Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-05950 is approved.
1. Permittee: Sea Crest Corporation of Canada Ltd., St. John's, Newfoundland.
2. Type of Permit: To dump or load fish offal.
3. Term of Permit: Permit is valid from September 8 to December 31, 1998.
4. Loading Site(s): 46°55.94' N, 55°32.45' W, Lawn, Newfoundland.
5. Dump Site(s): 46°55.00' N, 55°32.80' W, at an approximate depth of 30 m.
6. Route to Dump Site(s): Most direct navigational route from the loading site to the dump site.
7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transportation to the approved dump site.
8. Method of Dumping: Direct release.
9. Rate of Dumping: As required by normal operations.
10. Total Quantity to be Dumped: Not to exceed 250 tonnes.
11. Material to be Dumped: Fish offal.
12. Requirements and Restrictions: It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Branch, Department of the Environment, 6 Bruce Street, Mount Pearl, Newfoundland A1N 4T3, (709) 772-5097 (Facsimile) at least 48 hours prior to the start of the first dumping operation to be conducted under this permit.
A written report shall be submitted to Mr. Rick Wadman, Environmental Protection Branch, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.
It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.
The dump site must be marked and all dumping must take place within 100 m of the dump site marker.
The loading and transport of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.
The fish offal and crab offal must be covered by netting or other material to prevent access by gulls.
This permit must be displayed in an area of the plant accessible to the public.
Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.
The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.
Fish offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

5. Dump Site(s): 43°34.71' N, 65°48.55' W, 500 m southwest of the fairway buoy of Pubnico Harbour, at an approximate depth of 11 m.
6. Route to Dump Site(s): Most direct navigational route from the loading site to the dump site.
7. Equipment: Clam dredge, backhoe, excavator, and towed and/or self-propelled barges.
8. Method of Dumping: Dumping shall take place within 100 m of a dump site marker buoy.
9. Rate of Dumping: As required by normal operations.
10. Total Quantity to be Dumped: Not to exceed 22 500 m3 scow measure.
11. Material to be Dumped: Dredged material consisting of gravel, sand, silt and clay.
12. Requirements and Restrictions:
12.1. It is required that the Permittee notify in writing, by facsimile or electronic mail, Mr. Adrian MacDonald, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, (902) 426-3897 (Facsimile), adrian. macdonald@ec.gc.ca (Electronic mail), at least 48 hours prior to each occasion that dredging equipment is mobilized to the loading site. The notification shall include the equipment to be used, contractor, contact for the contractor, and expected period of dredging.
12.2. A written report shall be submitted Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the loading and dumping activities occurred.
12.3. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.
12.4. The Permittee shall notify in writing Mr. Peter Winchester, Department of Fisheries and Oceans, 215 Main Street, Yarmouth, Nova Scotia B5A 1C6, (902) 742-6893 (Facsimile), at least 48 hours prior to the commencement of the first dredging operation to be conducted under this permit.
12.5. An Environmental Protection Plan designed to address concerns relating to shellfish and other fisheries resources, wildlife, navigation, gear conflicts, and spill prevention shall be submitted to Mr. Adrian MacDonald, identified in 12.1. The plan shall be approved by the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit.
12.6. Any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act shall be permitted to mount an electronic tracking device on any vessel engaged in loading and dumping activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall only be removed with the written consent of an inspector.
12.7. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.
12.8. The dredging and ocean dumping authorized by this permit shall only be carried out by the Permittee or with written approval from the Permittee.

Maintenance Dredging Services Tonnage Fees
The Minister of Fisheries and Oceans, pursuant to section 47 of the Oceans Act, hereby fixes the fees to be paid for maintenance dredging services in the St. Lawrence Ship Channel in accordance with the annexed Schedule, effective September 1, 1998, until August 31, 1999.

MAINTENANCE DREDGING SERVICES TONNAGE FEES SCHEDULE
1. The following definitions apply for the purpose of establishing and collecting fees to be paid for the provision of maintenance dredging services by the Canadian Coast Guard to ships transiting the St. Lawrence Ship Channel.
"draught" means the largest static draught of a ship during a transit.
"gross tonnage" means
(a) in the case of a ship that is subject to the 1969 Convention, the gross tonnage that is indicated on the International Tonnage Certificate for that ship or
(b) in the case of a ship that is not subject to the 1969 Convention, the gross tonnage or register tonnage that is indicated on the certificate of registry for that ship.
"Minister" means the Minister of Fisheries and Oceans.
"1969 Convention" means the International Convention on Tonnage Measurement of Ships, 1969.
"ship" means a vessel, boat, or craft carrying either a domestic or foreign flag, other than a pleasure craft, fishing vessel, and state and military ship.
"St. Lawrence Ship Channel" means the navigation channel of the St. Lawrence River between the upstream boundary of the Port of Montreal and the upstream end of Île aux Coudres.
"transit" means any upstream movement or downstream movement made by a ship that begins, stops or ends at a Canadian port and that includes all or part of the St. Lawrence Ship Channel.
2. Subject to sections 7 to 11, the fee applies to each ship that
(a) is on a transit in the St. Lawrence Ship Channel; and
(b) has a static draught of 5.0 metres or more during a transit.
3. Subject to sections 7 to 11, every ship shall pay to the Minister a fee obtained by multiplying the gross tonnage of that ship by $0.0345 for each transit, subject to a minimum fee of $25.00.
4. Each of the corporations identified in Column I shall pay to the Minister the fixed fee in the corresponding line in column II:

5. The fee set by section 3 shall be paid by the ship upon issuance of an invoice by the Minister or by a person authorized by the Minister to the ship or the authorized agent of the ship.
6. The fee set by section 4 shall be paid by each of the corporations mentioned therein upon issuance of an invoice by the Minister or by a person authorized by the Minister.
7. No fee is payable by a ship that is travelling non-stop through Canadian waters to, or from, a port in the United States without a stop at a Canadian port.
8. A stop at a Canadian port for the sole purpose of bunkering will not be subject to the fee.
9. A stop at a Canadian port for one or more of the following sole purposes will not be subject to the fee:
(i) to respond to a medical emergency;
(ii) to undertake emergency ship repairs;
(iii) to respond to a government department or agency request to stop; or
(iv) to make an overnight stop required due to the seasonal removal of lighted aids to navigation.
10. Subject to section 12, no fee is payable when a movement of a ship is within the boundaries of a port on the St. Lawrence Ship Channel.
11. Subject to section 12, no fee is payable by a ship on a transit
(a) beginning at the Port of Montreal and proceeding directly into the St. Lawrence Seaway, or
(b) ending at the Port of Montreal after proceeding directly from the St. Lawrence Seaway.
12. For purposes of the application of sections 10 and 11, the Terminal at Contrecoeur shall be deemed to be a destination distinct from the Port of Montreal.
13. Interest is payable on an overdue fee commencing 30 days after issuance of the invoice and is calculated pursuant to the Interest and Administrative Charges Regulations.*
