Special Arrangement — Radioactive Material — Package and Shipment
Pursuant to section 4 of the Transport Packaging of Radioactive Materials Regulations, the Atomic Energy Control Board issued the authorization numbered CDN/5211/X (Rev. 0) on September 3, 1998, to MDS Nordion International authorizing the transportation of radioactive material in a packaging that does not conform to the requirements of these Regulations. The reasons for issuing this authorization were:
1. conformity with some of the requirements of these Regulations would be impractical; and
2. the terms and conditions of the authorization ensure a level of health and safety during transport at least equivalent to that which would exist if the packaging conformed to the applicable requirements of these Regulations.

COMMENCEMENT OF INVESTIGATION
Jacquard Circular Weft-knit Fabric
Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the request (Request No. TR-98-002) received from Distex Inc. (the requester) of Saint-Laurent, Quebec, is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of Jacquard circular weft-knit fabric, certified by the exporter that the fabric has been knit on a Jacquard loom, solely of cotton, mercerized, of yarns of different colours, of a weight of 100 g/m2 or more but not exceeding 200 g/m2, of subheading No. 6002.92, for use in the manufacture of golf jerseys (the subject fabric).
The Tribunal will conduct an investigation under section 19 of the Canadian International Trade Tribunal Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabric, which is classified in subheading No. 6002.92.
The Tribunal's investigation was commenced on September 28, 1998, and will be conducted by way of written submissions. To participate in the Tribunal's investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before October 23, 1998. The Tribunal's recommendations to the Minister of Finance are scheduled to be issued by January 26, 1999.

REVIEW OF FINDING
Synthetic Baler Twine
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76(2) of the Special Import Measures Act, review its finding made on April 22, 1994, in Inquiry No. NQ-93-003, concerning synthetic baler twine with a knot strength of 200 lbs or less, originating in or exported from the United States of America (Review No. RR-98-003).
Notice of Expiry No. LE-98-002 informed interested persons and governments of the impending expiry of the finding. On the basis of representations requesting the initiation of a review received by the Tribunal in reply to the notice, the Tribunal is of the opinion that a review of the finding is warranted.
Letters have been sent to parties with a known interest in the review providing the schedule for the review. The schedule specifies, among other things, the date for the filing of replies to Tribunal questionnaires, the date on which information on the record will be made available by the Tribunal to interested parties and counsel that have filed notices of appearance and the dates for the filing of submissions by interested parties.
Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why the information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.
Public Hearing
A public hearing relating to this review will be held in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing on February 9, 1999, at 9:30 a.m., to hear evidence and representations by interested parties.
Each interested person or government wishing to participate at the hearing as a party must file a notice of appearance with the Secretary on or before October 30, 1998. Each counsel who intends to represent a party at the hearing must file a notice of appearance as well as a declaration and undertaking with the Secretary on or before October 30, 1998.

Television Northern Canada Incorporated (TVNC)
For a broadcasting licence to operate a national Aboriginal television programming network, to be called Aboriginal Peoples Television Network, upon surrender of the current licences issued to TVNC. The network would broadcast programs in English and French as well as in Aboriginal languages, directed to aboriginal and non-aboriginal persons in both the north and south of Canada and would be distributed by satellite.
The applicant also requests that its programming service be distributed on a mandatory basis as part of the basic service by Class 1 and 2 distribution licensees (such as cable) pursuant to subsection 17(5) of the Broadcasting Distribution Regulations (the Regulations) and by DTH distribution undertakings pursuant to subsection 37(b) of the Regulations. In the case of Class 3 terrestrial distribution undertakings, the applicant is proposing that the service be optional to basic.
The Commission notes that paragraph 9(1)(h) of the Broadcasting Act reads as follows:
9. (1) Subject to this Part, the Commission may, in furtherance of its objects,
...
(h) require any licensee who is authorized to carry on a distribution undertaking to carry, on such terms and conditions as the Commission deems appropriate, programming services specified by the Commission.
The Commission invites interested parties to comment on the possibility of reliance on this paragraph of the Broadcasting Act to achieve the aims of the applicant, should the Commission approve the application.
The applicant is proposing a maximum monthly per-subscriber fee of $0.15; and that the proposed service would continue to be free of charge in those 96 communities which currently receive TVNC via local low power transmitters.
Since the proposed service includes TVNC's existing services, approval of this application would eliminate the need to consider the renewal of TVNC's current licences.
Comments on this matter may be filed, along with any other comments, on or before the intervention date set out in Notice of Public Hearing 1998-6, that is, October 19, 1998.

PUBLIC HEARING 1998-7
The Commission will hold a public hearing commencing on December 7, 1998, at 9 a.m. (Issue No. 1), at the Guy-Favreau Complex, 200 René-Lévesque Boulevard W, Montréal, Quebec, to consider the applications which are listed in the body of this notice.
The public hearing process for the competitive applications will consist of four phases. During Phase I, representatives for each item on the agenda will make a presentation of their applications. Representatives for each item published herein will be permitted a maximum of 20 minutes for presentation at the public hearing. In the decision, the Commission mentioned that the administrative renewal of the licence did not in any manner dispose of the licence renewal application, nor any relevant matters before the Commission in connection with this application and, consequently, it is scheduling this application at the December 7, 1998, public hearing. The Commission provides notice to the licensee that it wishes to discuss at the hearing the interventions received and the complaints contained in the public record pertaining to CKVL. The Commission will also wish to discuss the appropriateness of imposing, as a condition of licence, that the licensee abide by its policy regarding open-line programming (Public Notice CRTC 1988-213), as well as any other suitable conditions. It should be noted that only the interventions already received, accepted and filed on the public file will be considered by the Commission in its study of this application. Finally, the Commission notes the apparent failure of the licensee to comply with subsection 2.2(5) of the Radio Regulations, 1986 concerning the broadcast of French-language vocal music.

New Media — Call for Comments: Public Hearing Schedule
1. On July 31, 1998, the Commission issued Broadcasting Public Notice CRTC 1998-82 and Telecom Public Notice 98-20, in which it announced a call for comments relating to new media. The Commission also established the dates set out below for the filing of written submissions, commencement of the associated public hearing, and the submission of final written arguments.
Deadlines for submission of written comments: First Phase: October 1, 1998; Second Phase: October 21, 1998.
Date of Public Hearing: November 23, 1998, to December 4, 1998.
Deadline for submission of written final arguments: January 15, 1999.
2. Given the extensive information that the Commission expects to receive in this proceeding, it has decided to provide additional time for the preparation and filing of submissions in the second phase of the written comment process. In order that issues and information identified at the oral public hearing may be further explored with participants, the Commission has also made provision for an oral final argument phase to enable parties to present summaries of their written final arguments and allow further questioning by the panel.
3. The revised public hearing schedule is as follows:
