Year 2000 Challenge: Meeting Regulatory Requirements

As the millennium approaches, it is becoming clearer to both the public and private sectors that the Year 2000 problem is now the business issue facing almost all large organizations. It is also a serious concern to most small organizations.

The Year 2000 problem refers to the potential for computer error and failure due to the past practice of using two digits to represent the year in a date code. On January 1, 2000, many computer systems will add 1 to 99, and roll over to 00. Errors and outright failure (system crash) are possible as computers run into logic problems when attempting to carry out calculations involving 00. The fact that 2000 is a leap year further complicates matters.

The Year 2000 problem is a global issue, impacting everything from order-tracking systems, to industrial process control, to cash registers. As the millennium approaches, time is running out and the resources required to identify and repair all of the non-compliant systems are becoming increasingly scarce. The focus today is shifting from what the problem is, to who is prepared. Investors, suppliers and customers all want to know: how well prepared are you?

The Government of Canada is making every effort to ensure that the safety and well-being of Canadians will not be at risk as the result of Year 2000-related computer problems. Environment Canada has recognized Year 2000 compliance as its top management priority and has put in place a process with a view to achieving compliance.

In line with Environment Canada's responsibility to protect Canada's environment, we are making an effort to contact all organizations within regulated industries falling under federal jurisdiction. Environment Canada expects all regulated industries to act responsibly concerning Year 2000 issues. This includes taking proactive action to ensure that Year 2000-related operational problems do not result in contravention of federal statutes or regulations. An organization's failure to become Year 2000-compliant in time to prevent malfunctioning will not be acceptable as justification for being in contravention.

The consequences of a Year 2000 system failure could be devastating for the environment. Among the most serious implications is the potential for environmental damage due to the failure of control systems. Industrial process-control failures could result in the release of toxic substances into the environment. Failures like these are literally embedded in systems in operation around the world, and they will happen if Year 2000 issues are ignored.

It is our hope that your organization's Year 2000 plan is in place and that work is proceeding on schedule. If this is the case, congratulations on your foresight and good work, and we urge you to share your success within your industry. Response Organizations Standards — 1995

The Minister of Fisheries and Oceans, pursuant to subsection 660.8(3) of the Canada Shipping Act, hereby gives notice that he has issued amendments to the Response Organizations Standards — 1995.

The proposed amendments were published in the Canada Gazette, Part I, on August 22, 1998, pursuant to subsection 660.8(1) of the Canada Shipping Act, and an opportunity was given to interested persons to make representations within 30 days. No representations were made during those 30 days.

PROPOSED CANADA SMALL BUSINESS FINANCING ACT

Proposed Canada Small Business Financing Regulations

On September 23, 1998, the Minister of Industry introduced Bill C-53, the Canada Small Business Financing Act (CSBFA), which will continue to help small and medium enterprises (SMEs) obtain access to a guarantee on a loan of up to $250,000 to finance purchase, construction or improvement of real property or equipment or make leasehold improvements to business premises. These basic parameters of the Program are not changed from those of the Small Business Loans Program (SBL).

Industry Canada is currently developing a new regulatory regime pursuant to Bill C-53. Many of the administrative details found in the Small Business Loans Act have been shifted to the preliminary regulations. The draft regulations respond to a number of the issues raised during the comprehensive review of the SBL Program. They include a clearer definition of "related borrowers", who, collectively, would be limited to a loan of $250,000 under the Program. Financing of existing leasehold improvements and non-arm's length purchases of going concerns would not be eligible, and lenders would be required to apply the same degree of due diligence in loan approval. The 1.25 percent administration fee would be remitted more frequently rather than annually. Other proposed changes to the regulations include greater information on the loan Application/Registration form, and improved security requirements under specific conditions such as franchises. The lender would continue to have 36 months to file a claim; however, they would only receive full interest on the first year and half interest on the second year. In addition, the proposed regulations are introducing interim claim payments for lenders if a guarantee has been provided and if the lender has realized on all security except for the guarantee. Ministerial authority for correcting inadvertent errors by lenders would be increased.

This new regime will consolidate all of the administrative detail currently divided between the Small Business Loans Act and its associated regulations into the proposed Canada Small Business Financing Regulations.

The bill and related regulations are based on extensive stakeholder consultations with borrowers and lenders. Industry Canada will produce a preliminary draft of these regulations for the information of the House of Commons Standing Committee on Industry and the Standing Senate Committee on Banking, Trade and Commerce. While this preliminary draft will be available for consultation, the Department intends to release draft regulations for pre-publication comment, should the bill be adopted by Parliament.

Notice No. SMSE-009-98 — Redeployment Plan for Spectrum-Efficient Land Mobile Equipment in the Frequency Range 100-500 MHz (RDP 100-500 MHz)

In view of the limited availability of radio frequency spectrum in the land mobile bands between 100 and 500 MHz in large urban areas of the country, the Department of Industry initiated in April 1995 a process leading to a change in the spectrum management framework. This change, referred to as redeployment, or sometimes as refarming, will facilitate the introduction of more spectrum efficient equipment and systems, leading to increased overall traffic capacity of the bands, as part of long term solutions in meeting mobile spectrum needs.

The changes to the spectrum management framework that are presented in the redeployment plan follow the guiding principles established in the Spectrum Policy 30-896 MHz, Part II, issued in April 1995, and the consultation with the Radio Advisory Board of Canada. The Department will use several spectrum management tools, including policy, equipment certification and authorization provisions, to achieve the redeployment objectives. Also, the plan provides incentives for voluntary early deployment of more spectrum-efficient technologies, i.e., based on demonstrated need, applicants will be able to use a portion of the spectrum that is freed up through early deployment. The Department also foresees that when the new licence fee model is implemented, using more spectrum-efficient equipment may result in some reduction in licence fees. In addition, the plan is scheduled according to a time-frame in two phases, to allow graceful migration to more spectrum-efficient technologies.

The provisions of the redeployment plan will be applicable within congested areas, i.e., areas of intensive mobile use, where applicants are denied access to spectrum. These provisions may also be applied to assignments in areas surrounding the congested areas if they are expected to impact the availability of spectrum within the congested areas. The frequency bands to which this plan applies are the Land Mobile Service bands in the range 100-500 MHz. A list of the specific bands is provided in the redeployment plan.

TELECOMMUNICATIONS ACT AND RADIOCOMMUNICATION ACT

Notice No. SMSE-011-98

On May 14, 1998, Canada and the European Commission signed a Mutual Recognition Agreement aimed at reducing technical barriers to trade in a wide range of products. The Agreement covers the following sectors: telecommunications products, medical devices, pharmaceutical products, recreational boats, electric goods and electromagnetic compatibility (EMC). Under the Agreement, European regulators would permit Canadian organizations to carry out inspection, testing and product approvals to European requirements and vice versa. This agreement ensures that domestic regulations do not emerge as the main barrier to bilateral Canada-European Union trade.

The overall authority for the implementation of this agreement rests with the Department of Foreign Affairs and International Trade. Industry Canada will manage the implementation of the Telecom and EMC sectoral annexes. The Telecom sectoral annex includes telecommunications terminal equipment, information technology equipment and radio transmitters. During an 18-month transition phase, to commence November 1, 1998, each party will accept test reports from the exporting party's testing laboratories that have been designated by the exporting party to the importing party's requirements. Upon successful completion of the transition phase, each party will accept product certification from the exporting party's certification bodies that have been designated by the exporting party to the importing party's requirements.

To facilitate the implementation of those topics in this agreement under Industry Canada's responsibility, each party will sponsor one seminar concerning technical regulations and conformity assessment procedures for telecommunications terminal equipment, radio transmitters, information technology equipment and EMC. The seminar given by European Union officials and representatives will take place in the spring of 1999, in North America.

As part of the transition phase Industry Canada will designate Canadian testing laboratories which qualify to test to European requirements.

SPECIAL IMPORT MEASURES ACT

Filter Tipped Cigarette Tubes — Decision

On October 19, 1998, pursuant to subsection 31(1) of the Special Import Measures Act, the Deputy Minister of National Revenue initiated an investigation respecting the alleged injurious dumping into Canada of filter tipped cigarette tubes, excluding those which bear the trademark or brand name of a finished or ready-made cigarette, originating in or exported from France and the Federal Republic of Germany. The goods in question are classified under the Harmonized System tariff number 4813.10.00.00.

Information

Interested parties are invited to file written submissions presenting facts, arguments, and evidence which they feel are relevant to the alleged dumping and/or injury. Written submissions should be forwarded to Mr. Jan Smith, Anti-dumping and Countervailing Directorate, 191 Laurier Avenue W, Ottawa, Ontario KlA 0L5, (613) 954-7409 (Telephone), (613) 954-2510 (Facsimile). To be given consideration in this investigation, all such information should be received by December 4, 1998.

Any information submitted to Revenue Canada by interested parties concerning this investigation is deemed to be public information unless clearly marked confidential. Where the submission by an interested party is confidential, a non-confidential edited version of the submission must also be provided which will be disclosed to other interested parties upon request.

A statement of reasons explaining this decision has been provided to persons directly interested in these proceedings. A free copy may be obtained by contacting the officer named above.
