6. Route to Dump Site(s): Not applicable.

7. Equipment: Steel beam or scraper blade.

8. Method of Dumping: Levelling of the seabed by a steal beam or a scraper blade. Levelling operations must conform to the "Addenda no 1, projet no 704863, Québec, le 1998-02-05" prepared by the Department of Public Works and Government Services, Quebec Region.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 500 m3 place measure.

11. Material to be Dumped: Dredged material consisting of sand, silt, clay and colloids, and gravel.

12. Requirements and Restrictions: It is required that the Permittee report in writing to the Regional Director, Environmental Protection, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, at least 48 hours prior to the first levelling operation pursuant to this permit.

The Permittee shall submit a written report to the Regional Director within 30 days of the the expiry of the permit. This report shall contain the following information: the quantity and type of material displaced pursuant to the permit, the equipment used, the area levelled, as well as the dates and times on which the levelling operations occurred.

During levelling operations and for a minimum period of six hours after each levelling operation has been completed, a protective screen shall be deployed in a manner that seals the entrance to the harbour and prevents any dispersion of suspended materials outside the commercial basin. The characteristics of the protective screen must conform to the requirements set out in the "Addenda no 1" cited in condition 8 of this permit.

During levelling, the speed of the the steel beam or scraper blade must not exceed two knots, and the levelling will proceed from the south end to the north end of the commercial basin.

In the event that the protective screen becomes ineffective to retain suspended material in the interior of the commercial basin, levelling operations will be immediately halted and may not recommence until after a minimum period of six hours and until adequate measures have been taken to prevent the dispersion of any suspended material outside the commercial basin.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

The Permittee must ensure that any contractors taking part in loading or dumping operations under this permit are informed of its restrictions and conditions as well as the possible consequences for their violation.

A copy of this permit must, at all times, be kept aboard any vessel involved in the levelling operations.

The Permittee must complete the Registry of Ocean Dumping Operations as provided by the Department of the Environment. This registry must, at all times, be kept aboard the vessel involved in the levelling operations and be accessible to inspectors designated under the Canadian Environmental Protection Act.

The loading or ocean dumping referred to under this permit shall not be carried out without written authorization from the Permittee.

3. Term of Permit: Permit is valid from September 21 to October 30, 1998.

4. 5. Dump Site(s): 46°13.60' N, 63°07.08' W (NAD83), Charlottetown Harbour, as described in Figure 2.2.2 Proposed Disposal Area (June 29/98) submitted in support of the permit application.

6. Route to Dump Site(s): Most direct navigational route from the dredge sites to the dump site.

7. Equipment: Clam dredge, backhoe, excavator and towed or self-propelled barges.

8. Method of Dumping: All dumping shall occur in accordance with the Environmental Protection Plan required in paragraph 12.5.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 40 000 cubic metres scow measure.

11. Material to be Dumped: Dredged material consisting of gravel, sand, silt and clay.

12. Requirements and Restrictions:

12.1. It is required that the Permittee notify in writing, by facsimile or electronic mail, Mr. Adrian MacDonald, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, (902) 426-3897 (Facsimile), adrian.macdonald@ec.gc.ca (Electronic mail), at least 48 hours prior to each occasion that dredging equipment is mobilized to the loading site. The notification shall include the equipment to be used, contractor, contact for the contractor, and expected period of dredging.

12.2. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the loading and dumping activities occurred.

12.3. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The Permittee shall notify in writing Mr. Leaming Murphy, Department of Fisheries and Oceans, P.O. Box 1236, Charlottetown, Prince Edward Island C1A 7M8, (902) 566-7848 (Facsimile), at least 48 hours prior to the commencement of the first dredging operation to be conducted under this permit.

12.5. An Environmental Protection Plan designed to address concerns relating to shellfish and other fisheries resources, wildlife, navigation, gear conflicts, and spill prevention shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1. The plan shall be approved by Environment Canada prior to the commencement of the first dredging operation to be conducted under this permit.

12.6. Any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act shall be permitted to mount an electronic tracking device on any vessel engaged in loading and dumping activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall only be removed with the written consent an inspector.

12.7. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.8. The dredging and ocean dumping authorized by this permit shall only be carried out by the Permittee or by any person with written approval from the Permittee.

2. Type of Permit: To dump and load dredged material.

3. Term of Permit: Permit is valid from September 21, 1998, to September 20, 1999.

4. Loading Site(s): 46°33.63' N, 63°41.05' W, entrance channel to Darnley Basin, as described in aerial photograph "Malpeque Cove, PEI, 1990" submitted in support of the permit application.

5. Dump Site(s): 46°33.66' N, 63°40.96' W (NAD83), Darnley Basin Channel, as described in aerial photograph "Malpeque Cove, PEI, 1990" submitted in support of the permit application.

6. Route to Dump Site(s): Suction dredge: via pipeline. Crane and excavator: sidecasting.

7. Equipment: Suction dredge, pipeline and barge-mounted crane or excavator.

8. Method of Dumping: Suction dredge: via pipeline. Barge-mounted crane or excavator: sidecasting.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 12 000 m3 place measure.

11. Material to be Dumped: Dredged material consisting of gravel, sand, silt and clay.

12. Requirements and Restrictions:

12.1. 12.5. The Permittee shall restrict dredging activities to outgoing tides.

12.6. The Permittee shall ensure that all project vessels have properly operating mufflers.

12.7. The Permittee shall ensure that project vessels not approach concentrations of sea ducks or waterfowl when anchoring equipment, accessing wharves, or ferrying supplies.

12.8. The Permittee shall ensure that piping plover breeding areas (the beaches of Cabot Provincial Park, Darnley Point and Hog Island) are not disturbed by dredge crews or equipment from April 15, 1999, to August 30, 1999.

12.9. The Permittee shall ensure that a spill contingency plan is in effect prior to dredging.

12.10. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.11. The dredging and ocean dumping authorized by this permit shall only be carried out by the Permittee or by a person with written approval from the Permittee.

CANADA PENSION PLAN

In accordance with subsection 111(3) of the Canada Pension Plan, notice is hereby given that, pursuant to subsection 111(2), the Minister of Finance has fixed an interest rate of 5.63 percent as applicable in the case of any obligation described in subsection 111(1) having a term to maturity of 20 years that is offered by a province for purchase by the Minister of Finance during the period commencing October 1, 1998, and ending October 10, 1998.

Please note that this rate is subject to change pending final approval of legislation to amend the Canada Pension Plan and to establish the Canada Pension Plan Investment Board.

CANADA SHIPPING ACT

Western Canada Marine Response Corporation

Notice is hereby given, pursuant to subsection 660.4(3) of the Canada Shipping Act that on August 27, 1998, the following list of proposed amended fees was filed with the Canadian Coast Guard:

Notice of fees for an arrangement with Western Canada Marine Response Corporation (WCMRC) required by paragraphs 660.2(2)(b) and 660.2(4)(b) of the Canada Shipping Act (the "Act").

Description

Western Canada Marine Response Corporation has applied for a certificate of designation as a response organization pursuant to subsection 660.4(1) of the Act in respect of a rated capability of 10 000 tonnes and a geographic area covering the waters bordering British Columbia (including the shorelines associated with such waters) and excluding waters north of the 60° N latitude.

Definitions

In this notice of fees:

"Act" means the Canada Shipping Act. (Loi)

"asphalt" means a derivate of oil that is commercially described as road or paving asphalt or unblended roofers flux, that has a specific gravity equal to or greater than one, that is solid at 15 degrees Celsius and that sinks to the bottom as a solid when immersed in water. (asphalte)

"BOCF" means bulk oil cargo fee. (Droits sur les produits pétroliers en vrac (DCPV))

"designated oil handling facility" means an oil handling facility that has been designated pursuant to subsection 660.2(8) of the Act and is within the geographic area for which WCMRC has been issued a certificate of designation. (installation agréée de manutention d'hydrocarbures)

"geographic area" means the geographic area for which WCMRC has been issued a certificate of designation. (zone géographique)

"ship (bulk oil)" means a ship that is constructed or adapted primarily to carry bulk oil in its cargo spaces. (navire (avec produits pétroliers en vrac))

"ship (non-bulk oil)" means a ship that does not carry bulk oil as cargo. (navire (sans produits pétroliers en vrac))

"WCMRC" means Western Canada Marine Response Corporation. (WCMRC)

Registration Fee

The annual registration fee in relation to each arrangement with WCMRC is four hundred and fifty dollars ($450) plus all applicable taxes.

Bulk Oil Cargo Fees

In relation to an arrangement with WCMRC, a BOCF is payable by a designated oil handling facility on the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of the 60° N latitude) loaded at the designated oil handling facility.

In relation to an arrangement with WCMRC, a BOCF is payable by a ship (bulk oil) on:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of the 60° N latitude, the total number of tonnes of bulk oil loaded at an oil handling facility that is within WCMRC's geographic area and that does not have an arrangement with WCMRC;

(b) in the case of bulk oil unloaded from the ship (bulk oil), the total number of tonnes of bulk oil unloaded at an oil handling facility that is within WCMRC's geographic area and that does not have an arrangement with WCMRC;

(c) the total number of tonnes of bulk oil loaded onto the ship (bulk oil) outside WCMRC's geographic area which is transferred within WCMRC's geographic area to another ship for use as fuel by such ship; and

(d) the total number of tonnes of bulk oil received by the ship (bulk oil) within WCMRC's geographic area from another ship as cargo where such bulk oil is intended for international destinations and destinations north of the 60° N latitude.

The BOCF in respect of oil (other than asphalt) is:

(a) ninety-four and one-tenths cents ($0.941) per tonne, plus all applicable taxes, from the date of publication in the Canada Gazette to December 31, 1998; and

(b) an amended fee of ninety and nine-tenths cents ($0.909) per tonne, plus all applicable taxes, from January 1, 1999.

The BOCF in respect of asphalt is:

(a) forty-seven and one-tenths cents ($0.471) per tonne, plus all applicable taxes, from the date of publication in the Canada Gazette to December 31, 1998; and

(b) an amended fee of forty-five and five-tenths cents ($0.455) per tonne, plus all applicable taxes, from January 1, 1999.
