SPECIAL IMPORT MEASURES ACT
Grain Corn — Decision
On August 9, 2000, the Commissioner of Customs and Revenue initiated an investigation under the Special Import Measures Act into the alleged injurious dumping and subsidizing of grain corn in all forms, excluding white dent corn imported by snack food and tortilla manufacturers for use by them in the manufacture of snack food and tortillas, seed corn (used for reproductive purposes), sweet corn, and popping corn, originating in or exported from the United States of America, and imported into Canada for use or consumption west of the Manitoba/Ontario border. The goods in question are usually classified under the following Harmonized System classification numbers:

The Canada Customs and Revenue Agency will conduct the investigation into the alleged dumping and subsidizing. In addition, the Canadian International Trade Tribunal will now conduct a preliminary inquiry into the question of injury to the regional Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

Waterproof Footwear and Bottoms — Decision
On August 10, 2000, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Commissioner of Customs and Revenue made a preliminary determination of dumping respecting waterproof footwear and bottoms of plastic or rubber, including moulded clogs, originating in or exported from the People's Republic of China, excluding ski-boots, skating boots and all footwear subject to the order made in the Canadian International Trade Tribunal Review No. RR-97-001. On this date, the Commissioner determined that there is evidence that discloses a reasonable indication that the dumping has caused injury to production in Canada. The goods in question are usually classified under the Harmonized System tariff numbers:

Information
The Canadian International Trade Tribunal will now conduct an inquiry into the question of injury to the production of like goods in Canada. The Tribunal will make an order or finding within 120 days following the receipt of the notice of the preliminary determination.
Pursuant to section 8 of SIMA, provisional duties are payable on the subject goods which are released from customs during the period commencing on the date the preliminary determination is made and ending on the earlier of the date on which the investigation, or portions thereof, is terminated by the Canada Customs and Revenue Agency (CCRA), and the date on which the Tribunal makes its decision. The amount of provisional duty payable on the goods is no greater than the estimated margin of dumping. The payment of such duty is hereby demanded.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal), further to a judgement of the Federal Court of Appeal dated May 26, 2000, amended, on August 17, 2000, the recommendation (File No. PR-98-047R) that it made in its determination of June 17, 1999, with respect to a complaint filed by Novell Canada, Ltd., of Hull, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning Solicitation No. W8474-9-QQD8/A of the Department of Public Works and Government Services on behalf of the Department of National Defence, by recommending the following:
Pursuant to subsections 30.15(2) and (3) of the Canadian International Trade Tribunal Act, the Canadian International Trade Tribunal, after finding that the solicitation at issue relates to components of a network operating system rationalization project of the Department of National Defence, recommends, as a remedy, that the Department of National Defence dispose, outside the federal government, of the 325 Microsoft Windows NT Server 4.0 licences and the 12 000 client access licences that it acquired as a result of the above-mentioned solicitation and, if the need still exists, that it invite new proposals for this requirement in accordance with the trade agreements.
Should the Department of National Defence decide not to dispose of the server and client access licences, the Tribunal recommends, as an alternative, that, in addition to the recommendation for compensation for lost profits that it made in its determination of June 17, 1999, the Government compensate Novell Canada, Ltd. by a further amount, to be determined jointly by the Department of Public Works and Government Services and Novell Canada, Ltd. and to be submitted for the consideration of the Canadian International Trade Tribunal, which reflects the implications for Novell Canada, Ltd. of leaving undisturbed the acquisition by the Department of National Defence by means of unjustified limited tendering procedures from Microsoft Corporation of the server and client access licences, which has handicapped and will handicap Novell Canada, Ltd.'s opportunity to be successful in competing for the requirements of the Department of National Defence's network operating system.

Refrigerators, Dishwashers and Dryers
In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting certain refrigerators, dishwashers and dryers originating in or exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns
The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-2000-001) following the issuance by the Commissioner of the Canada Customs and Revenue Agency (the Commissioner) of a preliminary determination dated April 3, 2000, and of a final determination dated June 30, 2000, respecting the dumping in Canada of certain top-mount electric refrigerators, electric household dishwashers and gas or electric laundry dryers originating in or exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns.
Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that:
1. the dumping in Canada of the aforementioned refrigerators has caused material injury to the domestic industry, excluding those:
— with a capacity of 18.5 cubic feet and above; or
— destined for use in the Habitat for Humanity Program;
2. the dumping in Canada of the aforementioned dishwashers has caused material injury to the domestic industry (Member Close dissenting), excluding those:
— with stainless steel interiors (tubs); or
— destined for use in the Habitat for Humanity Program; and
3. the dumping in Canada of the aforementioned dryers has caused material injury to the domestic industry (Member Close dissenting), excluding those:
— with controls at the front, removable tops and chassis designed to be stacked on top of washers; or
— destined for use in the Habitat for Humanity Program.
The Canadian International Trade Tribunal also finds that the requirements of paragraph 42(1)(b) of the Special Import Measures Act with respect to massive dumping and of section 46 of the Special Import Measures Act with respect to an advice to the Commissioner regarding other allegedly dumped goods from the United States have not been met.
The statement of reasons will be issued within 15 days.

Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on August 11, 2000, a first Request for Panel Review of the final determination made by the Commissioner of Canada Customs and Revenue Agency, respecting Certain Top-Mount Electric Refrigerators, Electric Household Dishwashers, and Gas or Electric Laundry Dryers, Originating in or Exported from the United States of America and produced by, or on behalf of, White Consolidated Industries, Inc. and Whirlpool Corporation, their respective affiliates, successors and assigns, was filed by counsel for Whirlpool Corporation with the Canadian Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The final determination was published in the Canada Gazette, Part I, on July 15, 2000 (Vol. 134, No. 29).
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that:

Explanatory Note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Article 1904 Panel Rules. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

Prices for Consumer Goods and Souvenirs at National Battlefields Park — Public Notice
Notice is hereby given that in virtue of the powers conferred upon the Minister by section 9 of the Department of Canadian Heritage Act, the Minister delegates to the Chairman and Secretary of the National Battlefields Commission or their respective replacements her authority to fix the fees payable in respect of products, rights and privileges provided by the Commission. The Commission manages Battlefields Park (the Plains of Abraham) and ensures its conservation and enhancement. The Park welcomes over 4 million visitors annually and plans to provide them with certain complementary services, particularly consumer goods and souvenirs. Part of the responsibility for managing the park involves establishing and implementing rights to use.
The price schedule for the goods and objects listed below come into effect August 18, 2000. The prices charged by the National Battlefields Commission are based on the principles of equity, justice and suitability and take into consideration the market value of similar consumer goods and souvenirs sold by other organizations and institutions. The prices in the list produced at the Appendix A do not include applicable taxes.
It should be noted that the monies generated by the over-the-counter sale of these consumer goods and souvenirs to users will be reinvested in National Battlefields Park (the Plains of Abraham) and will allow for the continuation and development of services for the public. In this regard, National Battlefields Commission administrators entirely accept and support the basic principle of maintaining free access to the Plains of Abraham for the general public.

PUBLIC HEARING
Trans-Northern Pipelines Inc. — Proposed Suspension of Service on the Don Valley Lateral
The National Energy Board (the Board) will conduct an oral public hearing on Tuesday, October 24, 2000, pursuant to subsection 71(1) of the National Energy Board Act with respect to the proposed suspension by Trans-Northern Pipelines Inc. (Trans-Northern) of service on a portion of its oil products pipeline known as the Don Valley lateral effective January 1, 2001. The Don Valley lateral extends approximately 19 kilometres from Trans-Northern's mainline at Cummer Junction to a delivery terminal at Toronto Harbour. The hearing will be for the purpose of obtaining the views of interested parties on the matter. The location of the hearing will be determined at a later date.
Any person interested in the hearing should consult the Board's Directions on Procedure for Hearing Order MH-3-2000 for further instructions. The Directions on Procedure may be obtained by calling the Board toll-free at 1-800-899-1265 and specifying the MH-3-2000 proceeding or through the Board's Internet site at www.neb.gc.ca (click on "Regulatory Update" and then "Hearing Orders for Upcoming Hearings").
Any person wishing to intervene in this proceeding must file a written intervention with the Secretary of the Board by September 7, 2000, and serve one copy on Trans-Northern at the following address: Mr. J.
