Health of Animals Fees Notice

EXPLANATORY NOTE

Notice Fixing the Fees Payable for Services, Rights, Privileges or Use of a Facility Provided under the National Animal Health Program

This notice fixes fees payable for services, rights, privileges or use of a facility provided under the National Animal Health Program.

The change is made in recognition of the powers given to the Minister of Agriculture and Agri-Food to fix fees under the Canadian Food Inspection Agency Act.

These fees replace those previously set out in the National Animal Health Program Cost Recovery Fees Order made under the Financial Administration Act as it was published on May 1, 1996, in the Canada Gazette, Part II, Vol. 130, No. 9, pages 1282 to 1287 inclusive, and on March 18, 1998, in the Canada Gazette, Part II, Vol. 132, No. 6, pages 860 to 879 inclusive.

The fees fixed in the current notice are identical to those that were put in place in the May 1, 1996, and March 18, 1998, Fees Orders except for two related changes:

Item 2, Part I, is amended to exempt importers that apply for the permit required in paragraph 22.12(3)(d) for the importation of "Restricted Feeders" from paying the fees required in:

— subitem 2(a) where an amendment to the regulations governing the importation of the animals in question has been completed in the last two years; and

— subitem 2(b) where an assessment of the risk of introducing disease was required and has been completed in the last two years.

Item 2, Part I, is amended by adding a fee of $1.50 per head for restricted feeder cattle imported under section 22.12 of the Regulations.

Item 1, Part II, is amended to ensure that the wording applies to the premises approval for restricted feeders. There is no change in cost. The change is to facilitate interpretation of the item.

As a result of the two related changes, item 2, Part I, as amended will read as follows (the underlined portion is the new wording):

2. In addition to the fee payable under item 1, if

(a) subject to paragraph (d), the conditions agreed to between Canada and the country of origin for the importation of an animal or thing require modification, or have been modified less than two years before the date on which the application referred to in item 1 is received, for the consideration of an application for an import permit

(i) for single use $65.00

(ii) for multiple use $115.00

(b) subject to paragraphs (c) and (d), an assessment of the risk of introducing disease is required with respect to an application referred to in item 1, or such an assessment has been completed and conditions for the importation were agreed to between Canada and the country of origin less than two years before the date on which the application is received, for the consideration of an application for an import permit

(i) for single use $1,000.00

(ii) for multiple use $1,250.00

(c) the applicant is an accredited institutional member of the Canadian Association of Zoological Parks and Aquariums, the application is for no more than six mammalian animals or animal embryos or for no more than twelve birds or hatching eggs, and an assessment of the risk of introducing disease is required with respect to the application referred to in item 1, or such an assessment has been completed and conditions for the importation were agreed to between Canada and the country of origin less than two years before the date on which the application is received, for the consideration of an application for an import permit

(i) for single use $300.00

(ii) for multiple use $450.00

(d) an application is for the permit required by paragraph 22.12(3)(d) of the Regulations for the import of restricted feeders, for each animal $1.50

This change was made at the request of the Canadian Cattlemen's Association (CCA). The CCA and the National Cattlemen's Association in the United States had expressed concern that the current fee structure would limit the purpose of the Northwest Cattle Project, which was to facilitate the freer movement of feeder cattle from the United States to Canada.

The fee per head was agreed to as a means of paying for the services provided by the Canadian Food Inspection Agency in relation to the importation of restricted feeder cattle, including the costs of amending the Health of Animals Regulations, preparing and updating risk assessments, negotiating conditions and protocols, and monitoring the cattle imported into Canada under each permit.

The Minister of Agriculture and Agri-Food, pursuant to subsection 24(1) and section 25 of the Canadian Food Inspection Agency Act, hereby fixes the fees that are payable for any service, right, privilege or use of a facility provided or granted under the Health of Animals Act or the Health of Animals Regulations, in accordance with the annexed Health of Animals Fees Notice.

ORDER PRESCRIBING THE FEES TO BE PAID BY USERS FOR SERVICES PROVIDED UNDER THE NATIONAL ANIMAL HEALTH PROGRAM

Short Title

1. This order may be cited as the Health of Animals Fees Notice.

Interpretation

2. (1) The definitions in this subsection apply in this Order.

"Act" means the Health of Animals Act. (Loi)

"Agency" means the Canadian Food Inspection Agency established by section 3 of the Canadian Food Inspection Agency Act. (Agence)

"certification" means the signing by an inspector of a document authorizing an activity or attesting to the validity of information, no matter who prepared the document. (certification)

"commercial grade beef cattle" means cattle that are used primarily to produce meat, other than cattle that are purebred within the meaning of section 2 of the Animal Pedigree Act. (bœufs commerciaux sans race)

"import permit" means a permit for the purpose of the importation of animals or things that is issued by the Minister under section 160 of the Regulations. (permis d'importation ou licence d'importation)

"pet bird" means a pet bird that is imported from a country other than the United States under a permit issued pursuant to section 10 of the Regulations. (oiseau de compagnie)

"private quarantine facility" means a quarantine facility that is not a quarantine station. (installation de quarantaine privée)

"quarantine station" means a quarantine facility operated by the Agency. (station de quarantaine)

"Regulations" means the Health of Animals Regulations. (Règlement)

"related costs" means the costs of transportation, accommodation and meals and incidental and other expenses relating to the provision of a service, in an amount determined in accordance with the Treasury Board Travel Directive, as amended from time to time. (frais afférents)

"shipment" means one or more animals or things that are imported by one person at one port of entry in one vehicle at one time and, if a licence for the removal of an animal or thing has been issued under the Regulations or under an import permit, that are shipped to one destination. (expédition)

(2) Unless otherwise provided in this Order, other words and expressions have the same meanings as in the Act and the Regulations.

Fees

3. The fee that is payable in respect of a service set out in column I of an item of the schedule is the fee set out in column II of that item, and shall be paid at the time the service is requested.

5. (1) Subject to subitem (2), for services provided to an air or marine carrier respecting any animal or thing presented by the carrier under section 16 of the Act, including the control of international garbage, the review of manifests and an inspection,

  (a) for an aircraft entering Canada 25.00

(i) for the first manifest for the ship,
 
 
(A) if the manifest is provided to an inspector in an electronic format that is approved by Revenue Canada, at least one working day before the arrival of the ship

(iii) is operating exclusively in Canadian and American waters and, since it last left a port other than a Canadian or American port, has been inspected and certified by the appropriate Canadian or American officials as having no food or ship's refuse that originates in a country other than Canada or the United States, or contains food or ship's refuse that is approved by the Agency or the United States Department of Agriculture for uncontrolled entry into Canada or the United States, or
 
 
(iv) is operated by the armed forces of a country that, under an agreement with the Department of National Defence, is exempted from payment of the fees in respect of its military ships.
 
6. (1) In addition to any fee payable under this Part, for the inspection of an animal or thing, if the animal or thing is inspected at a place outside Canada or mainland United States, including Alaska, for the purpose of importing the animal or thing into Canada, for each day or part of a day during which the inspector is outside Canada
