CANADIAN ENVIRONMENTAL PROTECTION ACT

Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-03210 is approved.

1. Permittee: Westview Dredging Ltd., Richmond, British Columbia.

2. Type of Permit: To dump or load dredged material.

3. Term of Permit: Permit is valid from November 25, 1998, to November 24, 1999.

4. Loading Site(s):

(a) Various approved sites on the northeast portion of Vancouver Island at approximately 50°38.00' N, 127°10.00' W; and

(b) Various approved sites on the northern Strait of Georgia, Discovery Passage, and Malaspina Strait at approximately 50°05.00' N, 125°17.50' W.

5. Dump Site(s):

(a) Malcolm Island Disposal Site: 50°42.00' N, 127°06.00' W, at a depth of not less than 180 m;

(b) Hickey Point Disposal Site: 50°27.80' N, 126°04.80' W, at a depth of not less than 270 m;

(c) Hanson Island Disposal Site: 50°33.50' N, 126°48.00' W, at a depth of not less 350 m;

(d) Cape Mudge Disposal Site: 49°57.70' N, 125°05.00' W, at a depth of not less than 200 m;

(e) Malaspina Strait Disposal Site: 49°45.00' N, 124°27.00' W, at a depth of not less than 320 m; and

(f) Kingcone Inlet Disposal Site: 50°55.00' N, 126°13.00' W, at a depth of not less than 125 m.

The following position-fixing procedures must be followed to ensure disposal at the designated dump site:

(i) The vessel must call the Vancouver Vessel Traffic Management (VTM) Centre on departure and inform VTM that it is heading for a disposal site;

(ii) Upon arrival at the disposal site, and prior to dumping, the vessel must again call VTM to confirm its position. Dumping can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, VTM will direct it to the site and advise that dumping can proceed; and

(iii) The vessel must inform VTM when dumping has been completed prior to leaving the disposal site.

6. Route to Dump Site: Direct.

7. Method of Loading and Dumping: Loading by clamshell dredge or pipeline (cutter suction) with disposal by hopper barge, or by end dumping.

8. Rate of Dumping: As required by normal operations.

9. Total Quantity to be Dumped: Not to exceed 200 000 m3.

10. Material to be Dumped: (1) Silt, sand, rock, wood wastes and other materials typical of the approved loading site except logs and usable wood; and (2) Broken concrete slabs and non-usable concrete and/or steel piling.

11. Requirements and Restrictions: The Permittee must notify the permit issuing office in writing and receive written approval for each loading site site prior to any loading or dumping. The written notification must include the following information:

(i) the co-ordinates of the proposed loading site;

(ii) a site map showing the proposed loading site relative to known landmarks or streets;

(iii) a figure showing the legal water lots impacted by the proposed dredging/loading activities, giving the spatial delineations of the proposed dredge site within these water lots;

(iv) all analytical data available for the proposed loading site;

(v) the nature and quantity of the material to be loaded and dumped;

(vi) proposed dates on which the loading and dumping will take place; and

(vii) a site history for the proposed loading site.

Additional sampling or analytical requirements may be specified by the permit issuing office.

The Permittee must ensure that all contractors involved in the loading or dumping activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in ocean disposal activities. A copy of the written approval for the appropriate loading site must be displayed with copies of the permit posted at the loading sites.

Contact must be made with the Canadian Coast Guard regarding the issuance of a "Notice of Shipping". The Permittee should contact the District Manager, Vessel Traffic Services, Canadian Coast Guard, Kapilano 100 Building, Room 1205, 100 Park Royal S, West Vancouver, British Columbia V7T 1A2, (604) 666-8453 (Facsimile).

Any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act shall be permitted to mount an electronic tracking device on any vessel that is engaged in the ocean disposal activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an inspector or by a person with the written consent of an inspector.

The Permittee must submit to the Regional Director, Environmental Protection, Pacific and Yukon Region, within 10 days of the end of each month, the quantity of material disposed of from each excavation site pursuant to the permit.

The Permittee must submit to the Regional Director, Environmental Protection, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of from each site, and the dates on which the activity occurred.

(c) Five Finger Disposal Site: 49°15.20' N, 123°54.60' W, at a depth of not less 280 m;

(d) Porlier Pass Disposal Site: 49°00.20' N, 123°29.80' W, at a depth of not less than 200 m;

(e) Victoria Disposal Site: 48°22.30' N, 123°21.80' W, at a depth of not less than 90 m;

(f) Haro Strait Disposal Site: 48°41.00' N, 123°16.40' W, at a depth of not less than 200 m; and

(g) Watts Point Disposal Site: 49°38.50' N, 123°14.00' W, at a depth of not less than 230 m.

RADIOCOMMUNICATION ACT

Notice No. SMSE-12-98 — Interference-causing Equipment Standard (ICES)

Notice is hereby given that Industry Canada is releasing the following document for public comment:

ICES-004 Interference-Causing Equipment Standard for Alternating Current High Voltage Power Systems ICES-004, Issue 2 — Draft.

This draft standard was prepared in response to the promulgation of the Radiocommunication Regulations, under which it is to be designated as a Category II Equipment Standard. Aside from this, no substantive changes from the current ICES-004, Issue 1 are introduced in this draft 2nd issue.

In accordance with section 20 of the Radiocommunication Regulations, the Category II Equipment Standards List is published in the Canada Gazette, Part I, and provides a list of all technical standards applicable to interference-causing equipment. The effective date of the above standard will be the publication date of the amended list which will include this standard. Compliance with a listed standard is required in accordance with the Radiocommunication Regulations.

This notice is made pursuant to and subject to the Canada-Newfoundland Atlantic Accord Implementation Act, S.C., 1987, c. 3, and the Canada-Newfoundland Atlantic Accord Implementation Newfoundland Act, R.S.N., 1990, c. C-2.
