Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) is satisfied that the requests (Request Nos. TR-97-017 and TR-97-018) received from Helly Hansen Canada Limited (the requester) of Dartmouth, Nova Scotia, are properly documented. FINDING
Stainless Steel Round Bar
In the matter of an inquiry, under section 42 of the Special Import Measures Act respecting stainless steel round bar of sizes 25 mm diameter up to 570 mm diameter inclusive, originating in or exported from the Federal Republic of Germany, France, India, Italy, Japan, Spain, Sweden, Taiwan and the United Kingdom.
The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-98-001) following the issuance by the Deputy Minister of National Revenue of a preliminary determination of dumping dated May 7, 1998, and of a final determination of dumping dated August 5, 1998, respecting the importation into Canada of stainless steel round bar of sizes 25 mm diameter up to 570 mm diameter inclusive, originating in or exported from the Federal Republic of Germany, France, India, Italy, Japan, Spain, Sweden, Taiwan and the United Kingdom.
Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping in Canada of the aforementioned goods originating in or exported from the Federal Republic of Germany, France, India, Italy, Japan, Spain, Sweden, Taiwan and the United Kingdom has caused material injury to the domestic industry, excluding:
(1) stainless steel round bar made to specifications ASN-A3380 and ASN-A3294; and
(2) stainless steel round bar made to specification 410QDT (oil quenched), that is, grade 410, quenched and double tempered with an oil quenching medium.
The statement of reasons will be issued within 15 days.

In the matter of a ruling under section 90 of the Special Import Measures Act, R.S.C., 1985, c. S-15, as amended, on the question of which of two persons is the importer in Canada of fresh garlic originating in or exported from the People's Republic of China.
The Canadian International Trade Tribunal conducted an inquiry, pursuant to section 90 of the Special Import Measures Act, relative to a request by the Deputy Minister of National Revenue (Request No. MP-97-001), on behalf of D & L Business Canada Ltd., for a ruling on the question of which of two persons is the importer in Canada of fresh garlic originating in or exported from the People's Republic of China.
The Canadian International Trade Tribunal hereby rules that the importer in Canada of the said goods is D & L Business Canada Ltd. (Member Gracey dissenting).

REQUEST FOR PANEL REVIEW
Cold-reduced Flat-rolled Sheet Products of Carbon Steel
Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on September 1, 1998, a first Request for Panel Review of the order made by the Canadian International Trade Tribunal, respecting certain cold-reduced flat-rolled sheet products of carbon steel (including high-strength low-alloy steel) originating in or exported from the United States of America, was filed by counsel for U.S. Steel, LTV Steel Company, Inc., Bethlehem Steel Corp., National Steel Corporation, and Inland Steel Industries, Inc. with the Canadian Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The order was published in the Canada Gazette, Part I, on August 8, 1998 (Vol. 132, No. 32).
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the above-mentioned rules provides that:
(i) a Party or interested person may challenge the final determination in whole or in part by filing a Complaint in accordance with rule 39 within 30 days after the filing of the first Request for Panel Review [the deadline for filing a Complaint is October 1, 1998];

Explanatory Note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Article 1904 Panel Rules. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

PUBLIC HEARING
Maritimes & Northeast Pipeline Management Ltd. — Point Tupper Lateral Facilities Application
The National Energy Board ("the Board") has scheduled a public hearing with respect to an application made by Maritimes & Northeast Pipeline Management Ltd. ("M&NP") under the National Energy Board Act with respect to certain facilities to be constructed and operated by M&NP, hereinafter referred to as the Point Tupper Lateral.
The oral portion of the hearing will commence at 9 a.m. local time, Monday, November 23, 1998, at a location in Nova Scotia to be announced at a later date. The Board will conduct an environmental screening of the proposed facilities pursuant to the Canadian Environmental Assessment Act.
The Point Tupper Lateral would consist of 55 km of NPS 8 (219.1 mm O.D.) pipeline from a point near Goldboro, Guysborough County, Nova Scotia (approximately 6 km west of the Sable Offshore Energy Inc. ["SOEI"] gas plant) to the delivery point at the SOEI Fractionation Plant in Point Tupper. It would also include a further 4 km of NPS 6 (168.3 km O.D.) pipeline to two other delivery points (Stora Port Hawkesbury Ltd. and CGC Inc.) in the Point Tupper area, as well as associated metering, control and pressure regulation facilities. Construction of the Point Tupper Lateral, between the M&NP Mainline and the SOEI Fractionation Plant, would be carried out at the same time as construction of the SOEI Natural Gas Liquids ("NGL") pipeline. The Lateral would be installed in the same trench as the NGL pipeline. SOEI plans to begin clearing the right of way in January 1999, followed by pipeline construction from May to October 1999. SOEI plans to install a crossing of the Strait of Canso in late 1998. The crossing would consist of two NPS 8 (219.1 mm O.D.) pipelines. M&NP intends to purchase one of the two NPS 8 (219.1 mm O.D.) pipelines from SOEI.
