ADVICE

Filter Tip Cigarette Tubes

In the matter of a reference (Reference No. RE-98-001), under paragraph 34(1)(b) of the Special Import Measures Act, made by GIZEH Raucherbedarf GmbH, exporter, to the Canadian International Trade Tribunal;

And in the matter of an advice rendered by the Canadian International Trade Tribunal under section 37 of the Special Import Measures Act;

Respecting the dumping in Canada of filter tipped cigarette tubes, excluding those which bear the trademark or brand name of a finished or ready-made cigarette, originating in or exported from France and the Federal Republic of Germany.

The Canadian International Trade Tribunal hereby concludes that the evidence before the Deputy Minister of National Revenue discloses a reasonable indication that the dumping of filter tipped cigarette tubes, excluding those which bear the trademark or brand name of a finished or ready-made cigarette, originating in or exported from France and the Federal Republic of Germany has caused material injury or is threatening to cause material injury to the domestic industry.

REVIEW OF FINDING

12-Gauge Shotshells

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76(2) of the Special Import Measures Act, review (Review No. RR-98-005) its finding made on June 22, 1994, in Inquiry No. NQ-93-005, concerning 12-gauge shotshells originating in or exported from the Czech Republic and the Republic of Hungary.

Notice of Expiry No. LE-98-004, issued September 21, 1998, informed interested persons and governments of the impending expiry of the finding. On the basis of available information, including representations requesting or opposing the initiation of a review and responses to these representations received by the Tribunal in reply to the notice, the Tribunal is of the opinion that a review of the finding is warranted.

Letters have been sent to parties with a known interest in the review providing them with the schedule for the review. The schedule specifies, among other things, the date for the filing of replies to Tribunal questionnaires, the date on which information on the record will be made available by the Tribunal to interested parties and counsel that have filed notices of appearance and the dates for the filing of submissions by interested parties.

Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why the information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Public Hearing

A public hearing relating to this review will be held in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing on April 28, 1999, at 9:30 a.m., to hear evidence and representations by interested parties.

Each interested person or government wishing to participate at the hearing as a party must file a notice of appearance with the Secretary on or before January 13, 1999. Each counsel who intends to represent a party at the hearing must file a notice of appearance as well as a declaration and undertaking with the Secretary on or before January 13, 1999.

To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested person or government and each counsel filing a notice of appearance must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using English or French or both languages at the hearing.

The Canadian International Trade Tribunal Rules govern these proceedings.

In order to observe and understand production processes, the Tribunal, accompanied by its staff, may conduct plant visits.

2. Montréal (Verdun), Quebec
Metromedia CMR Montreal Inc.

To amend the broadcasting licence of the (radio) programming undertaking CKVL Verdun, by changing the frequency from 850 kHz to 690 kHz and by increasing the transmitter power from 10 000 to 50 000 watts during the night. It is noted that the power during the day will remain at 50 000 watts. The applicant is proposing to provide an all-news service dedicated to the Montréal Region. The Commission also notes that this application is technically mutually exclusive with other applications scheduled at this hearing for the use of the 690 kHz frequency.

3. Montréal, Quebec
Metromedia CMR Broadcasting Inc.

To amend the broadcasting licence of the (radio) programming undertaking CIQC Montréal, by changing the frequency from 600 kHz to 940 kHz and by increasing the transmitter power from 10 000 to 50 000 watts during the day and from 5 000 to 50 000 watts during the night. The applicant is proposing to provide an all-news service dedicated to the Montréal Region. The Commission also notes that this application is technically mutually exclusive with other applications scheduled at this hearing for the use of the 940 kHz frequency.

4. Montréal, Quebec
Radio Nord inc.

For a broadcasting licence to carry on an English-language AM (radio) programming undertaking with a country music format at Montréal, operating on a frequency of 940 kHz with a transmitter power of 50 000 watts during the day and night. 6. Montréal, Quebec
Canadian Broadcasting Corporation

For a broadcasting licence to carry on a French-language AM (radio) programming undertaking at Montréal, operating on a frequency of 690 kHz (channel 1-A) with a transmitter power of 50 000 watts day and night to provide an all-news radio service. It should be noted that the proposed undertaking at Montréal would become the mother station of the French-language all-news national radio network; for a broadcasting licence to carry on a French-language AM (radio) programming undertaking at Montréal, operating on a frequency of 940 kHz (channel 1-B) with a transmitter power of 50 000 watts day and night; and for a broadcasting licence to carry on a French-language all-news national radio network. The Commission notes that the 940 kHz frequency is requested by the applicant in the event that the 690 kHz is granted to another applicant. The Commission also notes that these applications are technically mutually exclusive with other applications scheduled at this hearing for the use of the 690 kHz and 940 kHz frequencies.

Ontario Region

7. Barrie, Ontario
Scott Jackson, on behalf of a company to be incorporated

For a broadcasting licence to carry on an English-language, not-for-profit, FM (radio) programming undertaking at Barrie, operating on a frequency of 100.3 MHz (channel 262B) with an effective radiated power of 1 800 watts. The applicant is proposing a Christian music service (speciality format) with at least 95 percent of the weekly total of music drawn from subcategory 34 (non-classic religious). The applicant is prepared to accept, as a condition of licence, that its level of advertising "will not exceed an average of four minutes per hour, or a maximum of six minutes in drive periods". The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

The Commission announces that it has approved, by Letter of Authority A98-0148 dated November 27, 1998, the transfer of control of Kennebec Vidéo inc., licensee of the cable distribution undertaking serving Linière, through the transfer of all of the shares of the licensee to Câble-Axion Québec inc. As a result of this change, effective control of Kennebec Vidéo inc. will be held by Câble-Axion Québec inc., a company ultimately controlled by Investissements Novacap inc.
