b) Disclose that an ingredient in the controlled product has been shown to cause fetotoxic effects in laboratory animals;

12. Registry Numbers 4088 and 4089: Disclose the Exposure Limit Values ACGIH TLV-TWA = 10 mg/m3 (as Mo) and 0.012 mg/m3 (as Cr) and also OSHA PEL = 15 mg/m3 (as Mo) and 0.5 mg/m3 (as Cr) for C.I. Pigment Red 104;

13. Registry Numbers 4088 and 4093: Disclose the Exposure Limit Values OSHA PEL = 15 mg/m3 (total) and OSHA PEL = 5 mg/m3 (respirable fraction) for aluminum oxide;

14. Registry Numbers 4093 and 4097:

Registry Numbers 4113-4116: Disclose that an ingredient in the controlled product has shown positive test results in in vivo screening tests for mutagenicity, and disclose that another ingredient in the controlled product has shown positive test results in in vitro screening tests for mutagenicity;

20. Registry Numbers 4088, 4089, 4093, 4098 and 4104: Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity;

21. Registry Numbers 4082, 4088, 4089, 4091, 4095, 4099, 4102, 4103 and 4112-6: Disclose oxides of carbon as hazardous combustion products;

Registry Number 4185

The claimant has been ordered to amend certain aspects of the wording of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Disclose an LD50 value for one of the confidential hazardous ingredients;

2. Disclose that ingestion of an ingredient in the controlled product has been shown to cause central nervous system depression in laboratory animals;

3. Revise the MSDS to show that crystalline silica has been classified as carcinogenic to humans (Group 1) by the International Agency for Research on Cancer (IARC);

4. Disclose that an ingredient in the controlled product has shown positive results in screening tests for mutagenicity;

5. Remove the statement that the "product is not known to cause allergies;"

6. In relation to the first aid information shown on the MSDS for ingestion, remove the statement "Give plenty of water to drink" and replace it with a statement such as the following: Have casualty drink 250-300 mL of water to dilute the ingested material.

Acknowledgement: Subsequent to the review of the MSDS-of-Record respecting this particular claim, the claimant provided the Commission with a copy of a revised version. This revised version of the MSDS was not, however, reviewed by the Screening Officer.

Registry Number 4226

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been ordered to amend the MSDS as indicated below.

1. Disclose an LD50 value for one of the confidential hazardous ingredients in an acceptable manner;

2. Disclose that an ingredient in the controlled product has been shown to cause skin sensitization in workers.

Registry Numbers 4643 and 4644

The claimant has been ordered to amend certain aspects of the content of the MSDS.

In the opinion of the Screening Officer, certain information should have been shown on the MSDS. The claimant has been further ordered to amend the MSDS as indicated below.

1. Add carbon dioxide to the list of products of thermal decomposition;

2. Registry Number 4643:

(a) Disclose the generic chemical identity of an additional confidential hazardous ingredient in the controlled product, disclose its concentration in an acceptable manner and disclose that the real chemical identity is included in the claim for exemption;

(b) Remove the entry for alkylphosphite in the hazardous materials section.

Acknowledgement: Subsequent to the review of the MSDSs-of-Record respecting these particular claims, the claimant provided the Commission with copies of revised versions. These revised versions of the MSDSs were not, however, reviewed by the Screening Officer.

Having regard to the foregoing, and pursuant to section 17 of the Hazardous Materials Information Review Act, notice is hereby given that the Screening Officer has, for each of the above-noted claims, with the exceptions of those claims bearing Registry Numbers 4145, 4273, 4282, 4283 and 4316, directed the claimant to comply with the provisions of the Hazardous Products Act and the Controlled Products Regulations within 30 days from the expiry of the appeal period, except that the information in respect of which the claim for exemption was made does not have to be disclosed, and to provide a copy of the amended MSDS to the Screening Officer within 40 days of expiry of the appeal period.

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, this notice includes certain information which, in the opinion of the Screening Officer, should have been shown on the relevant MSDS.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal any decision or order of a Screening Officer. To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered within 45 days of the publication of this notice in the Canada Gazette, Part I, to the Chief Appeals Officer at the following address: Hazardous Materials Information Review Commission, 200 Kent Street, Suite 9000, Ottawa, Ontario K1A 0M1, (613) 993-4472.
