CANADIAN NIAGARA POWER COMPANY, LIMITED

APPLICATION TO REHABILITATE AND OPERATE AN INTERNATIONAL POWER LINE TO NIAGARA MOHAWK POWER CORPORATION OF THE UNITED STATES

Notice is hereby given that by an application dated September 8, 1998, Canadian Niagara Power Company, Limited ("the Applicant") has applied to the National Energy Board ("the Board") under Part III.1 of the National Energy Board Act ("the Act") for authorization to rehabilitate and operate an international power line. One circuit of the line would be a 115 000 volt circuit operating at 60 Hz; the other would have nominal voltage of 40 600 operating at 25 Hz. The line would extend a distance of approximately 4 kilometres from the Applicant's Station 18 located at Fort Erie, Ontario, to a point on the international boundary on the Niagara River. The 115 000 volt circuit will be constructed in accordance with the terms of a contrat between the Applicant and Niagara Mohawk Power Corporation executed on March 25, 1998.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 1130 Bertie Street, P.O. Box 1218, Fort Erie, Ontario L2A 5Y2, (905) 871-0330 (Telephone), (905) 871-8676 (Facsimile), and provide a copy of the application to any person who requests a copy. A copy of the application is also available for viewing during normal business hours in the Board's library, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8.

2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, (403) 292-5503 (Facsimile), and the Applicant by October 30, 1998.

3. Pursuant to subsection 58.14(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submittors with respect to:

(a) the effect of the power line on provinces other than those through which the line is to pass; and

(b) the impact of the construction or operation of the power line on the environment.

4. As part of its consideration of the environmental effects of the proposed facilities, the Board will apply the Canadian Environmental Assessment Act ("the CEAA"). The Board will ensure that there is no duplication in requirements under the CEAA and the Board's own regulatory process.

5. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by November 16, 1998.

6. Any reply that submittors wish to present in response to item 5 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the Applicant by November 30, 1998.

CANADIAN PACIFIC RAILWAY COMPANY

Three-Year Rail Network Plan, 1998-2001

Pursuant to section 141 of the Canada Transportation Act, Canadian Pacific Railway Company (CPR) has updated its Three-Year Rail Network Plan.

Contents of Network Plan

This Plan consists of two schedules:

Schedule A is a comprehensive list of all lines indicating whether within the next three years CPR intends to transfer the line or its operating interest in the line, or to take steps to discontinue operating the line.

Schedule B is comprised of a schematic map which is not to scale. It is included to illustrate graphically CPR's rail network and to provide general information only about CPR's Network Plan.

Explanation of Terms and Timing

The following is an overview of terms used in this Network Plan:

1. To Continue Operation:

CPR intends to continue operation of these lines.

2. To Transfer:

A line, or the CPR's operating interest in the line, designated "To Transfer" may be sold, leased or otherwise transferred.

3. To Discontinue:

A line designated as "To Discontinue" means that CPR intends to discontinue operating the line if it is not transferred.

Plan Updates

The Three-Year Rail Network Plan may be updated at any time.

Posting

This plan will be published in the Canada Gazette and, as a result, the plan will be available nationally in depository libraries.
